Subjectivity of law: what is the legal regulation of illegal and criminal acts that destroy grassland resources? Article 2 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Criminal Cases of Destruction of Grassland Resources states that those who illegally occupy grasslands and change the use of the occupied grasslands by more than 20 mu, or who are subject to administrative punishment for illegally occupying grasslands and change the use of the occupied grasslands by more than 10 mu within three years, shall be deemed as "a large number" as stipulated in Article 342 of the Criminal Law. Illegal occupation of grasslands and change of the use of the occupied grasslands shall be deemed as "causing massive destruction of cultivated land, forest land and other agricultural land" as stipulated in Article 342 of the Criminal Law: (1) Reclaiming grasslands to grow food crops, cash crops and trees; (2) Building kilns, building houses, building roads, dredging sand, quarrying, mining, borrowing soil and stripping turf on grasslands; (3) stacking or discharging wastes on the grassland, causing serious damage or pollution to the original vegetation of the grassland; (four) in violation of the planning of grassland protection, construction and utilization, planting pasture and feed crops, resulting in grassland desertification or serious soil erosion; (five) other circumstances that cause serious damage to the grassland. Article 3 Any functionary of a state organ who engages in malpractices for personal gain and violates the grassland law and other land management laws and regulations shall be deemed as "serious" as stipulated in Article 410 of the Criminal Law: (1) illegally approving the expropriation, requisition or occupation of more than 40 mu of grassland; (two) the illegal approval of expropriation, requisition and occupation of grasslands, resulting in the destruction of grasslands of more than twenty acres; (3) Illegally approving the expropriation, requisition or occupation of grasslands, resulting in direct economic losses of more than 300,000 yuan or other bad circumstances. Under any of the following circumstances, it shall be deemed as "causing particularly heavy losses to the interests of the state or the collective" as stipulated in Article 410 of the Criminal Law: (1) illegally approving the expropriation, requisition or occupation of more than 80 mu of grassland; (two) the illegal approval of expropriation, requisition and occupation of grasslands, resulting in the destruction of grasslands of more than forty acres; (3) Illegal approval of expropriation, requisition or occupation of grasslands, resulting in direct economic losses of more than 600,000 yuan or other particularly bad circumstances. Article 4 Whoever obstructs grassland supervisors and inspectors from performing their duties according to law by violence or threats, which constitutes a crime, shall be investigated for criminal responsibility for the crime of obstructing official duties in accordance with the provisions of Article 277 of the Criminal Law. Whoever incites the masses to violently resist the enforcement of grassland laws and administrative regulations, which constitutes a crime, shall be investigated for criminal responsibility for the crime of inciting violence to resist the enforcement of laws in accordance with the provisions of Article 278 of the Criminal Law. Article 5 Where a unit commits an act specified in Article 342 of the Criminal Law, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be convicted and punished according to the conviction and sentencing standards specified in this Interpretation. Article 6 Whoever repeatedly commits illegal and criminal acts of destroying grassland resources and fails to deal with them shall be investigated for criminal responsibility according to law and convicted and punished according to the cumulative quantity and amount. Article 7 Grassland as mentioned in this Interpretation refers to natural grassland and artificial grassland. Natural grassland includes grassland, grass hill and grass slope, and artificial grassland includes improved grassland and returning farmland to grassland, excluding urban grassland. Objectivity of law: Article 13 of the Criminal Law: Endangering national sovereignty, territorial integrity and security, splitting the country, subverting the people's democratic dictatorship and overthrowing the socialist system, disrupting social and economic order, infringing on state-owned property or property collectively owned by working people, infringing on citizens' personal rights, democratic rights and other rights, and other acts endangering society are all crimes, but the circumstances are obviously minor and the harm is not great.
