Measures of Lhasa Municipality on Letters and Calls

Chapter I General Provisions Article 1 In order to further improve the efficiency of letters and visits, maintain the normal order and social stability of letters and visits, and protect the legitimate rights and interests of petitioners, these Measures are formulated in accordance with the provisions of laws and local regulations such as the Regulations on Letters and Visits and the Regulations on Letters and Visits in Xizang Autonomous Region, and in combination with the actual situation of this Municipality. Article 2 Letters and visits refer to activities conducted by citizens, legal persons and other organizations by means of letters, emails, faxes, telephone calls and visits. Reflect the situation to the state organs, put forward opinions, suggestions or complaints, shall be handled by the relevant state organs according to law.

Petitioners refer to citizens, legal persons and other organizations who reflect the situation to state organs and put forward their opinions, suggestions and demands in the form of letters, telephone calls, e-mails and visits. Article 3 These Measures shall apply to the letters and visits of petitioners within the administrative area of this Municipality and the letters and visits of state organs at all levels in this Municipality. Article 4 State organs at all levels should attach importance to the work of letters and visits, carefully handle letters, calls, emails and receive visitors, publicize the system of letters and visits, and ensure that the work of letters and visits is carried out in an orderly manner according to law. Article 5 Citizens, legal persons and other organizations engaged in letters and visits according to law shall be protected by law. Encourage and support the complainant to put forward opinions and suggestions on the social, political, economic, cultural and religious work of this Municipality. Article 6 The work of letters and visits shall follow the principle of territorial management, graded responsibility, centralized handling, whoever is in charge shall be responsible, and the combination of solving problems in accordance with the law, timely and on the spot and guiding education. Seventh state organs at all levels should adhere to scientific and democratic decision-making and administration according to law, strict, fair and civilized reception, timely investigation and resolution of contradictions and disputes. Article 8 The petition departments of state organs at all levels shall not spread the contents of petitions to irrelevant personnel, and shall not take the petitions out of the organs without authorization; Shall not disclose or disseminate the work instructions and petition materials to irrelevant personnel.

If the staff handling the complaint reporting matters have a direct interest in the complaint reporting matters or the complainant, they should withdraw. If the petitioner requests the petition staff to withdraw, it shall submit a written application, and whether or not to withdraw shall be decided by the department. Ninth state organs at all levels should establish and improve the accountability system for letters and visits, and investigate the responsibility of relevant personnel for dereliction of duty in the work of letters and visits in accordance with relevant laws and regulations and these Measures. Tenth state organs at all levels shall incorporate the performance of letters and visits into the evaluation system of leading bodies and leading cadres, and take whether the problems of letters and visits are solved at the corresponding level and in the local area as an important basis for performance evaluation. Units and individuals that have made remarkable achievements in the work of letters and visits shall be commended and rewarded. Chapter II Rights and Obligations of Petitioners Article 11 Petitioners shall enjoy the following rights to petition:

(a) put forward suggestions, criticisms and opinions;

(two) to lodge a complaint, report or accuse;

(three) reflect the situation, or solve practical problems;

(four) to urge the handling or application for review. Twelfth letters and visits should truthfully reflect the situation and abide by the petition system. Most people have opinions, suggestions and requirements, which should generally be in written form; If visits are needed, representatives shall be elected, and the number of representatives shall not exceed 5. Article 13 A complainant shall not commit any of the following acts:

(1) illegally gathering, containing, attacking state organs, intercepting official vehicles or blocking traffic around the offices and public places of state organs;

(2) Insulting, beating, threatening the staff of state organs or illegally restricting the personal freedom of others;

(3) Carrying dangerous goods and controlled devices;

(four) stay in the reception place for letters and visits, make trouble, or leave people who can't take care of themselves in the reception place for letters and visits;

(5) Inciting, colluding, coercing or indulging in property, manipulating others' letters and visits behind the scenes or taking the opportunity to collect money in the name of letters and visits;

(6) fabricating or distorting facts, falsely accusing or framing others;

(seven) other acts that disrupt public order and endanger the state and public safety. Chapter III Responsibilities of Letters and Visits Article 14 The departments under the people's governments of cities and counties (districts) shall set up letters and visits offices or be equipped with letters and visits staff suitable for their work tasks; Township and sub-district offices shall set up reception rooms for letters and visits, equipped with full-time or part-time staff for letters and visits. Using the existing information network resources, we will gradually establish a petition information system for state organs at all levels to realize information interconnection between counties and departments.

State organs at all levels shall announce to the public the address, postal code, e-mail, time, place and telephone number of the reception room for letters and visits. Fifteenth state organs at all levels of the petition agencies are mainly responsible for:

(a) to register letters and visits and accept matters that belong to the management of administrative organs at the same level;

(2) Accepted letters and visits shall be forwarded to relevant departments for handling according to the division of responsibilities;

(three) to undertake the petitions transferred and assigned by the higher authorities;

(four) to handle the letters and visits of the lower authorities, and to review the completion reports submitted by them;

(five) handling letters and visits, and giving a written reply to the complainant;

(six) comprehensive study of letters and visits, timely reflect the demands, opinions and suggestions of the masses to the leaders, and make suggestions;

(seven) other matters related to letters and visits.
