Measures for the Administration of Altered Design of Railway Construction Projects Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Regulations on Quality Management of Construction Projects, the Regulations on Survey and Design of Construction Projects, the Administrative Measures on Survey and Design of Railway Construction Projects and relevant regulations in order to standardize the management of design changes of railway construction projects, ensure the quality and safety of construction projects, and reasonably control the project investment.

Article 2 These Measures shall apply to large and medium-sized railway construction projects and projects with changes above designated size, and other railway construction projects may refer to them.

Article 3 The term "design change" as mentioned in these Measures refers to the activities of changing the design within six months after the construction drawing of a railway construction project has passed the examination and the preliminary acceptance of the project has passed. If the main contents of the preliminary design approval need to be adjusted in the construction drawing stage, including the construction drawing budget exceeding the total budget of the preliminary design approval, it shall be reported to the preliminary design review department for approval according to the first-level design change procedure.

Article 4 Design changes must be adhered to? Approval before implementation, design before construction? In principle, the design should be changed in strict accordance with laws and procedures, and it is strictly forbidden to change the design in violation of regulations.

Fifth construction units should strengthen the management of design changes, survey and design units should improve the quality of preliminary design and construction drawings, and effectively reduce design changes. All contractors should cooperate with each other, and the preliminary design review department should earnestly perform its duties, do a good job in design changes, and ensure the normal progress of construction projects.

Article 6 Design changes must be scientific and reasonable, and seek truth from facts. While ensuring the safety, quality and use function of the project, the project investment shall be strictly controlled in accordance with the provisions of the state and the Ministry of Railways on construction and investment management.

Chapter II Changes of Design Classification

Seventh railway construction project design changes are divided into first-level changes and second-level changes.

Article 8 A change in the contents of the preliminary design examination and approval, which meets one of the following conditions, is a first-class design change.

1. Change the approved construction scale, main technical standards, main schemes and major engineering measures;

Construction scale refers to the scope of the project and the scale of the station (section, station);

The main technical standards refer to railway grade, number of main lines, designed running speed, line spacing, minimum curve radius, restricted gradient or maximum gradient, traction type, locomotive type or EMU type, traction quality, effective length of arrival and departure lines, blocking type or traffic command mode, passenger train operation control mode and building clearance;

Major schemes and major engineering measures refer to approved lines, stations, key bridges and crossings, station construction schemes and important environmental and water conservation measures (see Annex 1 for details).

2. Change the design principles of major disciplines approved by the preliminary design.

3. Adjust the total construction period approved by the preliminary design.

4. The investment in a construction project exceeds the total budgetary estimate approved by the preliminary design.

5. The relevant norms and regulations of the state and the Ministry of Railways have been greatly adjusted.

Article 9 Design changes other than the first-level design changes are second-level design changes.

Article 10 Category I design changes are divided into design change reasons, and a design change reason is a design change.

The second type of change design is divided into work sites, and an inseparable one-time change caused by the same work site or the same disease is called change design. Different changes of the same worksite, different worksites of the same disease and different paragraphs of the same change should be divided into different design changes, and it is strictly forbidden to merge or split the design changes.

Chapter III First-level Change Design Procedure

Article 11 The first-level design change procedures are divided into putting forward design change suggestions, joint examination of design change schemes, preparation of design change documents, preliminary examination of design change documents, approval of design change documents, examination and issuance of change construction drawings, etc.

Article 12 puts forward suggestions for changing the design.

After the construction drawing has passed the examination and delivery, the construction, construction, supervision, survey and design units may put forward design change suggestions to the construction unit for the contents in the design documents that meet the requirements of the first-class design change. The design change proposal shall be put forward before the implementation of the change, and the design change proposal (Annex 2) shall be filled in.

Article 13 The joint review changes the design scheme

The construction unit shall organize survey, design, construction, supervision and other units to conduct on-site survey and joint review of the first-level design change scheme, analyze the reasons for the design change in detail, study and put forward the design change category and design change scheme, determine the responsible unit and cost treatment opinions, and form the minutes of joint review of design change signed by the participants (Annex 3).

The construction unit shall perform internal procedures to confirm the main contents of the minutes of joint review of design changes, and if it is necessary to perform the decision-making procedures of the board of directors, it shall perform the decision-making procedures.

Fourteenth in the process of construction project implementation, design changes that endanger safety need to be dealt with immediately, and the construction unit shall organize survey, design, construction, supervision and other units to put forward plans for emergency treatment. If the design is changed to the first level, it shall be reported to the relevant departments of the Ministry of Railways as required. When it is important or necessary, the appraisal center and the industry management center will determine the change design scheme on the spot, and the construction unit will first carry out construction preparation and emergency treatment according to the determined scheme.

Fifteenth changes in the preparation of design documents

The survey and design unit shall prepare the change design documents in strict accordance with the relevant provisions of the Ministry of Railways, the minutes of joint review of change design and the determined safety emergency plan. The first type of design change documents shall include the reasons for the design change, the design change scheme, the engineering quantity and budget estimate, the original design scheme, the engineering quantity and budget estimate, relevant original design documents and design change drawings, economic and technical comparison data and analysis instructions; The design depth of the first-level change design is the preliminary design depth, and the work site is designed according to the design requirements of key bridges and tunnels in the preliminary design stage.

Level 1 change design documents should generally be completed within 30 days after the minutes of joint review are issued. Under special circumstances, the completion time of the first-level change design documents shall be determined by the construction unit and the survey and design unit through consultation.

Article 16 Changes of design documents in the first instance.

The construction unit shall conduct a preliminary examination of the design documents for the first-level changes, and the design changes involving major issues of environmental protection and water conservation shall first be reported to the competent department of environmental protection and water conservation of the Ministry of Railways. After approval, the preliminary examination opinions will be formed and submitted to the Ministry of Railways together with the first-level change design documents.

Seventeenth approved the change of design documents.

The preliminary design review department shall organize on-site verification as soon as possible and put forward clear requirements after receiving the first-level change design documents. For those who meet the examination and approval conditions, the examination and approval is generally completed within 30 working days; If supplementary information is needed, it shall timely put forward supplementary requirements and give a separate reply within 20 working days after the supplementary information is provided.

Eighteenth audit issued to change the construction drawing.

The construction unit shall, according to the approval of the first-level design change, organize the survey and design unit to complete and review the construction drawing, send the qualified construction drawing together with the Notice of Design Change (Annex 4) to the construction and supervision unit, and sign a supplementary construction agreement with the construction unit for the part that is not the responsibility of the construction unit.

The fourth chapter Ⅱ type change design procedures

Nineteenth secondary design change procedures are divided into putting forward design change suggestions, conducting on-site verification, determining design change plans, reviewing and issuing change construction drawings, etc.

If it is necessary to make secondary design changes after the construction drawing is approved for delivery, the construction, construction, supervision, survey and design units may put forward design change suggestions, fill in the design change suggestions, and explain the reasons for the secondary design changes in detail.

Twenty-first the implementation of on-site verification.

After receiving the design change proposal, the construction unit shall organize on-site verification and confirmation, take photos of the current situation, objectively put forward verification and confirmation opinions for the design change proposal, and the confirmer shall sign the confirmation opinions. After signing, the confirmation opinions and image data are included in the changed design documents for safekeeping.

Twenty-second determine the change of design scheme.

The construction unit shall organize survey, design, construction, supervision and other units to jointly review the change design suggestions and on-site confirmation results, analyze the reasons for the change design in detail, study and determine the change design scheme and confirm the classification of the change design, determine the responsible unit and the cost treatment opinions, and form the minutes of the joint review of the change design signed by the participants.

The construction unit shall perform internal procedures and confirm the contents of the minutes of joint review of design changes, which shall be implemented after being signed by the competent leader or main leader.

Twenty-third class II design changes endanger safety, the construction unit shall organize and determine the design change plan on the spot, and carry out construction preparation and emergency treatment according to the determined plan.

Twenty-fourth examination and issuance of construction drawings.

The construction unit shall, according to the determined change design scheme, organize the survey and design unit to prepare the construction drawing. Generally, the survey and design unit shall complete the construction drawing within 10 days after the "minutes of joint review of design changes" is issued.

The construction unit shall organize the audit of the construction drawings, and send the qualified construction drawings together with the notice of design change to the construction and supervision units.

Chapter V Expenses for Changing Design

Twenty-fifth level design change budget by the survey and design units in accordance with the preliminary design approved budget preparation principles, increase or decrease the amount of work and costs, and in accordance with the provisions of the Ministry of Railways for approval.

The engineering cost caused by Class II design change shall be compiled by the survey and design unit according to the engineering quantity of design change, the construction contract and the budgetary principle of preliminary design approval, and the construction unit shall organize the examination and approval. The expenses borne by the construction unit shall be charged in the reserve fund.

Twenty-sixth design changes caused by responsibility, which belongs to the responsibility of the construction unit, the construction unit shall bear the losses caused by the design changes in accordance with the provisions; If it is the responsibility of the survey and design unit, the survey and design unit shall undertake the survey and design work of changing the design free of charge, and bear the losses caused by changing the design according to the regulations; If it is the responsibility of the construction party, the construction unit shall bear the losses caused by the design change.

Twenty-seventh design changes caused by non-liability reasons, which are force majeure, shall be handled in accordance with the contract; Belong to the scope of risk responsibility, according to the relevant provisions of risk responsibility; Other design changes, increase or decrease the project cost, except the relevant provisions, shall be borne by the construction unit, and the relevant matters shall be specified in the contract.

Twenty-eighth class I design changes caused by non-liability reasons shall pay the survey and design fees according to the approved design changes; The survey and design fee for the first-class design change caused by the responsibility shall be borne by the responsible unit.

No additional survey and design fees are charged for secondary design changes.

Twenty-ninth units and individuals that save investment in design changes shall be rewarded in accordance with the relevant provisions of the state and the Ministry of Railways.

Thirtieth design changes to perform the examination and approval procedures and after approval, the cost can be included in the project budget; If the examination and approval procedures are not fulfilled and approved, the expenses shall not be included in the project budget.

Chapter VI Management of Change Design

Thirty-first preliminary design review department is responsible for the review of level I design changes, and complete the review of level I design changes within the prescribed time limit; Check, count and analyze the first-class design changes, and put forward opinions and suggestions to improve the management of survey and design.

Thirty-second industry management center should strengthen the supervision and inspection of the design change management of the construction unit, and the inspection results should be included in the assessment of the construction unit, and put forward suggestions for punishment for violations of design changes.

Article 33 The construction unit must strengthen the organization and management of design changes, formulate the design change management system, clarify the internal management procedures and work standards, implement the competent leaders, competent departments, co-management departments and responsible personnel, establish the assessment system and implement the assessment. Regularly make statistics and analysis on the use of secondary design changes and reserve funds, report to the appraisal center every year, and send a copy to the Ministry of Planning and Construction and the industry management center.

Thirty-fourth survey and design units should improve the internal survey and design change management system, improve the quality of preliminary design and construction drawings, avoid class I design changes and reduce class II design changes. Changes should be made in a reasonable, systematic and timely manner to reduce engineering losses and delays, and at the same time prevent the design from being changed again due to work mistakes. Shall not resort to deceit or collusion with other units in the process of changing the design.

Thirty-fifth construction units should do a good job in the construction process of on-site construction drawing verification and geological data confirmation, and ask questions to supervisors and construction units in a timely manner; Actively participate in the research of changing design scheme, and organize construction in strict accordance with changing design and construction drawing; Shall not resort to deceit or unauthorized construction in the process of changing the design.

Thirty-sixth supervision units should carefully check the design documents, and timely notify the survey and design units and construction units of the problems found in the survey and design and the problems raised by the construction unit; Actively participate in the study of changing the design scheme, supervise according to the changed design and construction drawing, and it is strictly forbidden to change the construction without approval.

Thirty-seventh construction, survey and design units should establish a change design management account, regular analysis and research, find out the existing problems, improve survey and design management, and do a good job in filing the change design data. Changes to design files include:

1. Change the design scheme;

2. On-site confirmation opinions and video materials;

3. Change the minutes of joint review of design;

4. Change the design documents;

5. Preliminary opinions on changing the design;

6. Approval of design changes;

7. Change the design notice and change the design and construction drawing.

Chapter VII Accountability

Thirty-eighth administrative personnel and related staff who violate laws and regulations in the management of design changes shall be investigated for responsibility in accordance with the relevant provisions of the state and the Ministry of Railways.

Article 39 If a Class I design change occurs due to the reasons of the construction unit, and the construction unit violates the design change management regulations, the responsibilities of the leaders and relevant personnel of the construction unit shall be investigated in accordance with the Interim Measures for Accountability of Managers of Railway Construction Units, and shall be included in the assessment of the construction unit.

Article 40 The construction unit shall include matters related to the accountability of the contractor in the contract, investigate and deal with the irregularities of the contractor in changing the design through the contract, record them as bad behaviors, and incorporate them into the credit evaluation or construction drawing assessment, and urge the contractor to investigate and deal with the irregularities. If the violation is serious, it shall be submitted to the Ministry of Railways for handling according to relevant regulations; The persons who are directly responsible may put forward punishment suggestions such as suspending relevant professional qualifications to the relevant departments.

Forty-first any unit or individual has the right to report or complain about violations of design changes to the Construction Management Department and Supervision Bureau of the Ministry of Railways.

According to relevant regulations, the Ministry of Railways will form an investigation team to investigate violations of design changes and report complaints, identify responsibilities and impose penalties.

Chapter VIII Supplementary Provisions

Forty-second construction projects to implement the agent system, I, II design changes in the internal management agreement of the agent.

Forty-third construction projects with general contracting and unit price contracting shall be handled in accordance with the provisions of these measures, and the corresponding provisions shall be implemented for changing the design cost.

Forty-fourth projects under construction, after the signing of the no-liability accident contract, there are Class II design changes, and the increase or decrease of the project cost is less than 3 million yuan, which is included in the risk lump sum fee; If the project cost increases or decreases by more than 3 million yuan, the construction unit shall pay the basic reserve fund and adjust the construction contract amount accordingly; If bidding is conducted on the basis of preliminary design, the difference of construction drawing quantities shall be executed according to the signed construction contract.

Article 46 These Measures shall come into force as of 20121015. The Ministry of Railways issued Management Measures for Design Changes of Railway Construction Projects (Tie Jian [2005] 146), Interim Measures for Investigating the Responsibility of First-level Design Changes of Railway Construction Projects (Tie Jian [2007]1/0/) and Notice on Adjusting the Review Procedure for Major and Complicated First-level Design Changes.
