According to the definition of trade union law, manual workers and mental workers whose main source of income is wages do not include retirees. Therefore, employees can retain their party membership after going through retirement procedures, but in fact they have naturally left the trade union organization and no longer enjoy the welfare benefits when they are on the job.
Who will solve the welfare of retirees?
Article 22 of our Detailed Rules for the Implementation of the Management of Funds Revenue and Expenditure of Grass-roots Trade Unions in Hunan Province clearly stipulates that the standard of collective welfare that retired cadres and workers can enjoy in accordance with relevant regulations shall be determined by the unit administration in accordance with relevant regulations, and the funds shall be charged in accordance with relevant administrative regulations, and shall not be spent in trade union funds.
Therefore, the benefits of retirees should be paid by the unit administration according to relevant regulations. In other words, it is illegal for a trade union to pay benefits to retirees.

Legal basis: Article 3 of the Trade Union Law of People's Republic of China (PRC) stipulates that manual workers and mental workers whose main source of livelihood is wages in Chinese enterprises, institutions and organs have the right to join and form trade unions according to law, regardless of nationality, race, sex, occupation, religious belief and education level. No organization or individual may obstruct or restrict it.
