Measures for the administration of works of art
Art works refer to: calligraphy, inscriptions, seal cutting, painting (Chinese painting, oil painting, printmaking, watercolor painting, gouache painting, sketch, sketch, mural painting, lacquer painting, antique painting, etc. ), sculpture, artistic photography, etc.
Art business activities refer to: art collection, auction, hosting art competitions, exhibitions, exhibitions, calligraphy and painting mounting and other business service activities. Article 3 Art business activities must adhere to the direction of serving the people and socialism and meet the cultural needs of the people. Article 4 The cultural administrative department of the government is the competent department of art business activities. Chapter II Painting shops, galleries, art companies and art auction companies Article 5 The establishment of painting shops, galleries, art companies, art auction companies and other art business units shall be subject to the examination and approval of the local cultural administrative department at or above the county level.
The establishment of art business units by Chinese-foreign joint ventures and Chinese-foreign cooperative enterprises directly under the Ministry of Culture or established by the Ministry of Foreign Trade and Economic Cooperation and registered by the State Administration for Industry and Commerce shall be examined and approved by the Ministry of Culture.
The establishment of art business units by enterprises and institutions affiliated to central departments (including the military system), the State Council departments and national mass organizations shall be examined and approved by the cultural administrative departments of provinces, autonomous regions and municipalities directly under the Central Government authorized by the Ministry of Culture, except as otherwise provided in these Measures.
In addition to the above provisions, the establishment of art business units by other enterprises, institutions and mass organizations shall be examined and approved by local cultural administrative departments at all levels. The examination and approval authority of local cultural administrative departments at all levels shall be stipulated by the cultural administrative departments of provinces, autonomous regions and municipalities directly under the Central Government in accordance with the principle of hierarchical management. Article 6 To bid for the collection and sale of art works such as painting shops, galleries and art companies, the following documents shall be submitted to the examination and approval department:
(1) An application report;
(2) The approval document of the superior administrative department of the applicant;
(three) the relevant certification materials of the person in charge of the business unit;
(4) Professional staffing, including no less than 3 full-time staff in painting shops and galleries and no less than 8 full-time staff in art companies;
(5) Credit certificate issued by the bank or accounting firm, in which the liquidity of the painting shop is not less than 65,438+10,000 yuan, the liquidity of the gallery is not less than 200,000 yuan, and the liquidity of the art company is not less than 500,000 yuan;
(six) the certificate of the right to use the place, and the business area is not less than 20 square meters; Among them, the gallery must also have an exhibition hall of not less than 40 square meters;
(seven) information about the source of the artwork;
(8) Management regulations. Article 7 The establishment of an art auction unit shall be subject to the examination and approval of the cultural administrative department at or above the provincial level.
Chinese-foreign joint ventures and Chinese-foreign cooperative enterprises affiliated to the central departments (including the military system), the State Council departments and national mass organizations set up art auction units, or are registered with the Ministry of Foreign Trade and Economic Cooperation and the State Administration for Industry and Commerce, which shall be examined and approved by the Ministry of Culture.
In addition to the provisions of the preceding paragraph, the establishment of art business units by other enterprises, institutions and mass organizations shall be examined and approved by the provincial cultural administrative department and reported to the Ministry of Culture for the record. Article 8 An entity applying for art auction shall submit the following documents to the examination and approval department:
(1) An application report;
(2) The approval document of the superior administrative department of the applicant;
(three) the relevant certification materials of the person in charge of the business unit;
(four) professional personnel, full-time staff of not less than 8 people;
(five) the relevant materials of experts identified by the administrative department of culture at or above the provincial level;
(6) The asset credit certificate issued by the bank or accounting firm of not less than 5 million yuan;
(seven) the certificate of the right to use the place, and its business area is not less than 60 square meters;
(eight) the relevant information about the source of the artwork;
(9) Management regulations. Ninth approved art business units, the approval department issued a "license" for art business; Apply to the administrative department for industry and commerce for a business license with the Cultural Business License. Chapter III Art Competition, Exhibition, Exhibition and Auction Article 10 The holding of art competition, exhibition, exhibition and auction of artworks must be examined and approved by the administrative department for culture.
Holding inter-provincial, national, international or internationally sponsored art competitions, exhibitions, exhibitions and art auctions must be reported to the Ministry of Culture for approval.
Holding local art competitions, exhibitions, exhibitions and auctions shall be examined and approved by the cultural administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the Ministry of Culture for the record. Eleventh bid to host art competitions, exhibitions and exhibitions, shall submit the following documents to the examination and approval department:
(1) An application report;
(2) The approval document of the superior competent department of the applicant;
(3) Organization and procedures of activities;
(4) documents certifying the budget and sources of funds;
(five) the types, quantities and grades of artistic works in competitions, exhibitions or exhibitions;
(six) the selection criteria of the competition.
