Article 1 In order to strengthen the management of scenic spots, improve the quality of tourism services, effectively protect and scientifically develop tourism resources, and promote the sound and rapid development of tourism, these Measures are formulated in accordance with the State Council's Regulations on Scenic Spots, Qinghai's Tourism Regulations and other laws and regulations, combined with the actual city. Article 2 The term "tourist attractions" as mentioned in these Measures refers to an independent management area with functions of sightseeing, leisure and holiday, entertainment and fitness, unified management organization, clear geographical scope, corresponding tourist service facilities and corresponding tourist services, as determined in the Overall Plan for Tourism Development of Xining City. It mainly includes: scenic spots, historical sites, revolutionary memorial sites, temples and churches, hot spring resorts, nature reserves, resorts, theme parks, forest parks, geological parks, amusement parks, zoos, botanical gardens, reservoirs, and various tourist areas such as industry, agriculture, economy and trade, science and education, military affairs, sports, culture and art. Article 3 These Measures shall apply to the planning, construction, protection, operation and related management activities of tourist attractions within the administrative area of this Municipality. Article 4 The planning, construction, protection and management of tourist attractions shall follow the principles of government leading, market operation, protection first, scientific planning, rational development and sustainable utilization, implement the system of environmental and resource protection, safeguard the legitimate rights and interests of tourists and operators, and continuously improve the management level and service quality. Article 5 The municipal tourism administrative department shall be responsible for the supervision and management of tourism activities such as the construction and operation of tourist attractions within the administrative area of this Municipality. County (District) tourism administrative departments shall be specifically responsible for the supervision and management of tourism activities such as the construction and operation of tourist attractions within their respective administrative areas. Development and reform, planning, construction, transportation, agriculture and animal husbandry, forestry, urban management and law enforcement, land and resources, water conservancy, culture, sports, environmental protection, finance, public security, industry and commerce, price and other departments shall, according to their respective functions and duties, do a good job in the relevant management of tourist attractions. Article 6 The people's governments of cities and counties (districts) shall incorporate the planning, construction and development of tourist attractions into the plans for national economic and social development, and encourage and support the development of tourist attractions. City and county (District) people's governments shall set up special funds for tourism development, mainly used for tourism promotion, tourism infrastructure and supporting facilities construction, etc., and strengthen guidance, support and support for key projects. Seventh encourage domestic and foreign enterprises, organizations and individuals to attract social funds to participate in the development, construction and management of tourist attractions through sole proprietorship, cooperation and joint venture. Article 8 The development and construction of tourist attractions shall conform to the overall urban planning and the overall tourism development planning. The development, construction and protection planning of tourist attractions shall be compiled by units with corresponding planning qualifications, and shall be submitted for approval according to the prescribed procedures after being approved by the tourism administrative department. Ninth development and construction of tourist attractions, environmental impact assessment should be carried out, and the relevant environmental protection facilities must be designed, constructed and put into use at the same time as the main project. Article 10 When developing and constructing new scenic spots within the key protection scope at or above the municipal level, tourist areas and living areas shall be divided according to the principle of sightseeing in the scenic spots and accommodation outside the scenic spots, and supporting sanitary facilities and other service facilities shall be set up in accordance with the regulations to coordinate with the scenic environment. Eleventh tourist attractions and their surrounding protected areas should be in harmony with the landscape; In the tourist area, hotels, guest houses, rest (treatment) institutions and other permanent buildings (structures) that affect the natural landscape shall not be built. Twelfth tourism administrative departments should strengthen the dynamic supervision and management of the planning and implementation of scenic spots, and timely discover and stop the development activities that violate the planning and destroy the scenic resources and ecological environment. When the construction project of tourist attractions is completed and accepted, the tourism administrative department shall participate. Thirteenth the use of natural resources to develop tourism projects, strict protection measures should be taken, not to destroy the landscape and pollute the environment. The use of historical and cultural resources to develop tourism projects shall maintain its unique historical features and shall not be rebuilt, rebuilt, relocated or demolished without authorization. Fourteenth in the construction of tourist attractions, the construction unit shall protect the surrounding scenery, vegetation, water and landforms. After the completion of the project, the site should be cleaned in time to restore vegetation. It is forbidden to dump construction waste in scenic spots. Fifteenth tourist attractions operators shall comply with the following provisions:
(a) to formulate the management system and measures of tourist attractions, and be responsible for their implementation;
(two) the establishment of a tourist center as the main form of tourism service organizations, to provide tourists with tourism explanation, consultation, complaints, medical care and other related services;
(three) in accordance with the provisions of the scenic spot guide signs and public information graphic signs in line with national standards;
(four) the establishment of safety management responsibility system, equipped with full-time (part-time) personnel and necessary safety equipment and facilities to adapt to the safety management work;
(five) set up obvious tips or warning signs for dangerous places or projects, and take necessary safety protection measures;
(six) to formulate emergency plans and strengthen emergency management;
(seven) to submit the monthly report, annual report and holiday report of tourism statistics in accordance with the regulations;
(eight) the operation of special tourism projects involving public safety, the facilities and equipment shall be inspected by the relevant legal institutions, and can be put into operation only after obtaining the certificate;
(nine) to publicize the service charge items and standards, to ensure the quality of service, and not to deceive, blackmail, coerce or mislead tourists;
(ten) the effective protection and management of natural landscape, cultural relics, historical sites and cultural landscape;
(eleven) responsible for the environmental sanitation work of tourist attractions;
(twelve) take the initiative to accept the supervision and management of tourism, price and other departments;
(thirteen) other obligations that should be performed according to law.
