Regulations on the protection and management of Qingyongling in Xinbin Manchu Autonomous County

Article 1 In order to strengthen the protection and management of the Qing Yongling Mausoleum, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and other relevant laws and regulations, combined with the actual situation of Autonomous County. Article 2 All units and individuals engaged in various activities within the protection scope and construction control zone of the Qing Yongling Mausoleum must abide by these regulations. Article 3 The cultural administrative department of the Autonomous County People's Government shall, under the guidance of the cultural relics administrative department at a higher level, supervise and manage the protection of the Qing Yongling Mausoleum.

Other relevant departments of the Autonomous County People's Government shall, in accordance with their respective functions and duties, assist the cultural administrative departments in implementing the protection and management of the Qing Yongling Mausoleum. Article 4 The protection scope and construction control zone of Qingshui Mausoleum shall be implemented in accordance with the Protection Scope and Construction Control Zone of Qingyongling Cultural Relics approved by the Liaoning Provincial People's Government.

The sign of the protection scope of the Qing Yongling Mausoleum indicates that no unit or individual may move, damage or dismantle it without authorization. Article 5 Within the scope of protection of the Qing Yongling Mausoleum, the following acts are prohibited:

(a) unauthorized felling of trees, destruction of flowers and plants, vegetation;

(2) Hunting wild animals and grazing;

(three) graffiti, posting and climbing on cultural relics and protection facilities;

(4) Setting up advertisements;

(five) urinating, littering, littering, sewage discharge;

(six) smoking in areas with no smoking signs;

(7) Taking photos in areas where photography is prohibited;

(eight) picnics, burning leaves, weeds, garbage, fireworks;

(nine) borrow soil to build a cemetery;

(ten) other acts that damage cultural relics and hinder the landscape. Article 6 In the construction control zone of Qingyongling, the engineering design must be approved by National Cultural Heritage Administration and submitted to the national urban and rural construction planning department for examination and approval.

In the control zone of the construction of Qingyong Mausoleum, no facilities that endanger the safety of Qingyong Mausoleum shall be built, and no buildings or structures whose style, height, size and color are not in harmony with the historical features of Qingyong Mausoleum shall be built. Seventh Qing Yongling cultural relics maintenance project must be in accordance with the provisions of relevant laws and regulations, step by step reported to National Cultural Heritage Administration for approval. Without approval, no unit or individual may carry out repair, restoration and other cultural relics maintenance projects for the Qing Yongling Mausoleum.

The protection and maintenance of Qingshui Mausoleum shall not change the original state and appearance of cultural relics. Eighth Autonomous County People's government set up a special fund for the protection and maintenance of the Qing Yongling Mausoleum, which was included in the fiscal budget of the Autonomous County at the corresponding level.

Funds allocated by state organs at higher levels, funds raised by the society and funds donated at home and abroad shall be used for special purposes, and no unit or individual may occupy or use them for other purposes. Article 9 If it is necessary to record cultural relics scenes and cultural relics when shooting movies, television, professional videos and professional photography, it shall have the approval documents of the State Department for Cultural Relics Administration, and it shall be conducted under the supervision of the cultural relics protection and management personnel of Qingyong Mausoleum. Article 10 Any unit or individual that applies for engaging in various business activities within the protection scope of the Qing Yongling Mausoleum shall obtain the consent of the cultural administrative department of the Autonomous County People's Government before going through the formalities with the relevant departments and carrying out business activities. Eleventh Autonomous County People's Government has made important inventions or other important contributions to the protection of science and technology in Qingyongling; Those who have made outstanding achievements in the protection and management, security and environmental management of the Qing Yongling Mausoleum shall be commended or rewarded. Twelfth in violation of the relevant provisions of this Ordinance, the autonomous county administrative department of culture shall be given the following penalties:

(a) in violation of the provisions of the second paragraph of Article 4 of these regulations, in addition to ordering restitution or compensation for actual losses, a fine of more than 500 yuan 1000 yuan shall be imposed.

(two) in violation of the provisions of Article 5 (1) and (2) of this Ordinance, it shall be ordered to stop the sabotage activities, confiscate the illegal income, make restitution within a time limit, and impose a fine of 1000 yuan to 30000 yuan.

(three) in violation of the provisions of Article 5 (3), (4), (5), (6), (7) and (8) of these regulations, it shall be stopped and a fine of over 100 yuan shall be imposed; If the circumstances are serious, a fine of more than 200 yuan 100 yuan shall be imposed.

(four) in violation of the provisions of article fifth (nine) of this Ordinance, it shall be ordered to move out within a time limit, restore the original landform, and impose a fine of more than 1000 yuan in 500 yuan.

(five) in violation of the provisions of the first paragraph of Article 6 of these regulations, it shall be ordered to go through the formalities of examination and approval, and shall be fined not less than 50,000 yuan but not more than 6,543.8+10,000 yuan. If the consequences are caused, a fine of 654.38+10,000 yuan but not more than 200,000 yuan shall be imposed.

In violation of the provisions of the second paragraph of Article 6 of these regulations, it shall be ordered to clear within a time limit, and if the consequences are caused, a fine of 50,000 yuan or more and 200,000 yuan or less shall be imposed.

(six) in violation of the provisions of the seventh paragraph of this Ordinance, it shall be ordered to stop the illegal act and impose a fine of 50 thousand yuan and 6.5438+10 thousand yuan.

In violation of the provisions of the second paragraph of Article 7 of these regulations, it shall be ordered to restore its original state and appearance, and a fine of two hundred thousand yuan or more and three hundred thousand yuan or less shall be imposed. Causing consequences, a fine of not less than 300,000 yuan but not more than 500,000 yuan shall be imposed. If a crime is constituted, criminal responsibility shall be investigated according to law. Thirteenth staff engaged in the protection and management of cultural relics in Qing Yongling Mausoleum neglect their duties, abuse their powers, engage in malpractices for selfish ends, resulting in consequences, they shall be given administrative sanctions by the competent department at a higher level; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law. Article 14 These Regulations shall come into force on June 6, 2003.
