Measures of Shanghai Municipality on the Administration of Jiuduansha Wetland Nature Reserve
In order to strengthen the protection of the ecological environment and ecological resources in Shanghai Jiuduansha Wetland Nature Reserve, these measures are formulated in accordance with the regulations of People's Republic of China (PRC) Nature Reserve and relevant laws and regulations, and combined with the actual situation. Article 2 (Nature of Protected Areas)
Shanghai Jiuduansha Wetland Nature Reserve (hereinafter referred to as the reserve) is an estuary wetland nature reserve with wetland ecosystem as the protection object. Article 3 (Scope of Application)
These Measures shall apply to the planning, construction, protection and related management activities of protected areas. Article 4 (Administrative Department)
Shanghai Pudong New Area People's Government (hereinafter referred to as the new district government) is entrusted by the municipal government to be in charge of the work of protected areas, responsible for the preparation of protected area planning, protected area construction and related management activities; Shanghai Jiuduansha Wetland Nature Reserve Management Office (hereinafter referred to as Jiuduansha Management Office) is the management institution of the reserve, which is specifically responsible for the daily management of the reserve.
Shanghai Environmental Protection Bureau (hereinafter referred to as the Municipal Environmental Protection Bureau) is responsible for the comprehensive management of protected areas, and guides, supervises and inspects the environmental protection of protected areas.
The relevant departments of development and reform, planning, construction, land, agriculture, forestry, public security, fishery, ocean, port and water affairs of this Municipality shall, according to their respective responsibilities, coordinate the implementation of these measures. Article 5 (Determination of the Scope of Protected Areas)
The scope of the reserve includes the land of the four sandbars of Jiangya Nansha, Shangsha, Zhongsha and Xiasha and the surrounding waters within a certain range. The specific scope is proposed by the new district government in conjunction with the Municipal Environmental Protection Bureau and other relevant departments, and approved by the Municipal Planning Bureau, and reported to the municipal government for approval and promulgation.
If it is necessary to adjust the scope of protected areas due to changes in geographical environment, the new district government shall, jointly with the Municipal Environmental Protection Bureau and other relevant departments, propose an adjustment plan, which shall be approved by the Municipal Planning Bureau and promulgated by the municipal government.
Jiuduansha management department shall, according to the scope of the protected area approved by the municipal government, set up obvious landmarks in the corresponding position. Article 6 (Management Principles)
The protection and management of protected areas should follow the principles of scientific planning, zoning control, unified management and rational utilization. Article 7 (Sources of Funds)
The sources of protection funds for protected areas include:
(1) Special funds allocated by the finance;
(two) donations from domestic and foreign organizations, enterprises and individuals;
(3) Funds raised by other means permitted by the state. Article 8 (Planning of Protected Areas)
The new district government shall, according to the needs of the natural environment and wetland ecological protection of the protected area, formulate the ecological construction and development plan of the protected area jointly with the Municipal Environmental Protection Bureau, and organize the implementation after the approval of the municipal government. The approved ecological construction and development plan of protected areas shall be incorporated into the national economic and social development plans of this Municipality and Pudong New Area.
The new district government should take appropriate forms to listen to the opinions of relevant experts and organize environmental impact assessment in the process of compiling the ecological construction and development plan of protected areas. Article 9 (Division of Functional Zones)
According to the ecological development characteristics of the reserve, the reserve is divided into three functional areas: core area, buffer area and experimental area. The determination and adjustment of the specific scope of the three functional areas shall be proposed by the new district government and reported to the Municipal Nature Reserve Review Committee for approval.
Jiuduansha management department shall set up obvious signs in the corresponding positions according to the scope of the three functional areas approved by the municipal government. Article 10 (Behavior Restrictions in Core Zone, Buffer Zone and Experimental Zone)
In the core area, except for the needs of scientific research, it is necessary to enter the core area to engage in scientific research observation and investigation activities, and any other activities are prohibited.
In the buffer zone, except for scientific research activities such as scientific research observation, investigation, teaching practice and specimen collection, any development and utilization activities are prohibited.
In the experimental area, in addition to the activities permitted in the first and second paragraphs of this article, you can also carry out related activities such as sightseeing, eco-tourism, protozoa and rare animal and plant breeding. However, development and utilization activities that seriously affect the hydrodynamic environment and destroy ecological resources are prohibited. Article 11 (Management of Teaching and Scientific Research Activities)
To carry out teaching and scientific research activities such as scientific observation, investigation, teaching practice and specimen collection in protected areas, a written application shall be submitted to Jiuduansha Management Bureau in advance, and the written application shall include the following contents:
Basic information of the applicant;
(two) the time, content, scale, number of people, scope and equipment used for the scheduled activities;
(3) Names and quantities of animals and plants to be captured or collected. Among them, if it is necessary to capture and collect wild animals and plants protected by the state and this Municipality, a license issued by the relevant administrative department shall also be provided.
Jiuduansha management department shall make a decision on examination and approval within 10 working days from the date of accepting the application, and notify the applicant of the examination and approval results and reasons in writing. Among them, the need to enter the core area for scientific research activities, Jiuduansha management department shall put forward preliminary opinions within 5 working days from the date of receiving the application, and report to the Municipal Environmental Protection Bureau for approval. The Municipal Environmental Protection Bureau shall make a decision on examination and approval within 5 working days from the date of receiving the preliminary examination opinions, and notify the Jiuduansha Management Bureau. Jiu Duan Sha Management Department shall immediately notify the applicant in writing after receiving the approval decision of the Municipal Environmental Protection Bureau.
Jiuduansha management department believes that the scientific research activities carried out by the applicant are valuable for protecting the ecological environment and ecological resources, and can sign relevant agreements with the applicant to stipulate the ownership and use right of scientific research results.
