Tourism Regulations of Pengshui Miao and Tujia Autonomous County (revised on 20 19)

Article 1 In order to rationally utilize and protect tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism in Pengshui Miao and Tujia Autonomous County (hereinafter referred to as Autonomous County), these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China, the Regulations of Chongqing Municipality on Tourism and the autonomous regulations of Pengshui Miao and Tujia Autonomous County, combined with the actual situation of the Autonomous County. Article 2 These Regulations shall apply to tourism planning, development, operation, management and tourism activities within the administrative area of Autonomous County. Third Autonomous County tourism development should follow the principles of government guidance, unified planning, market operation, rational development, strict protection and sustainable development, highlight the characteristics of folk culture eco-tourism, and adhere to the unity of ecological benefits, economic benefits and social benefits. Article 4 Autonomous County People's Government shall strengthen its leadership over tourism, incorporate the development of tourism into the national economic and social development plan, strengthen the construction of tourism infrastructure, improve the tourism environment, and encourage and support the development of tourism. Fifth Autonomous County People's government tourism administration department is responsible for the administrative area of tourism management and supervision.

The relevant departments of the Autonomous County People's Government shall, in accordance with their respective responsibilities, do a good job in the development of tourism.

Township people's governments and sub-district offices shall assist relevant departments to do a good job in tourism management and service. Sixth Autonomous County People's Government shall set up special funds for tourism development, included in the annual budget. It is mainly used for the general survey of tourism resources, the preparation of tourism development planning, the early development of key tourism resources and scenic spots, the construction of tourism public welfare facilities, tourism propaganda, investment promotion of tourism projects, the inheritance and protection of folk culture, the production and development of characteristic cultural products, and the discount on loans for tourism projects. Seventh Autonomous County encourages investors to invest in tourism, develop tourism resources, build tourism facilities and operate tourism projects in Autonomous County, and protect their legitimate rights and interests according to law.

Encourage and support citizens, legal persons and other organizations to invest in tourism projects with national culture and natural ecological experience, and develop and process tourism commodities with historical and cultural connotations of Pengshui and the characteristics of Miao and Tujia. Article 8 Autonomous County People's governments shall integrate funds for ethnic development, poverty alleviation and agricultural development, and support township people's governments and sub-district offices to develop rural tourism by using ethnic villages, natural landscapes, ecological agriculture and new countryside, and enrich tourism products. Article 9 Autonomous County People's Government shall guide tourist attractions, travel agencies, tourist hotels, farmhouses and tourist transportation enterprises to establish trade associations according to law, give full play to the role of guidance, service and industry self-discipline, and optimize the environment for tourism development.

Tourist hotels and restaurants implement the same water, electricity and gas prices as general industrial enterprises. Tenth autonomous county tourism authorities responsible for the investigation and evaluation of autonomous county tourism resources.

Autonomous County People's Government shall, according to the results of the census and evaluation, determine the key tourism resources and scenic spots in Autonomous County, and announce them to the public. Article 11 Autonomous County People's Government shall make full use of the advantages of tourism resources in Autonomous County, and actively build tourism brands with national and local characteristics such as Chiyou, Mowei Mountain, Ayi River, Wujiang Gallery, Yushan Ancient Town and Anzimiaozhai, and build a folk culture eco-tourism destination. Twelfth Autonomous County People's government to strengthen the ecological environment protection of tourism resources and scenic spots, no unit or individual may violate the provisions of the state and Chongqing Municipality on nature reserves, scenic spots and tourism management. Thirteenth autonomous county tourism development planning by the autonomous county tourism authorities to organize the preparation, reported to the Autonomous County People's government for approval before implementation. The approved tourism development plan shall not be changed without authorization. If it is really necessary to change, it shall be examined and approved in accordance with the procedures.

The overall planning and regulatory detailed planning of tourist attractions shall be organized by the competent tourism authorities of Autonomous County, involving the spatial layout and planning and construction land, and shall conform to the overall planning of land use, the overall planning of urban and rural construction and the planning of ecological protection and construction, and be coordinated with the tourism development planning and special tourism planning, and implemented after being approved by the Autonomous County People's Government.

Special tourism planning shall be prepared by the relevant competent departments of the Autonomous County and implemented after the approval of the Autonomous County People's Government.

The detailed planning for the construction of tourist attractions shall conform to the overall planning and regulatory detailed planning of tourist attractions, and shall be compiled by the project owners, solicit the opinions of the tourism authorities, and be implemented after being approved by the competent department of urban and rural planning of the autonomous county and reported to the people's government of the autonomous county. Fourteenth autonomous county water conservancy, electric power, transportation, communications, radio and television, municipal and other departments in planning, should take into account the needs of tourism development, involving the tourism development environment, it should seek the opinions of the autonomous county tourism authorities and the local township people's government, street offices. The development and utilization of fifteenth key tourism resources shall be decided by the Autonomous County People's Government, and the project owners shall be determined in accordance with the principles of openness, fairness and impartiality.

The development and utilization of other tourism resources shall be organized and implemented by the township people's governments and sub-district offices according to the tourism development planning of autonomous counties. Sixteenth tourism resources development operators occupy land, forest land and other resources, should be compensated according to law.

Encourage the owners or users of land and forest land to participate in the development of tourism resources by means of circulation and shareholding.
