Jimmy Lin was found guilty of infringement for sunbathing "P" in Sina Weibo?

Jimmy Lin used tampered photographer's works in his official Sina Weibo "Jimmy Lin the Dreamer". Zhu Qingfu, the author of this work, sued Beijing Wei Meng Chuangke Network Technology Co., Ltd., which was jointly operated by Jimmy Lin and Sina Weibo, and demanded to stop the infringement, apologize and compensate the economic losses. Today (September 8), Beijing Haidian Court concluded the case and ruled that Jimmy Lin constituted infringement and compensated Zhu Qingfu for more than 300,000 yuan.

Zhu Qingfu, a well-known photographer, completed the works involved on 1992. On August 25th, 20 13, Jimmy Lin published pictures and texts of Weibo and Weibo in the "Weibo" operated by Wei Meng Company to celebrate that the number of fans in Weibo reached 2 1 10,000. The picture was tampered with, and the head of the third soldier from the left in the works involved was replaced by his own head and cut off. This Weibo has been widely forwarded, commented and praised.

Zhu Qingfu believes that Jimmy Lin's behavior violated his right of authorship, the right to protect the integrity of works, the right to modify and the right to disseminate information on the Internet. Beijing Wei Meng Chuangke Network Technology Co., Ltd., a company operated by Jimmy Lin and Sina Weibo, was sued, demanding to stop the infringement, apologize and compensate economic losses and reasonable expenses11more than one million yuan.

Jimmy Lin argued that after receiving Zhu Qingfu's complaint, he immediately disconnected the link and published an apology statement in Weibo on February 17. The pictures used by Jimmy Lin in the case of Weibo were widely circulated when Jimmy Lin released the case of Weibo. They were not revised by Jimmy Lin, nor did they originate in Jimmy Lin. Jimmy Lin just thought it was interesting to reprint them in Weibo, and Weibo's comments involved did not lower Zhu Qingfu's evaluation. Zhu Qingfu did not submit evidence to prove his economic loss and reputation damage. Jimmy Lin thinks that the amount of economic losses and reasonable expenses demanded by Zhu Qingfu is too high.

Wei Meng Company replied that Wei Meng Company, as a network service provider, has no legal obligation to review in advance. After receiving the complaint, Wei Meng Company took timely measures to fulfill its post-event supervision obligations, and did not cause any damage, and did not assume responsibility.

After the trial, the court held that Zhu Qingfu was the copyright owner of the works involved and enjoyed the copyright of the works involved.

The court ruled that Jimmy Lin made a statement in the name of "Jimmy Lin the Dreamer" on the homepage of Sina Weibo for 72 hours, apologized to the plaintiff Zhu Qingfu, and compensated the plaintiff Zhu Qingfu for economic losses of 300,000 yuan, legal fees of 40,000 yuan, notary fees of 5,000 yuan and other reasonable expenses, totaling 345,000 yuan.

Believe this experience, Jimmy Lin has a deep memory.
