Tourism Regulations of Guangxi Zhuang Autonomous Region (revised on 20 16)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and tourism professionals, standardize the order of the tourism market, protect and rationally develop tourism resources, and promote the sustained and healthy development of tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other relevant laws and administrative regulations, combined with the actual situation of this autonomous region. Article 2 These Regulations shall apply to organizing tours, vacations, leisure and other tourism activities outside the autonomous region within the administrative area of the autonomous region, as well as tourism promotion, tourism resources protection and development, tourism management services, tourism supervision and management. Article 3 The development of tourism should follow the principles of scientific planning, rational development and sustainable development, adhere to government guidance, social participation, market operation and industry self-discipline, highlight local characteristics, and adhere to the unity of social, economic and ecological benefits. Article 4 The people's governments at or above the county level shall strengthen the organization and leadership of the tourism industry, incorporate tourism development into the national economic and social development plan, establish and improve the comprehensive coordination mechanism and incentive mechanism for tourism development, increase capital investment and policy support for tourism, strengthen the construction of tourism public service system, and promote the integrated development of tourism and related industries.

Township (town) people's governments and subdistrict offices shall assist the people's governments at or above the county level and their relevant departments to do a good job in the protection and utilization of tourism resources, tourism development, tourism safety supervision and tourism environmental order maintenance within their respective administrative areas. Article 5 The tourism authorities of the people's governments at or above the county level shall be responsible for the guidance, coordination, management, service and supervision of tourism within their respective administrative areas, and other relevant departments of the people's governments at or above the county level shall do a good job in tourism-related work according to their respective duties. Article 6 People's governments at all levels and their relevant departments and news media shall carry out publicity and education on civilized tourism, guide tourists, tour operators and their employees, and residents in tourist areas to enhance their awareness of protecting the ecological environment, and advocate and encourage healthy, civilized and environmentally friendly tourism modes. Tourism industry organizations, tourism operators and their employees provide convenience for tourists' healthy, civilized and environmentally friendly tourism in tourism business activities. Article 7 Tourism industry organizations established according to law shall formulate industry norms, improve industry self-discipline management, guide members to operate in good faith, safeguard fair competition order in the tourism market and the legitimate rights and interests of members, and promote the healthy development of tourism.

Encourage tourism industry organizations to establish an industry credit information management system and disclose the credit information of their members to the public according to law. Chapter II Tourists Article 8 Tourists shall enjoy the following rights:

(a) to understand the contents, standards, prices, precautions and other information of relevant tourism products and services;

(two) to choose tourism products, services and tourism operators independently;

(3) Refusing the compulsory trading behavior of tour operators;

(4) Requiring tour operators to provide tourism products and services in accordance with the contract, and obtaining relevant contract texts, invoices and other payment vouchers during the tour;

(five) personal dignity, national customs and religious beliefs are respected;

(6) Requesting assistance and protection when personal and property are in danger;

(seven) causing personal and property damage, compensation according to law;

(eight) other rights stipulated by laws and regulations and agreed in the travel contract.

Disabled people, the elderly, minors, students, soldiers and other tourists enjoy convenience and preferential treatment in tourism activities in accordance with laws, regulations and relevant provisions. Article 9 Tourists shall perform the following obligations:

(1) Abide by social order and social morality, take good care of tourist facilities, protect tourist resources and ecological environment, and refrain from spitting, urinating, making noise, littering, doodling and other uncivilized behaviors;

(two) respect for local customs, cultural traditions and religious beliefs;

(three) truthfully inform the tourism operators of personal health information related to tourism activities;

(four) shall not harm the legitimate rights and interests of local residents, interfere with the tourism activities of others, and harm the legitimate rights and interests of tourism operators and tourism professionals;

(five) to cooperate with the local people's government to implement temporary restrictions on tourism activities in response to emergencies and the relevant departments, institutions or tourism operators to implement safety precautions and emergency measures;

(six) comply with the safety warning regulations;

(seven) other obligations stipulated by laws and regulations and travel contracts. Article 10 Disputes between tourists and tour operators can be resolved through the following channels:

(a) negotiated settlement with the tour operators;

(two) to complain to the relevant competent departments, tourism complaint handling agencies or consumer rights protection organizations;

(three) to apply for mediation to the relevant mediation organizations;

(four) if there is an arbitration clause or a written arbitration agreement in the travel contract, it shall be submitted to an arbitration institution for arbitration;

(five) to bring a lawsuit to the people's court;

(six) other ways as prescribed by laws and regulations. Chapter III Tourism Promotion Article 11 The people's governments at or above the county level shall establish a joint meeting system of tourism departments to guide the tourism work within their respective administrative areas, study and deploy the important work of tourism reform and development, and coordinate and solve major problems of tourism reform and development.
