Measures of Taiyuan Municipality on the Administration of Commercial Networks

Chapter I General Provisions Article 1 These Measures are formulated for the purpose of strengthening the management of commercial outlets, promoting the rational development and full utilization of commercial outlets, and meeting the needs of developing planned commodity economy and urban development. Article 2 These Measures shall apply to the planning, construction, use and management of urban commercial outlets within their respective administrative areas. Article 3 The term "commercial outlets" as mentioned in these Measures refers to fixed retail places, wholesale places, service places, storage places and market trading places specializing in commodity trading and commercial services. Article 4 The planning and construction of commercial outlets shall follow the principles of unified planning, rational layout, supporting industries, facilitating production and life, and beautifying cities. Article 5 The competent departments of commercial outlets in cities and counties (cities, districts) are the people's governments of cities and counties (cities, districts) and the commercial administrative departments. The planning, construction, use and management of commercial outlets shall be the responsibility of the administrative departments of planning, construction, planning, commerce, land, real estate, industry and commerce, finance and state-owned assets of the municipal and county people's governments respectively. Chapter II Planning Article 6 The development plan and construction plan of commercial outlets shall be incorporated into the urban planning and the national economic and social development plans of cities and counties (cities, districts) respectively. Article 7 The contents of the development plan of commercial outlets include: development objectives, development scale, development priorities, regional layout, industry structure and scale structure, etc.

The contents of the commercial network construction plan include: the nature of network construction, the nature of industry, the scale of investment, the source of funds, etc. Article 8 The development plan of commercial outlets in the whole city shall be compiled by the competent department of urban planning administration of the Municipal People's Government in conjunction with the competent department of commercial outlets and incorporated into the urban construction plan.

The annual construction plan of city and county (city, district) commercial outlets shall be compiled by the competent department of city and county (city, district) commercial outlets according to the development plan of commercial outlets, jointly with the competent department of urban construction and land administration at the same level, and incorporated into the annual national economic and social development plan after comprehensive balance by the competent department of planning administration at the same level.

The development plan and construction plan of commercial outlets shall be implemented in accordance with the relevant provisions of the Urban Planning Law of People's Republic of China (PRC), and shall not be changed at will after being approved by the statutory authorities. If some changes are needed, they should be reported to the original approval authority for approval according to the original approval procedures. Chapter III Construction Article 11 The construction of commercial outlets takes various forms, such as unified construction, distribution construction, generation construction and self-construction. Article 12 The design of commercial outlets should be economical, practical, novel and beautiful, and meet the requirements of different outlets in different industries. Thirteenth new residential buildings should be reserved for commercial use in accordance with the provisions of the State Council, or the corresponding investment and materials should be reserved for the construction of commercial outlets. Article 14 Where legal commercial outlets need to be demolished due to urban construction, the demolisher shall make up or relocate them according to the original nature and scale, or compensate them according to the replacement price, or the people's government of the city or county (city, district) shall resettle them according to the scale of urban commercial outlets. Chapter IV Administration Article 15 Responsibilities of the competent departments of commercial outlets in cities and counties (cities, districts):

(a) the implementation of laws, regulations and policies related to the planning, construction, use and management of commercial outlets;

(two) to cooperate with the competent department of city planning administration to formulate the development plan of commercial outlets, and to work out the construction plan of commercial outlets jointly with the relevant administrative departments;

(three) in accordance with the relevant provisions of the collection, use and management of commercial network fees;

(four) to manage the regional layout, industry structure and construction scale of commercial outlets. Article 16 In accordance with the relevant regulations of the State Council, the fees of urban commercial outlets shall be stored in the special account of the competent department of urban commercial outlets, arranged in a unified way and used for special purposes. In areas with few outlets, priority is given to the construction, reconstruction and expansion of small and medium-sized commercial outlets closely related to people's lives. Except for state-owned enterprises whose profits are meager or whose policy losses are unable to repay and manage people's daily necessities, commercial network fees should be paid for. Seventeenth new residential city, in accordance with the provisions of the State Council should allocate commercial outlets or pay the corresponding investment, the construction unit should go through the formalities of agent construction or payment, and then go through other formalities. Article 18 The property rights of commercial outlets shall be managed in accordance with the following provisions:

(a) the property rights of new commercial outlets invested or charged by the people's governments of cities and counties (cities, districts) are owned by the state and managed by the competent departments of commercial outlets at the same level.

(two) commercial outlets reserved for new residential buildings in accordance with the provisions of the State Council, the property rights are owned by the state and managed by the competent department of commercial outlets at the same level. Nineteenth city and county (city, district) commercial premises managed by the competent department of commercial outlets must be used to set up commercial outlets, and shall not be used for other purposes without authorization. Twentieth lease outlets, the two sides should sign a lease contract, clear the rights and responsibilities of both parties.

The rent needs to be repaired. If the lessor is unable or refuses to maintain, the lessee can carry out maintenance through consultation between the two parties, and the expenses will be used to offset the rent. The lessee's expenses for renovation due to business needs cannot offset the rent. You have to pay for renting a house. If the rent in arrears exceeds the time limit or amount stipulated in the contract, the lessor has the right to terminate the lease contract.
