In 2009, the General Office of the State Council issued document No.66 (2009) issued by the State Council, namely "Notice on the Interim Measures for the Transfer and Continuation of the Basic Old-age Insurance for Employees in Urban Enterprises". According to the spirit of this notice, those who have not reached the age of receiving wages may not stop issuing endowment insurance and go through the formalities of surrender. Those who emigrate and settle in Hong Kong, Macao and Taiwan provinces shall be implemented in accordance with relevant state regulations. In other words, after 2009, social endowment insurance cannot be refunded before reaching the statutory retirement age stipulated by law. Article 14 (438+065,438+0) of the Social Security Law, which was implemented on July 65, 1965, also clearly stipulates that individual accounts cannot be redeemed in advance, and the bookkeeping interest rate cannot be lower than the fixed interest rate of financial institutions and banks, and interest tax is exempted. The balance of my deceased personal account can be inherited.

But before 2008, in many places, when migrant workers left the local area, individuals could indeed return part of their personal accounts to themselves when they applied. However, due to the low salary and low deposit base at that time, most enterprises still paid social endowment insurance according to 60% of the deposit base issued locally. For example, some areas in Shenzhen and Xiamen pay social endowment insurance according to the minimum level of local employees, so personal account assets are relatively small. Once you surrender, it means that your payment account has been saved, and the previous payment period will not be recalculated. After handling the social endowment insurance payment account again, the payment period needs to be recalculated, which is not cost-effective.

Before 2008, there were still many people who worked in factories and retired after 78 years of old-age insurance. Several of my cousins used to work in Guangdong. After leaving Guangdong, they think that the social endowment insurance paid by enterprises is useless. When I resigned, I retired my insurance, and everyone only retired a few thousand yuan. Compared with the fellow villagers who worked in Guangdong during the same period, some people insisted on working in Guangdong to make money. At present, the payment period has exceeded 15 years and reached the statutory retirement age stipulated by law, and at least 1000 kinds of old-age insurance can be received every month. After returning to rural daily life, my treatment in my later years was compared with those who applied for surrender. One is in the sky, the other is underground, totally ice and fire. But it's no use regretting now. You have to pay old-age insurance in your hometown.

According to the relevant provisions of the current social security law, it is not allowed to surrender before reaching the statutory retirement age stipulated by law. Because social endowment insurance is managed by two major accounts, corporate contributions belong to overall accounts, and individual contributions belong to personal accounts. The overall account belongs to the pension fund, and this money is non-refundable. At the statutory retirement age stipulated by law, if the payment period does not reach the stipulated payment period, you can continue to pay the fee until 15 years later. Only when you reach the legal retirement age stipulated by law, the social security contribution is not enough 15 years, and you are unwilling to pay again, can you apply for surrender after your application is confirmed by the social security agency, and only the principal and interest of your personal account will be refunded. After insurance retirement, it has nothing to do with retirement. In this life, I really can only rely on my children to support the elderly.

Generally speaking, after working in the construction site for seven or eight years and paying the endowment insurance, most people apply for surrender because they don't know the social security knowledge. After withdrawing their insurance, they still regret losing their retirement qualification. There are both subjective and objective reasons. According to today's requirements, insurance cannot be returned casually, which is actually a maintenance of the rights of the insured.
