Procedures of Jiangmen Municipal People's Government for Drafting Local Regulations and Formulating Government Rules (202 1)

Chapter I General Provisions Article 1 In order to standardize the procedures for the Municipal People's Government to draft local regulations (hereinafter referred to as draft regulations) and formulate government regulations (hereinafter referred to as regulations), and improve the quality and efficiency of legislation, these Provisions are formulated in accordance with the Legislative Law of People's Republic of China (PRC), the Regulations on Rules-making Procedures and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the activities of the Municipal People's Government such as proposing regulations, drafting and deliberating draft regulations, and submitting them to the Municipal People's Congress and its Standing Committee for deliberation.

These Provisions shall apply to the project establishment, drafting, examination, decision, publication, filing, interpretation, cleaning and file management of the Municipal People's Government. Article 3 The term "draft regulations" as mentioned in these Provisions refers to the normative documents drafted by the Municipal People's Government and submitted to the Municipal People's Congress and its Standing Committee for deliberation in the form of a motion of the Municipal People's Government.

The regulations mentioned in these Provisions refer to the normative documents formulated by the Municipal People's Government in accordance with the legislative authority and the procedures stipulated in these Provisions, and promulgated and implemented in the form of orders of the Municipal People's Government. Article 4 When drafting regulations and formulating rules, we should implement the Party's line, principles, policies and decision-making arrangements, follow the legislative principles defined in the Legislative Law of People's Republic of China (PRC) and the Regulations on Rules-making Procedures, conform to the provisions of the Constitution, laws and regulations, combine with the actual situation of this Municipality, highlight local characteristics, and have pertinence and operability.

The formulation of major economic and social regulations shall be reported to the Municipal Party Committee in a timely manner in accordance with relevant regulations. Article 5 The municipal judicial administrative department shall be responsible for the following government legislative work:

(a) the preparation of the annual legislative work plan of the Municipal People's government (including the annual regulatory project proposal and the annual regulatory plan);

(two) according to the annual legislative plan of the Standing Committee of the Municipal People's Congress and the annual rule-making plan of the Municipal People's Government, organize the drafting of draft laws and regulations, review, coordinate and modify the draft laws and regulations, and submit them to the executive meeting of the Municipal People's Government for deliberation;

(3) Filing, interpreting and cleaning up the rules and regulations of the organization;

(four) other government legislative work as stipulated by laws and regulations and these Provisions.

The department or unit responsible for drafting laws and regulations (hereinafter referred to as the drafting unit) shall carry out the relevant work of government legislation in accordance with these Provisions, and do a good job in ensuring funds and personnel.

The people's governments at the county level, relevant departments and units shall cooperate with the legislative work of the government. Article 6 The names of draft regulations are generally called "Regulations", "Provisions" and "Implementation Measures". The names of rules are generally called "regulations" and "measures", not "regulations". Article 7 The funds required for drafting laws and regulations shall be included in the annual financial budget. Chapter II Project Establishment Article 8 The municipal judicial administrative department shall, before the end of September each year, solicit legislative suggestions from people's governments at all levels, departments of the Municipal People's Government and relevant institutions for formulating, amending and abolishing local regulations and government rules in the next year. The relevant units shall submit it in a timely manner as required.

The municipal judicial administrative department shall publicly solicit legislative suggestions through the portal website of the Municipal People's Government, new government media or newspapers, radio and television. , easy for the public to know. The time for public solicitation is generally not less than 30 days.

The municipal judicial administrative department can also rely on the municipal government's legislative grassroots contact point, organize symposiums and conduct research to collect legislative suggestions.

The municipal judicial administrative department may, according to the actual needs of the work arrangements of the municipal party committee and municipal government, the suggestions of party representatives, the suggestions of deputies to the National People's Congress and the proposals of CPPCC members, directly put forward legislative suggestions and submit them to relevant departments and units for study and comments. Legislative proposals concerning the regulation of the government's common administrative behavior can be directly put forward by the municipal judicial administrative department.

The legal adviser of the municipal government can put forward legislative suggestions to the municipal judicial administrative department through research reports and demonstration reports.

Citizens, legal persons and other organizations may put forward legislative suggestions to the municipal judicial administrative department in writing or by e-mail. Ninth people's governments at the county level and the Municipal People's government departments and relevant institutions shall submit legislative suggestions and explanations to the municipal judicial administrative department when proposing local regulations or government rules and regulations for the next year. The instructions shall include the following contents:

(a) the necessity and feasibility of formulation;

(two) the main problems to be solved and the main measures to be taken;

(3) Basis for formulation;

(four) the basic situation of investigation and consultation;

(five) to submit the legislative progress and plan to the Municipal People's government.

The legislative proposal project materials submitted in the preceding paragraph shall be audited by the institution responsible for legal affairs of the unit and signed by the principal responsible person of the unit.

When the public puts forward legislative proposals, they can only put forward the name of the project and the main reasons for legislation. Article 10 The municipal judicial administrative department shall collect and sort out the legislative suggestions put forward by relevant units and the public, and listen to opinions and suggestions from all sides through project coordination meetings, demonstration meetings or special investigations. The municipal judicial administrative department shall carefully study the opinions and arguments from all sides, formulate the draft annual legislative work plan of the Municipal People's Government according to the needs of the city's economic and social development and the construction of democracy and the rule of law, and give feedback to the units or individuals that put forward legislative suggestions in an appropriate way.
