Who should the ownership of the photo belong to?
Entrusted photographic works refer to specific photographic works created by the author according to the wishes and specific requirements of the client by paying the agreed creative remuneration to the author. Article 17 of China's Copyright Law stipulates that the ownership of commissioned works's copyright shall be agreed by the client and the client through the contract; If the contract is not clearly stipulated or concluded, the copyright belongs to the trustee. That is to say, according to the contract, the copyright of the commissioned photographic works can be owned by the client or by the client. If there is no contract or no agreement in the contract, the copyright of the photographic work belongs to the author. Such a provision is conducive to safeguarding the interests of the author.
