Measures for the supervision and administration of individual industrial and commercial households in tourist attractions

Article 1 In order to strengthen the supervision and management of individual industrial and commercial households in tourist attractions, standardize their business practices, protect the legitimate rights and interests of consumers and promote the healthy development of individual economy, these Measures are formulated in accordance with relevant national laws and regulations. Article 2 The term "tourist attractions" as mentioned in these Measures refers to scenic spots and parks, cemeteries, temples and museums (institutes) that can be visited and toured by people. Third individuals engaged in business activities in tourist attractions must hold a business license issued by the administrative department for Industry and commerce before they can operate. It is strictly forbidden to operate without a license. Article 4 Individual industrial and commercial households in tourist attractions shall engage in business activities in accordance with relevant state laws, regulations and these Measures, and accept the supervision and management of the administrative department for industry and commerce. Article 5 Individual industrial and commercial households in tourist attractions shall hang their business licenses and report telephone cards under the supervision of the local administrative department for industry and commerce in a prominent position in their business premises.

Individual industrial and commercial households that are inconvenient to move or hang their business licenses should wear service badges issued by the administrative department for industry and commerce. Article 6 Individual industrial and commercial households in tourist attractions are not allowed to change their business premises and expand their business area without authorization. Article 7 Individual industrial and commercial households in tourist attractions shall not operate beyond the approved business scope. Article 8 Individual industrial and commercial households in tourist attractions shall not lend, lease, sell or alter their business licenses. Article 9 Individual industrial and commercial households in tourist attractions shall not commit any of the following acts in their business operations:

(a) pestering consumers and selling goods and services to them, or forcibly selling goods and services to consumers;

(two) the quantity of goods sold is insufficient or the services provided do not meet the agreed conditions;

(three) the sale of goods is not clearly marked or the provision of services is not clearly marked;

(4) Violating the personal dignity or personal freedom of consumers;

(five) the sale of food that does not meet the hygiene standards and is harmful to human health;

(6) selling wild animals under state protection or their products;

(seven) selling fake and shoddy goods;

(8) dealing in articles that are explicitly prohibited by the state from being operated by individuals;

(nine) engaged in other business activities prohibited by laws, regulations and policies. Article 10 The administrative department for industry and commerce shall set up a telephone number for supervision and reporting, establish a duty system, and strengthen the supervision and management of individual industrial and commercial households in tourist attractions. Eleventh in violation of the provisions of article third of these measures, shall be punished in accordance with the provisions of article fifteenth of the detailed rules for the implementation of the Interim Regulations on the administration of individual industrial and commercial households in urban and rural areas. Twelfth in violation of the provisions of article fifth of these measures, depending on the seriousness of the case, given a warning or impose a fine of 500 yuan. Thirteenth in violation of the provisions of article sixth of these measures, shall be punished in accordance with the provisions of item (a) of article sixteenth of the Detailed Rules for the Implementation of the Interim Regulations on the Administration of Urban and Rural Individual Industrial and Commercial Households. Fourteenth in violation of the provisions of article seventh of these measures, shall be punished in accordance with the provisions of article sixteenth (three) of the Detailed Rules for the Implementation of the Interim Regulations on the Administration of Urban and Rural Individual Industrial and Commercial Households. Fifteenth in violation of the provisions of article eighth of these measures, shall be punished in accordance with the provisions of article fourteenth of the detailed rules for the implementation of the Interim Regulations on the administration of individual industrial and commercial households in urban and rural areas. Sixteenth in violation of the provisions of Article 9 (1), (2) and (3) of these measures, give a warning or impose a fine of 1000 yuan; If the circumstances are serious, it shall be ordered to suspend business or revoke its business license. Seventeenth in violation of the provisions of article ninth (four) of these measures, shall be punished in accordance with the provisions of article fiftieth of the consumer protection law. Eighteenth in violation of the provisions of article ninth (five) of these measures, shall be punished in accordance with the relevant provisions of the "food hygiene law". Nineteenth in violation of the provisions of article ninth (six) of these measures, confiscate the illegal income, and impose a fine equivalent to less than ten times the real value; If the circumstances are serious, it shall be ordered to suspend business or revoke its business license. Twentieth in violation of the provisions of article ninth (seven) of these measures, shall be punished in accordance with the provisions of article fiftieth of the consumer protection law. Twenty-first in violation of the provisions of article ninth (eight), confiscate the illegal income, and impose a fine of fifty yuan and one thousand yuan; If the circumstances are serious, it shall be ordered to suspend business or revoke its business license. Twenty-second in violation of the provisions of article ninth (nine) of these measures, shall be punished in accordance with the relevant laws, regulations and rules of the state. Twenty-third individual industrial and commercial households who refuse to accept the administrative punishment may apply for administrative reconsideration or bring a lawsuit directly to the people's court according to law; If he refuses to accept the reconsideration decision, he may bring a lawsuit to the people's court according to law. Twenty-fourth private enterprises in tourist attractions shall be supervised and managed in accordance with relevant laws, regulations and rules; Where there are no provisions in laws, regulations and rules, these Measures shall apply. Article 25 These Measures shall come into force as of the date of promulgation.
