Interim Measures for the Supervision and Administration of Outbound Tourism Business in Pilot Operation of Sino-foreign Joint Venture Travel Agencies

Article 1 In order to further accelerate the opening up of the tourism industry, strengthen international tourism cooperation, introduce advanced international travel agency business models, promote the transformation and upgrading of China's travel agency industry, and improve international competitiveness, these Measures are formulated in accordance with the Travel Agency Regulations and the State Council's Opinions on Accelerating the Development of Tourism. Article 2 On the basis of pilot projects, the State will gradually open the outbound tourism business of domestic residents to foreign-invested travel agencies. Article 3 Chinese-foreign joint venture travel agencies shall abide by these Measures when conducting outbound tourism business on a pilot basis. Article 4 The pilot outbound tourism business of Sino-foreign joint venture travel agencies mentioned in these Measures refers to the business activities of Chinese-foreign joint venture travel agencies that have obtained the pilot qualification to attract, organize and receive China mainland residents to travel abroad and travel to Hong Kong and Macao Special Administrative Regions; Except mainland residents who go to Taiwan Province province. Article 5 The State strictly controls the number of Sino-foreign joint venture travel agencies that operate outbound tourism business on a pilot basis. The specific number is decided by the tourism administrative department of the State Council. Article 6 A Chinese-foreign joint venture travel agency applying for pilot operation of outbound tourism business shall meet the conditions stipulated in Article 8 of the Travel Agency Regulations, and submit an application to the tourism administrative department of the State Council and relevant supporting documents meeting the conditions stipulated in Article 8 of the Travel Agency Regulations. Article 7 Sino-foreign joint venture travel agencies that conduct outbound tourism business on a pilot basis shall be selected and determined by the tourism administrative department of the State Council from among the applicants, and the "Approval Letter for Business License of Foreign-invested Travel Agencies" shall be issued to the applicants. Article 8 An applicant shall submit an application for changing the business scope to the competent department of commerce with the Letter of Approval for Business License of Foreign-invested Travel Agency and the contracts and articles of association signed by all investors. The competent department of commerce shall make a decision of approval or disapproval in accordance with the provisions of relevant laws and regulations. If it is approved, the approval certificate of the foreign-invested enterprise shall be renewed, and the applicant shall be notified to apply to the tourism administrative department of the State Council for a travel agency business license; If it is not approved, it shall notify the applicant in writing and explain the reasons.

The applicant shall apply to the administrative department for industry and commerce for changing the business scope of the enterprise with the renewed Travel Agency Business License and the Approval Certificate for Foreign-invested Enterprises. Article 9 A Sino-foreign joint venture travel agency (hereinafter referred to as the pilot travel agency) that has obtained the qualification of pilot outbound tourism business shall, within three working days from the date of renewal of the Travel Agency Business License, increase the quality guarantee by RMB 654.38+RMB 200,000, and submit relevant supporting documents to the tourism administrative department of the State Council. Tenth pilot travel agencies shall, within 3 years after operating outbound tourism business, submit the following business information and materials to the tourism administrative department of the State Council every six months:

(a) the number and number of organizations that organize and receive outbound tourists;

(2) outbound tourism business volume;

(3) Experience and effect. Eleventh within three years after the implementation of these measures, the tourism administrative department of the State Council shall evaluate the effect of the pilot outbound tourism business every year, and adjust the number of pilot outbound tourism business and pilot travel agencies according to the evaluation results. Twelfth pilot travel agencies engaged in outbound tourism business, its business activities should comply with the "Regulations on Travel Agencies", "China citizens travel abroad management measures" and other laws, regulations and rules. Thirteenth tourism administrative departments and other relevant administrative departments shall supervise and manage the pilot travel agencies in accordance with the Regulations on Travel Agencies, the Measures for the Administration of Overseas Travel of China Citizens and the relevant laws, regulations and rules of the state. Fourteenth pilot travel agencies in violation of the provisions of these measures, by the tourism administrative departments and other relevant administrative departments, in accordance with the "Regulations on Travel Agencies", "China citizens travel abroad management measures" and the provisions of relevant laws, regulations and rules of the state for punishment. Fifteenth these Measures shall come into force as of the date of promulgation.
