Regulations of Hefei Municipality on Water Environment Protection (revised on 20 18)

Chapter I General Provisions Article 1 In order to protect and improve the water environment and promote comprehensive, coordinated and sustainable economic and social development, these Regulations are formulated in accordance with the People's Republic of China (PRC) Environmental Protection Law, the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Water Pollution Prevention Law and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the water environmental protection of rivers, lakes, reservoirs, ponds, canals, wetlands and other surface water bodies and underground water bodies within the administrative area of this Municipality. Article 3 Water environmental protection adheres to the principles of scientific planning, unified management, graded responsibility, comprehensive management and public participation. Give priority to the protection of drinking water sources, make rational use of water resources, strictly control water pollution, and take scientific water safety precautions to promote the overall improvement of the water environment. Article 4 The people's governments of cities, counties (cities), districts and townships shall be responsible for the quality of water environment within their respective administrative areas, and implement the responsibility system of government target assessment.

The management institutions of development zones and various industrial parks shall, in accordance with the requirements of the people's governments of cities, counties (cities) and townships, do a good job in water environmental protection in their respective regions. Fifth city, county (city) district environmental protection administrative departments to implement unified supervision and management of water environmental protection within their respective jurisdictions.

Development and reform, planning, urban and rural construction, water administration, urban management, transportation, maritime affairs, agriculture, animal husbandry and fishery, forestry, gardens, health and other departments should do a good job in the supervision and management of water environmental protection within the scope of their duties.

If the water environmental supervision and management department listed in the second paragraph of this article fails to perform its supervision and management duties, the competent administrative department of environmental protection may put forward rectification opinions or suggestions to the people's government at the same level or at a higher level. Article 6 The municipal and county (city) people's governments shall establish working mechanisms such as joint law enforcement, information sharing, public participation and ecological compensation for water environmental protection. Chapter II Management of Water Environment Article 7 The municipal, county (city) people's governments and the administrative agencies of development zones shall, in accordance with the provisions on the reduction and control of the total discharge of key water pollutants in their respective administrative areas, implement the total control system of key water pollutants.

For areas that exceed the control target of total discharge of key water pollutants or fail to complete the improvement target of water environmental quality, the competent administrative department of environmental protection of the people's government of the city or county (city) District shall suspend the examination and approval of environmental impact assessment documents of new construction projects with total discharge of key water pollutants in the responsible area according to law. Article 8 The discharge of water pollutants shall conform to the national or local standards for the discharge of water pollutants, and conform to the total discharge control indicators of key water pollutants.

In violation of the provisions of the preceding paragraph, the competent administrative department of environmental protection of the people's government of the city or county (city) District shall order it to make corrections or limit production or stop production for rectification, and impose a fine of100000 yuan or more1000000 yuan or less; If the circumstances are serious, it shall be reported to the people's government with the power of examination and approval and ordered to suspend business or close down.

Water supply, power supply, gas supply and other relevant units shall cooperate in accordance with the law and implement corresponding measures. Article 9 For acts that seriously damage the water environment, the competent administrative department of environmental protection or other administrative departments exercising supervision and management in accordance with the provisions of these Regulations shall order those responsible to eliminate environmental hazards within a time limit and compensate for environmental losses. Tenth city, county (city) District People's government, development zone management agencies should determine the institutions engaged in drainage management is responsible for the drainage management within their respective jurisdictions.

City, county (city) district, development zone drainage management agencies shall organize the preparation of special drainage planning in this area, and regularly dredge and maintain drainage facilities such as drainage pipe network, box culvert and open channel. Eleventh Township People's governments and sub-district offices are responsible for the supervision and management of water environmental protection, and should immediately stop illegal acts, protect the site and report to the relevant administrative departments.

In violation of the provisions of the preceding paragraph, failing to perform the duties of supervision and management according to law, the administrative responsibilities of the competent leaders and the main responsible persons shall be investigated according to law. Twelfth the implementation of the city, county (city) district, township, street office leaders responsible for the regional river (section) long responsibility system. Its main responsibilities are:

(a) the protection and management of patrol rivers;

(two) to supervise the implementation of river regulation planning and scheme;

(3) Coordinate relevant issues in river regulation. Thirteenth water tourism, water sports, water management and other development and utilization activities, shall not affect the safety of flood control, water pollution, damage to the river and its supporting facilities. The relevant administrative departments shall solicit the opinions of the competent departments of environmental protection and water administration before approval. Article 14 Under the premise of regional macro-control and regional total pollutant discharge control, pollutant discharge units may trade emission rights indicators according to law.

Gradually establish a water right transfer system that combines government regulation and market allocation. Fifteenth responsible for water environmental protection of state organs and their staff in violation of the provisions of this Ordinance, do not perform the duties of supervision and management or other obligations, the directly responsible person in charge and the directly responsible personnel shall be investigated for administrative responsibility according to law. Chapter III Utilization of Water Resources Article 16 A water use system combining total water use control with annual water use plan management shall be implemented.

City, county (city) District People's Government shall, according to the water allocation plan formulated by the people's government at a higher level, establish an index system for total water consumption control in this administrative region. Seventeenth city, county (city) district water administrative departments shall not approve the total water intake has reached or exceeded the control index of the construction project in the region to add water; In areas where the total amount of water intake is close to the control index, the approval of new water intake is restricted.
