The company’s employees did not report when they took annual leave to travel out of the province + can the company record a major demerit file?

No major demerit will be recorded, but it needs to be reported.

According to the "Regulations on Paid Annual Leave for Employees": Employees of agencies, groups, enterprises, public institutions, private non-enterprise units, individual industrial and commercial households with employees, etc., who have worked continuously for more than one year , all can enjoy paid annual leave. The unit should ensure that employees enjoy annual leave.

The "Regulations" stipulate that employees who have worked for more than 1 year but less than 10 years in total are entitled to 5 days of annual leave, 10 days of annual leave if they are more than 10 years but less than 20 years, and 15 days of annual leave if they are more than 20 years old. National statutory holidays and rest days are not included in annual leave. Employees enjoy the same salary income during vacation as during normal working hours.

The "Regulations" point out that annual leave can be arranged collectively within one year or in sections, and is generally not arranged across years. If the unit really needs to arrange annual leave for employees across years due to production and work characteristics, it can arrange it across one year. For the number of untaken annual leave days that an employee should have taken, the unit shall pay annual leave wages at 300% of the employee's daily wage income. If any unit violates national regulations by neither arranging annual leave for employees nor paying annual leave wages, the "Regulations" also clarify the relevant handling methods. The Personnel Department of the State Council and the Labor and Social Security Department of the State Council will respectively formulate implementation measures for the Regulations in accordance with their powers.
