Provisions on the Administration of Qualification Certification of Travel Agency Managers

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the relevant provisions of the Regulations on the Administration of Travel Agencies. Article 2 The term "manager" as mentioned in these Provisions refers to the general manager (deputy general manager) employed by the travel agency and the department manager or business supervisor at the same level. Article 3 The qualification certificates of travel agency managers include: general manager qualification certificate of international travel agency, department manager qualification certificate of international travel agency, general manager qualification certificate of domestic travel agency and department manager qualification certificate of domestic travel agency. Article 4 The administration of qualification certification of travel agency managers shall be under the unified leadership of the National Tourism Administration, and shall be organized and implemented jointly with the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government. Article 5 The National Tourism Administration shall set up a leading group for the qualification certification of travel agency managers, with an office and an expert committee.

The tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government have set up leading groups for the qualification certification of travel agency managers, with offices under them. Chapter II Application Conditions Article 6 The manager of a travel agency must be a citizen of People's Republic of China (PRC). Article 7 The general manager (deputy general manager) of an international travel agency shall have a college degree or above, and have worked in the position of manager of the travel agency department for more than three years, or engaged in other tourism economic management for more than five years. Article 8 The department manager or business supervisor at the same level of an international travel agency shall have a college degree or above, and have worked in a travel agency for more than three years, or engaged in other tourism economic management for more than three years, or engaged in other enterprise management for more than five years. Article 9 The general manager (deputy general manager) of a domestic travel agency shall have a college degree or above, and have worked in the position of manager of the travel agency department for more than two years, or engaged in other tourism economic management for more than three years, or engaged in other enterprise management for more than five years. Article 10 The manager of a domestic travel agency or the business supervisor at the same level shall have a high school education or above, and have worked in a travel agency for more than two years, or engaged in other tourism economic management for more than two years, or engaged in other enterprise management for more than three years. Eleventh any of the following circumstances, shall not participate in the travel agency manager qualification examination:

(1) Having a record of intentional crime;

(2) Being the legal representative of an enterprise whose business license has been revoked due to violation of the law, or bankrupt and liquidated due to poor management, and bearing personal responsibility or direct leadership responsibility for the above situations;

(3) Having been examined by judicial organs or party and government departments, and no conclusion has been reached;

(four) gambling, drug abuse, prostitution and other bad behaviors that are not suitable for tourism;

(five) in violation of social morality, causing serious adverse effects. Chapter III Training and Examination Article 12 Those who have been assessed by the tourism administrative departments at or above the provincial, autonomous region or municipality directly under the Central Government and meet the requirements specified in Articles 6, 7, 8, 9, 10 and 11 of these Provisions and need to take the qualification examination for travel agency managers must receive the qualification examination training specially organized by the tourism administrative departments at or above the provincial, autonomous region or municipality directly under the Central Government.

The training of the qualification examination for travel agency managers shall be undertaken by the education and training departments entrusted by the National Tourism Administration and the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government. Thirteenth travel agency manager qualification examination training guidance teaching plan and teaching materials, organized or designated by the National Tourism Administration. Fourteenth personnel who take the qualification examination for travel agency managers shall take the unified examination organized by the National Tourism Administration after receiving training. Fifteenth travel agency manager qualification examination is set up in provinces, autonomous regions and municipalities directly under the central government, and is organized and implemented by the tourism administrative departments of the provinces, autonomous regions and municipalities directly under the central government. Sixteenth travel agency manager qualification examination time announced by the National Tourism Administration. Seventeenth general manager (deputy general manager) qualification examination subjects: travel agency management, policies and regulations.

The qualification examination subjects of department managers or business executives at the same level of travel agencies are: professional knowledge and practice (elementary), tourism economic policies and regulations [travel agencies].

When the National Tourism Administration deems it necessary, it may make appropriate adjustments to the subjects of the qualification examination for travel agency managers. Eighteenth travel agency manager qualification certificate by the National Tourism Administration unified production and distribution. Those who pass the qualification examination of travel agency managers can obtain the corresponding certificates listed in Article 3 of these Provisions. Article 19 The list of persons who have obtained the qualification certificate of travel agency managers shall be published by the National Tourism Administration. Chapter IV Supervision and Inspection Article 20 It is strictly forbidden to lend, transfer or forge the Qualification Certificate of Travel Agency Manager without permission. Article 21 An applicant for the establishment of a travel agency shall submit the qualification certificate of the travel agency manager employed by him to the tourism administrative department at or above the province, autonomous region or municipality directly under the Central Government. Article 22 During the annual inspection of travel agencies, the qualification certificate of travel agency managers must be sent to the tourism administrative departments at or above the province, autonomous region or municipality directly under the Central Government for inspection. If the inspection is qualified, the annual inspection organ shall affix the seal of annual inspection. Twenty-third after the establishment of a travel agency, during the operation period, if the operators holding the qualification certificates issued by the National Tourism Administration fail to reach the number stipulated in the Detailed Rules for the Implementation of the Regulations on the Administration of Travel Agencies, the tourism administrative department shall order them to make corrections within a time limit. If it is not handled within the time limit, it shall be deemed as not meeting the conditions for the establishment of a travel agency. The tourism administrative department that examines and approves the travel agency shall confiscate and cancel its travel agency business license, and notify the administrative department for industry and commerce to confiscate its business license as an enterprise legal person.
