Regulations of Hengshui Municipality on Property Management (202 1 Revision)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of property management-related subjects, improve people's living and working environment, meet people's growing needs for a better life, and create a social governance pattern of * * * *, these Regulations are formulated in accordance with the Civil Code of People's Republic of China (PRC), the Property Management Regulations of the State Council and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management and its supervision and management within the administrative area of this Municipality.

The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities, equipment and related sites within the property management area through self-management or entrusting property service providers to make joint decisions, and to maintain environmental sanitation and related order. Property service providers include property service enterprises and other managers. Article 3 The people's governments of cities and counties (cities, districts) shall incorporate property management into the development planning and community governance system of modern service industry, formulate and implement supporting policies for modern property service industry, promote the construction of smart and safe communities, and promote the standardization and marketization of property management. Article 4 The owners' congress, owners' committee and property service providers shall, under the leadership of community party organizations, carry out property management activities according to laws and regulations, and establish and improve the deliberation and coordination mechanism of neighborhood (village) committees, owners' committees and property service providers under the leadership of community party organizations.

Guide and support party member among the owners to become a representative of the owners, a member of the owners' committee or the property management committee through legal procedures, play a vanguard and exemplary role, and perform his duties according to law. Fifth city and county (city, district) housing and urban and rural construction departments in accordance with the principle of territorial management, responsible for property supervision and management within their respective jurisdictions, and perform the following duties:

(a) to study and formulate policies related to property management and property service industry norms;

(two) supervision and management of property service enterprises and employees;

(three) the organization and management of property management bidding activities;

(four) the record of the property service contract and the record of the property undertaking inspection;

(five) the supervision and management of maintenance funds;

(six) to coordinate the handling of contradictions and disputes in property management;

(seven) other duties as prescribed by laws and regulations. Sixth city and county (city, district) departments in accordance with the division of responsibilities, jointly do a good job in the supervision and management of * * property:

(a) the civil affairs department is responsible for guiding the residential areas that have not implemented property management to rely on the neighborhood (village) committees to implement autonomous management;

(two) the administrative examination and approval department is responsible for the planning, adjustment and change management of property service houses, elevator installation and electric vehicle charging, and assists in the division of property management areas;

(three) the comprehensive administrative law enforcement department of urban management is responsible for investigating and dealing with illegal activities such as raising livestock and poultry, occupying and destroying green space, cutting down trees without authorization, and posting advertisements without authorization. ; Administrative penalties shall be imposed on illegal acts such as changing the use, form, color or materials of buildings, structures and other facilities without authorization, changing the facade of houses without authorization, illegally building, and cooking fume pollution in catering services;

(four) the market supervision and management department is responsible for investigating the behavior of engaging in unlicensed operation in the property management area; Responsible for the safety supervision of elevators, boilers and other special equipment in the property management area, and investigate and deal with illegal acts in the installation, renovation, maintenance and use of special equipment; Responsible for the supervision and inspection of property service charges within the property management area, and investigate and deal with all kinds of price violations according to law;

(5) The public security organs shall be responsible for community policing, strengthen public security prevention in property management areas, supervise and inspect public security monitoring, and investigate and deal with illegal acts affecting public security and public order in residential quarters;

(six) the competent department of ecological environment is responsible for the supervision and management of environmental protection within the property management area;

(seven) the price department in conjunction with the relevant departments is responsible for the formulation and adjustment of government-guided property service charges;

(eight) the health department is responsible for the prevention and control of infectious diseases and the supervision of drinking water hygiene in the property management area;

(nine) other relevant competent departments in accordance with their respective responsibilities to do a good job in property supervision and management. Seventh street offices (Township People's Government) shall perform the following duties of property supervision and management:

(a) to organize and guide the establishment of the owners' congress, elect the owners' committee, set up the property management committee, organize and guide the general election of the owners' committee, and be responsible for the record of the owners' committee;

(two) to guide and supervise the owners' congress and the owners' committee to perform their duties according to law;

(three) to guide and supervise the property service providers to perform their obligations according to law, and to supervise and inspect the implementation of property services;

(four) the establishment of property management contradictions complaint mediation mechanism, coordinate the handling of property management disputes;

(five) responsible for the management of property files, assist in collecting and verifying the credit information of property service enterprises and their project managers within their respective jurisdictions;

(six) other duties as prescribed by laws and regulations.

Neighborhood (village) committees assist and cooperate with neighborhood offices (township people's governments) to carry out property supervision and management, and guide and supervise the daily work of owners' congress, owners' committee and property service providers.
