The All-China Federation of Trade Unions on the Treatment of Retired Workers

Retirees cannot enjoy the same trade union treatment as employees.

According to the regulations of the All-China Federation of Trade Unions, the payment standard of membership dues is 0.5% of the monthly salary of the person. Membership dues are mainly used to organize members to watch movies, cultural performances and sports competitions; Carry out spring outing and autumn outing, and buy annual tickets for local parks for members. But in practice, the annual membership fee is generally around 200 yuan, which is only symbolic. The main sources for trade unions to carry out trade union activities and distribute employee benefits are 2% of the total wages of all employees allocated by enterprises, higher-level trade union subsidies and unit administrative subsidies. If the enterprise's benefit is poor or the boss doesn't pay attention to it, and the trade union funds can't be fully allocated, the trade union activities can't be carried out normally, and the national statutory employee benefits can't be in place. According to the definition of trade union law, manual workers and mental workers whose main source of income is wages do not include retirees. Retired or unemployed members can keep their membership. Free of membership fees during the retention period. Therefore, employees can retain their party membership after going through retirement procedures, but in fact they have naturally left the trade union organization and no longer enjoy the welfare benefits when they are on the job.

Who will solve the welfare of retirees?

Article 22 of our Detailed Rules for the Implementation of the Management of Funds Revenue and Expenditure of Grass-roots Trade Unions in Hunan Province clearly stipulates that the standard of collective welfare that retired cadres and workers can enjoy in accordance with relevant regulations shall be determined by the unit administration in accordance with relevant regulations, and the funds shall be charged in accordance with relevant administrative regulations, and shall not be spent in trade union funds.

Therefore, the benefits of retirees should be paid by the unit administration according to relevant regulations. In other words, it is illegal for a trade union to pay benefits to retirees.

To sum up, retirees can't enjoy the same trade union treatment as employees, but there will be relevant specific regulations that will be strictly implemented.
