Measures of Shenyang Municipality on the Administration of Short-distance Tourism

Article 1 In order to strengthen the management of short-distance tourism in our city, protect the legitimate rights and interests of tourists and operators, and promote the development of tourism, these Measures are formulated according to the actual situation of our city. Article 2 The term "short-distance tourism" as mentioned in these Measures refers to the tourism business activities of units and individuals engaged in tourism business, which organize tourists to take tourist vehicles to visit scenic spots within the administrative area of our city and surrounding areas in the form of teams or concentrated individual travelers, and return to their places of residence on the same day or within a few days. Article 3 The Municipal Tourism Bureau is the administrative department in charge of short-distance tourism management. Article 4 Units and individuals applying for short-distance travel must go through the following procedures:

(a) to the public security department for vehicle inspection and registration;

(two) to apply to the administrative department of transportation for the "People's Republic of China (PRC) Road Transport Certificate";

(3) Submit a written application to the Municipal Tourism Bureau with the above-mentioned documents. After examination and approval, go to the industrial and commercial and tax departments for business license and tax registration, and go to the insurance department for relevant insurance procedures as required. Article 5 Short-distance tour operators shall report to the municipal tourism administration department for the record within 10 days, and go through the formalities of suspension or closure in other relevant departments in accordance with regulations. Sixth vehicles engaged in short-distance travel must be equipped with qualified drivers and tour guides. Tour guides must hold a tour guide card issued by the Municipal Tourism Bureau. Drivers and tour guides should carry certificates, wear service marks, dress neatly, provide civilized and standardized services, and equip tour guides with portable public address equipment. Seventh vehicles engaged in short-distance travel must use a unified short-distance travel vehicle logo; Must have a complete license and be in good condition; The car should be hung or posted with tourist information, short-distance travel route map, scenic spot tickets, route price list and complaint telephone number. The inside and outside of the car should be kept clean and tidy. Article 8 Short-distance tour operators and tour guides shall publicize and protect the tourist environment to prevent pollution and damage to the tourist environment in their tour guide work. Ninth short-distance tour operators, tour guides and drivers should strictly implement the price standards approved by the price department, and use legal invoices and receipts. Tenth short-distance tour operators, tour guides and drivers shall not have the following acts:

(a) unauthorized changes in tourist routes, increase or decrease tourist attractions;

(2) Raising prices without authorization;

(3) forcing tourists to eat and shop in restaurants and shops designated by them;

(four) in any way to accept kickbacks, ask for property;

(5) Forcibly soliciting customers by improper means. Eleventh city tourism administrative departments should set up a complaint telephone, timely accept and investigate complaints from tourists. If the complaint is true, in addition to solving it in time, the complainant and informant should be given appropriate rewards. Twelfth in violation of these measures, one of the following acts, given a warning by the municipal tourism administrative department or the relevant administrative law enforcement departments, and impose a fine of more than 500 yuan 1000 yuan; If the circumstances are serious and violate the criminal law, the judicial organs shall deal with them according to law.

(a) engaged in short-distance tourism business activities without going through the relevant formalities as required;

(two) the driver and tour guide are not equipped according to the regulations, the tourist vehicles are in poor condition, and the tourist facilities do not meet the prescribed requirements;

(three) did not carry out tour guide activities in accordance with the prescribed standards;

(four) do not carry out environmental protection publicity according to the provisions, resulting in tourism environmental pollution;

(5) changing tourist routes without authorization, increasing or decreasing tourist attractions, forcing tourists to eat and shop in their designated restaurants and shops, or taking improper means to attract customers. Thirteenth in violation of the provisions of unauthorized price increases, price increases or in any way to accept kickbacks, asking for property, the municipal price and supervision departments shall be punished according to the relevant provisions; If the circumstances are serious and violate the criminal law, the judicial organs shall deal with them according to law. Fourteenth penalties for illegal acts must be carried out in accordance with the procedures stipulated in the Administrative Punishment Law of the People's Republic of China, and fines and confiscations must be paid to the finance at the same level in full and on time. Fifteenth if a party refuses to accept the decision on administrative punishment, it may apply for administrative reconsideration or bring a lawsuit to the people's court according to law. Neither applies for reconsideration nor brings a suit in a people's court within the time limit, nor complies with the decision on punishment, the organ that made the decision on punishment shall apply to the people's court for compulsory execution. Sixteenth specific issues in the implementation of these measures shall be interpreted by the Municipal Tourism Bureau. Seventeenth of these measures shall come into force as of the date of promulgation.
