Main laws and regulations of overseas tourism management.

1. Examination and approval system for overseas tourist destinations

Travel destinations abroad refer to countries or regions that allow travel agencies to organize tours for China citizens with the approval of the China Municipal Government. According to the provisions of Article 2 of the Measures for the Administration of China Citizens Traveling Abroad, the destination countries of China citizens traveling abroad are proposed by the National Tourism Administration in conjunction with the Ministry of Foreign Affairs, the Ministry of Public Security and other relevant departments, and announced by the National Tourism Administration after being approved by the State Council.

China is a country with a huge outbound tourism market. In recent years, more and more countries hope to become destinations for China citizens to travel abroad. Therefore, the examination and approval of overseas tourist destinations is a very serious and important work. Generally speaking, as a destination for China citizens to travel abroad, they should meet the following conditions:

(1) is a tourist source country in China, which is conducive to tourism cooperation and exchanges between the two sides;

(2) Being politically friendly to China and conducting state diplomacy are in line with China's foreign policy;

(3) Tourism resources are attractive and have reception service facilities suitable for China tourists;

(4) There is no policy of discrimination, restriction or retaliation against China tourists politically and legally;

(5) Tourists have a sense of security and good accessibility.

As can be seen from the above provisions, travel agencies engaged in overseas tourism business may not organize tourists to travel to countries and regions other than China citizens' overseas tourist destinations announced by the tourism administrative department of the State Council.

2. Examination and approval system for operating overseas tourism business

A travel agency that has obtained a business license for two years and has not been fined by the administrative organ for violating the legitimate rights and interests of tourists may apply to the tourism administrative department of the State Council for outbound tourism business.

Where a travel agency obtains an outbound travel business license, the the State Council tourism administrative department shall renew the travel agency business license. The travel agency shall register the change of business scope with the administrative department for industry and commerce with the Travel Agency Business License.

The tourism administrative department of the State Council may entrust the provincial tourism administrative department to accept the application of travel agencies for outbound tourism business, and make a decision on whether or not to grant permission.

The provisions of the Interim Measures for the Administration of Border Tourism shall apply to travel agencies applying for border tourism business.

Where a travel agency applies for the business of traveling to Taiwan Province Province, the provisions of the Measures for the Administration of Mainland Residents Traveling to Taiwan Province Province shall apply.

According to the provisions of Article 5 of the Measures for the Administration of Overseas Travel of China Citizens, the National Tourism Administration shall publish the list of travel agencies (hereinafter referred to as tour groups) that have obtained overseas travel business qualifications, and notify foreign affairs, public security and other relevant departments.

3. Total overseas tourism control system

According to Article 6 of the Measures for the Administration of Overseas Tourism of China Citizens, the National Tourism Administration determines the total number of overseas tourism organizations in this year before the end of February each year according to the performance of national inbound tourism in the previous year, the increase of destination countries and the development trend of overseas tourism, and issues it to the tourism bureaus of all provinces, autonomous regions and municipalities directly under the Central Government. The provincial tourism bureaus shall, according to the annual performance, business ability and service quality of travel agencies with overseas tourism business qualifications within their respective administrative areas, and in accordance with the principles of fairness, justice and openness, verify the arrangement of the number of overseas tourists organized by tour groups this year before the end of March each year. In short, in order to achieve the goal of controlling the total number of overseas tourists, the National Tourism Administration determines the total number of overseas tourists every year, and then decomposes it into provincial tourism bureaus, which in turn decompose it into travel agencies. In order to ensure the concrete implementation of this measure, the Measures for the Administration of Overseas Tourism of Citizens of China stipulates that the National Tourism Administration shall supervise the number of overseas tourists approved by provincial tourism bureaus and the overseas tourism of China citizens organized by travel agencies.
