Is it infringement to copy other people's works without their consent?

Not exactly.

China's copyright law did not recognize the copyright of copied works in the past, and the attitude of the revised copyright law to copying is still very vague. Starting from the law of art itself and the conditions for obtaining copyright, this paper shows that copying is not copying, and copying works can be original and should constitute works in the sense of copyright law. Copied works should have complete copyright, but their rights should be restricted. Giving the copied works complete copyright and proper interest protection conforms to the artistic law and is beneficial to the public and artistic authors. In order to promote the prosperity of culture, we should adopt a more clear and tolerant attitude towards copying works in legislation.

Copying works are based on the original, after all, different from the pure original, and it is likely to have some conflicts with the original in practice. Although it is strongly advocated that copied works enjoy complete copyright, due to their backwardness and derivative compared with the original works, in order to protect their interests, some restrictions should be imposed on the rights of the original works and their authors.
