Provisions of Lanzhou Municipality on the Administration of Temporary Population

Chapter I General Provisions Article 1 In order to strengthen the management of temporary population, safeguard the legitimate rights and interests of temporary population, promote economic and social development, and maintain social order, these Provisions are formulated in accordance with the Interim Measures for the Administration of Temporary Population in Gansu Province and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the management of temporary population within the administrative area of this Municipality.

The temporary residence management of compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and foreigners in this city shall be implemented in accordance with the relevant provisions of the state. Article 3 The temporary population as mentioned in these Provisions refers to:

(a) no permanent residence in the administrative area of this Municipality;

(2) Citizens of this Municipality leave the county or district where their permanent residence is located and stay in other counties or districts temporarily;

(3) Citizens of Yongdeng, Gaolan, Yuzhong and Honggu leave their permanent residence and stay in areas where the people's governments at or above the county level decide to be included in key management.

The temporary population mentioned in these Provisions does not include the following persons:

(a) citizens with permanent residence in Chengguan, Qilihe, Xituan and Anning districts live in the four districts;

(2) Being appointed by local organs, organizations, enterprises and institutions or invited by relevant units of this Municipality to engage in official activities, give lectures, conduct scientific and technological exchanges, conduct trade negotiations and participate in study and training in this Municipality;

(three) to enter universities, technical secondary schools and other schools approved by the administrative department of education to study or borrow;

(four) a valid marriage certificate, and one of the husband and wife has a permanent residence and a fixed residence in this city;

(five) to participate in the tourism organizations or units organized by travel agencies approved by the tourism administrative department to organize group tours in this city;

(six) the Municipal People's Government considers it inappropriate to manage the temporary population. Article 4 The principles of "government leadership, participation of all parties, respective responsibilities and comprehensive management" and "who is in charge, who is responsible, who employs, who lives in, who is responsible, who rents and who is responsible" shall be implemented in the management of temporary population.

The people's governments at all levels and their agencies shall strengthen the leadership over the management of temporary population, establish and improve the leadership responsibility system, and incorporate the management of temporary population into the agenda of the government at the corresponding level. Fifth public security organs at all levels are the competent authorities for the registration and management of temporary residents, and perform the following duties:

(a) for temporary residence registration, issuance, inspection, change and cancellation of temporary residence permits;

(two) the establishment of temporary population files, responsible for the statistics of temporary population;

(3) Establish and improve the registration management system for temporary residents.

Family planning, labor, industry and commerce, education, housing management, health, urban construction, civil affairs, justice and other administrative departments shall, in accordance with their respective functions and powers, cooperate with the public security organs to do a good job in the management of temporary residents.

Organs, organizations, military units, enterprises and institutions, and neighborhood (village) committees shall assist public security organs and administrative departments in the management of temporary residents. Article 6 The county and district people's governments may, according to the actual situation, set up a comprehensive management service institution for the temporary population, which is attended by the public security and other relevant administrative departments, and be responsible for the management of the temporary population within their respective administrative areas; In the streets, townships, towns, communities, enterprises and institutions where the temporary population is relatively concentrated, you can set up a branch of the comprehensive management service for the temporary population, and under the guidance of the comprehensive management service for the temporary population at a higher level, be specifically responsible for the management of the temporary population in the region or the unit. Article 7 The lawful rights and interests of temporary residents shall be protected by law.

The public security organs, the relevant administrative departments and the temporary population management service institutions shall seriously accept the complaints, accusations and exposures of the temporary population, and shall promptly deal with them according to law when their legitimate rights and interests are infringed.

When the temporary population encounters difficulties in this city and asks the relevant departments for help, the relevant departments shall give necessary help.

Temporary residents shall abide by laws, regulations, rules and other relevant provisions of the citizens' convention of this Municipality, consciously obey management and actively maintain social order.

Temporary residents who have made outstanding contributions to the city's economic construction and spiritual civilization construction, or have outstanding deeds of being courageous, shall be commended and rewarded by the county and district people's governments or relevant departments in the temporary residence; Outstanding achievements, but also submitted to the Municipal People's government awarded the title of honorary citizen. Chapter II Temporary Registration and Temporary Residence Permit Management Article 8 The system of temporary registration and application for temporary residence permit shall be implemented in the management of temporary population.

The temporary population who intends to stay in this city shall, within 7 days of arriving at the temporary residence, declare the temporary registration to the local police station; If you intend to stay for more than 30 days and reach the age of 16, you shall apply for a temporary residence permit at the same time as you apply for temporary residence registration. Ninth to declare temporary residence registration and apply for a "temporary residence permit", the following valid documents shall be submitted:

(a) temporary identity card or other valid identification;

(two) the legal documents of the units or individuals that shelter the temporary population;

(3) If the temporary population is a person of childbearing age, it shall also submit the marriage and childbearing certificate examined by the people's government of the township or town or the sub-district office of the temporary residence;

(four) engaged in labor services and production and business activities, but also to submit the "employment registration card" issued by the township people's government or the labor administrative department where the household registration is located.
