Measures for the Administration of People Boarding Foreign Ships in Jiangsu Province (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the management of ports open to the outside world in our province, maintain the normal work and production order of ports, and ensure the safety of foreign ships (hereinafter referred to as foreign ships) and personnel in Hong Kong, these measures are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this province. Article 2 Ocean-going ships mentioned in these Measures refer to foreign merchant ships, passenger ships, tourist ships, scientific research ships, exploration ships and fishing boats and other civilian ships moored at the ports open to the outside world in this province. Article 3 The State shall set up frontier inspection stations at ports open to the outside world in this province, which shall be responsible for the management of persons boarding foreign ships. Article 4 These Measures shall apply to domestic personnel who board foreign ships at ports open to the outside world in Jiangsu Province. Chapter II Handling of Certificates Article 5 Anyone who needs to board an ocean-going ship because of work shall hold a valid boarding certificate, unless the boarding certificate is exempted as stipulated by the state. Article 6 The validity period of the boarding certificate can be divided into two types: the validity period of this voyage and the stipulated validity period (not exceeding one year). Article 7 To apply for boarding certificates, an application shall be submitted to the local frontier inspection station and relevant materials shall be submitted in accordance with the relevant provisions of the state. The boarding certificate is issued by the frontier inspection station. Article 8 When boarding an ocean-going ship to perform official duties, the following persons shall wear uniforms, show their certificates and be exempted from boarding certificates:

(a) the personnel of the joint inspection unit and other inspection and inspection units prescribed by the state shall go through the joint inspection and inspection procedures;

(two) the port public security organ staff boarded the ship to handle the case;

(3) Firefighters shall supervise or extinguish the fire;

(4) Personnel of the maritime court board the ship to handle maritime cases;

(5) medical personnel who rescue the sick and wounded.

Other personnel who need to board ocean-going ships due to special circumstances may also be exempted from boarding certificates with the approval of frontier inspection stations. Article 9 The following persons shall not apply for boarding certificates:

(a) suspected of theft, drug trafficking, smuggling and other illegal activities;

(2) Having been released from prison or released from reeducation through labor for less than two years;

(three) suspected of stealing across the country (border);

(four) suspected of selling, illegally providing or revealing state secrets or information;

(five) in violation of the regulations on boarding, the boarding certificate has been revoked for less than one year;

(6) Failing to go through the application procedures for boarding documents in accordance with the provisions;

(seven) other direct boarding. Chapter III Inspection and Management Article 10 When boarding a foreign ship, the boarding personnel shall take the initiative to show their boarding certificates and accept the inspection and management of the personnel on duty at the frontier inspection station. Article 11 Before the entry frontier inspection, after the exit frontier inspection and during the inspection, except the joint inspection unit and the personnel approved by the frontier inspection station, no one is allowed to board the ship regardless of whether they have boarding certificates. Article 12 Under any of the following circumstances, the personnel on duty at the frontier inspection station have the right to prevent boarding an ocean ship:

(1) The officials who boarded the foreign ship failed to wear uniforms and show their certificates as required, and the personnel on duty at the frontier inspection station did not receive the notice;

(2) Without a boarding pass;

(3) Holding another person's boarding pass or forging or altering other invalid boarding passes,

(four) the work is not needed;

(5) refusing to show boarding certificates or not accepting inspection. Article 13 When patrolling foreign ships, the officers on duty at frontier inspection stations have the right to inquire about the boarding personnel, and manage and punish those who violate the boarding regulations according to law. Chapter IV Boarding Provisions Article 14 Boarding must strictly abide by the relevant laws, regulations and foreign-related disciplines of China, strictly observe state secrets, and consciously safeguard national reputation and national dignity. Fifteenth people aboard ocean-going ships must abide by the following provisions:

(1) It shall work and operate at the designated place on an ocean-going ship. Unless it is necessary for work, it is not allowed to enter the crew's living quarters and studios, and it is not allowed to eat, bathe and rest on the outer ship;

(two) shall not trade with the crew of foreign ships, shall not ask for or buy from the crew. Entrust shopping goods or accept gifts privately;

(3) It is forbidden to watch movies, television and videos on foreign ships. Don't read books and newspapers at will on ocean-going ships, and don't carry internal documents and newspapers that are prohibited from being exported to ocean-going ships;

(4) Not to carry, destroy or steal equipment and articles on ocean-going ships without permission;

(5) Do not quarrel or fight on the ship;

(6) Not to sell political and economic information or engage in other activities to the crew of foreign ships;

(seven) shall not engage in other illegal activities. Article 16 When a person boarding an ocean-going ship finds that the crew, passengers and other domestic personnel of the ocean-going ship have violated the laws, regulations or other relevant provisions of our country, they shall report to the frontier inspection station in time. Chapter V Legal Liability Article 17 Frontier inspection stations may punish those who violate the relevant provisions of these Measures with warnings and fines. If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Eighteenth any of the following acts, may be punished by a warning or a fine of more than 300 yuan and less than 300 yuan:

(1) attempting to board a ship with another person's boarding certificate, altering the boarding certificate, or transferring the boarding certificate to another person for use;

(2) Deliberately defacing or destroying the boarding certificate issued by the frontier inspection station;

(3) Boarding without a boarding certificate or not wearing a uniform as required, and disobeying the management of the personnel on duty at the frontier inspection station;

(4) Carrying internal documents and materials whose export is prohibited;

(5) It is found that foreign ship crew, passengers and domestic boarding personnel violate Chinese laws and regulations and infringe upon the interests of the state and people.
