Notice of the People's Government of Fujian Province on Implementing the Trial Rules for the Regulations on Science and Technology Secrecy in Fujian Province

Article 1 In order to implement the Regulations on Science and Technology Security formulated by the State Council and approved by the State Science and Technology Commission, strengthen the science and technology security work in our province, and protect and promote the socialist modernization, these Trial Measures are formulated. Article 2 The scope of scientific and technological secrecy:

1. inventions approved by the state;

2. It may be the key to scientific and technological inventions or patents;

3. Although important scientific and technological research achievements abroad are confidential;

4. Proprietary technology and traditional technology that are not available or kept secret abroad;

5 the State Council ministries, commissions, bureaus and provinces, municipalities and autonomous regions to introduce, promote and apply important scientific and technological achievements that have reached the domestic advanced level or international level;

6 varieties, technologies and imitation products imported from abroad through various channels that need to be kept confidential;

7. Sino-foreign joint ventures and the introduction of foreign advanced technologies, equipment and projects are part of the confidentiality clause in the agreement, which is a major reform to introduce, digest and absorb foreign advanced technologies and equipment;

8. All kinds of important rare and precious natural resources, animal and plant varieties, fine varieties, specimens and related scientific research materials unique to our province;

9. New theories and new treatment methods of traditional Chinese medicine, Chinese patent medicine, medicinal plants and combination of traditional Chinese and western medicine unique to our province;

10. The unique technical know-how in the traditional handicraft production in our province and the mechanized and semi-mechanized parts in the export handicraft industry;

1 1. New theories, new signs, new discoveries and new ideas that are of great significance to the development of science and technology and should not be made public temporarily;

12. scientific and technological development research, planning and other confidential scientific and technological information. Article 3 Scientific and technological secrets are classified into three levels: top secret, confidential and secret:

1. Those involving national security or China's unique science and technology, once leaked, will cause serious harm and heavy losses to the country or lose some advantages, and will be classified as top secret;

2. Science and technology that exceeds the international level and is of great significance to national construction and people's lives, once leaked, will cause great losses to the country and be classified as confidential;

3. Science and technology that has reached or approached the international level or advanced domestic level and is of great significance to national construction and people's lives, once leaked, will cause losses to the country, and it will be classified as a secret. Article 4 The examination and approval authority of scientific and technological secret projects:

1. For the invention project, the applicant shall put forward classification opinions when reporting, and report to the State Science and Technology Commission for approval after being audited by the Provincial Science and Technology Commission. The State Council, the relevant departments of the subordinate units in our province, should be reported to the competent department for examination and approval, submitted to the State Science and Technology Commission for examination and approval, and send a copy to the Provincial Science and Technology Commission for the record;

2. Top secret projects shall be examined and approved by the provincial competent department and bureau, and reported to the State Science and Technology Commission for the record. The relevant departments of the State Council reported to the competent department of our province for examination and approval, and sent a copy to the Provincial Science and Technology Commission for the record;

3 confidential projects, in accordance with the affiliation, approved by the competent department, bureau, the provincial science and Technology Commission for the record. The subordinate units of the relevant departments of the State Council in our province shall, according to the provisions of the competent department, send a copy to the provincial science and technology commission and the local science and technology commission for the record;

4. Secret-level projects shall be examined and approved by the relevant departments of the competent departments and bureaus, and copied to the local science and technology commission for the record. The subordinate units of the relevant departments of the State Council in our province shall be handled in accordance with the provisions of the competent department and send a copy to the local science and technology commission for the record;

5. Inter-departmental confidential projects shall be subject to professional centralized examination and approval, and the division of labor is as follows:

Medical treatment (including Chinese and Western medicine and medical devices) is under the jurisdiction of the Provincial Health Department; Drugs (including Chinese and western medicines and commonly used medicinal plants) are under the jurisdiction of the Provincial Administration of Medicine; Species resources of animals, plants and microorganisms: crops (including related wild plants), fruits, vegetables, sericulture, tea, livestock, pasture and veterinary drugs are under the jurisdiction of agricultural departments, woody plants, dried fruits, flowers, wild animals, plants and insects are under the jurisdiction of forestry departments, and microorganisms and spore plants are under the jurisdiction of their subordinate departments; Traditional handicraft technology is under the jurisdiction of the Second Light Industry Department; Computer software programs are centralized by application department; Other industrial and agricultural production technologies are centralized by the competent departments and bureaus of industry and agriculture respectively.

Where foreign exchange, foreign aid or foreign trade involves the transfer and sale of confidential science and technology, it must be reviewed by the relevant departments of the State Council or the Provincial Science and Technology Commission and reported to the State Science and Technology Commission for approval; Those belonging to national defense scientific and technological achievements shall be reported to the National Defense Science, Technology and Industry Committee for examination and approval. Article 5 When arranging scientific research, trial production and production projects, the units that have assigned tasks shall put forward opinions on the classification and specific confidential parts according to the provisions of Article 4 of these Detailed Rules. After the task is completed, if the original security level is found to be inappropriate, it can be adjusted. Article 6 The technical evaluation of confidential projects may be conducted by inviting experts from the same industry to evaluate them separately. When it is necessary to hold an appraisal meeting, the appraiser is required to keep it strictly confidential, and the responsibility should be investigated for external leaks. Seventh units open to the outside world, involving scientific and technological projects, should be subject to scientific and technological security review. Science and technology secret projects are not allowed to receive foreign visitors or take photos. Units that are not open to the outside world generally do not arrange foreigners to visit. If it is really necessary to arrange a visit, it must be approved by the leading organs at or above the competent department and bureau level, and do a good job in scientific and technological confidentiality. When key positions are approved for opening to the outside world, it is necessary to delimit the scope of foreign guests' visits and draw up the caliber of foreign introduction. Excerpts, photographs and videos are allowed, and they should be registered and signed for future reference. For places or projects that are not allowed to take photos, make audio or video recordings or shoot movies or television, it is necessary to explain to foreigners, Hong Kong, Macao and Taiwan and overseas Chinese in advance before receiving the visit. According to different reception objects, different reception methods and contents should be adopted.
