Regulations of Shaanxi Province on Tourism Management (2005)

Chapter I General Provisions Article 1 In order to promote the development of tourism, standardize the order of tourism market, effectively protect, rationally develop and utilize tourism resources, and safeguard the legitimate rights and interests of tourists and tour operators, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this province. Article 2 "Tourism" as mentioned in these Regulations refers to a comprehensive industry that provides tourists with services such as sightseeing, catering, accommodation, transportation, shopping, entertainment and information by using tourism resources and facilities. Article 3 These Regulations shall apply to the planning, development, construction, operation, service and management of tourism within the administrative area of this province, as well as the units and individuals engaged in tourism activities. Article 4 To develop tourism in this province, we should give full play to the advantages of tourism resources in this province, highlight its characteristics, adhere to unified planning, rational development and coordinated development, and realize the unity of economic, social and environmental benefits. Article 5 The people's governments at or above the county level shall incorporate the development of tourism into the national economic and social development plan, increase investment in tourism, open up the tourism market, improve the management system, create a civilized and healthy tourism environment, meet the needs of tourists' cultural life, and promote the sustainable development of tourism. Article 6 The tourism industry shall follow the principle of unified leadership and hierarchical management.

The tourism administrative department of the provincial people's government is responsible for the tourism management of the whole province. City, county (District) tourism administrative departments responsible for the administrative area of tourism management.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the management and service of tourism. Seventh tour operators can set up trade associations according to law.

Tourism industry associations shall formulate industry service standards, strengthen industry self-discipline and carry out activities in accordance with their articles of association. Eighth units and individuals that have made outstanding contributions to the development of tourism, the people's governments at or above the county level shall commend and reward. Chapter II Tourism Planning and Tourism Resources Development and Protection Article 9 The provincial tourism development plan shall be formulated by the provincial tourism administrative department jointly with relevant departments, and shall be linked with land use planning, overall urban planning, environmental protection planning, scenic spot planning, cultural relics protection planning and cultural industry planning, and shall be submitted to the provincial people's government for approval and implementation after full demonstration.

City, county (District) people's government shall, according to the provincial tourism development plan, formulate the tourism development plan of this administrative region and organize its implementation. Tenth city and county (District) tourism administrative departments in the preparation of special planning within their respective administrative areas, should reflect the regional characteristics and functional characteristics, widely listen to public opinions, and report to the tourism administrative department at the next higher level for comprehensive balance. Eleventh provinces, cities and counties (districts) tourism administrative departments in conjunction with the relevant administrative departments, to investigate and evaluate the tourism resources, establish tourism resources files, and guide the protection, development and construction of tourism resources. Twelfth new construction, renovation and expansion of tourism construction projects and tourism facilities projects shall conform to the tourism development plan, and their building scale and style shall be in harmony with the surrounding landscape, and shall not damage the tourism environment and ecological environment.

The relevant administrative departments shall solicit the opinions of the tourism administrative departments when demonstrating the tourism construction projects and tourism facilities projects, and the environmental protection departments shall conduct environmental impact assessment according to law.

It is forbidden to engage in activities that destroy the ecological environment such as quarrying, mining, sand digging, earth borrowing, grave building, logging, burning, etc. in tourist attractions (spots) and planning areas, and it is forbidden to discharge pollutants into tourist attractions (spots) and planning areas. Thirteenth the use of scenic spots, nature reserves and forests, waters, wetlands and other natural resources to develop tourism projects, should take corresponding protective measures, not to destroy the landscape, pollute the environment, hinder the tour.

The use of natural resources to develop tourism projects should take into account local interests and correctly handle the relationship between tourism resources development and local social and economic development and people's production and life. Fourteenth the use of cultural relics and other historical and cultural resources to develop tourism projects shall abide by the laws and regulations on the protection of cultural relics and maintain its unique historical features, and shall not be rebuilt, moved or demolished without authorization. Chapter III Tourism Promotion and Development Article 15 Provincial and municipal people's governments should strengthen their leadership over tourism, integrate tourism resources, optimize the tourism environment and build tourism brands; Establish a joint meeting system for tourism work, study and formulate policies to promote tourism development, and coordinate and solve major problems in tourism market management. Article 16 The municipal people's governments of provinces and districts shall set up special funds for tourism development, which shall be included in the annual financial budget for the promotion of the overall image of tourism, the development of the tourism market, the construction of tourism public welfare facilities and information networks, and the organization of major tourism promotion activities. Seventeenth domestic and foreign enterprises, other organizations and individuals are encouraged to invest in tourism in various forms, and their legitimate rights and interests are protected by law. Tourism administrative departments should provide policy advice and information services for investors. Eighteenth the right to operate state-owned tourism resources can be transferred according to law, except those that are not allowed to be transferred according to laws and regulations.

The transfer of the management right of state-owned tourism resources shall follow the principles of openness, fairness, impartiality and good faith, and shall be carried out by auction and bidding. Nineteenth people's governments at or above the county level shall make good use of relevant professional meetings, trade fairs, cultural performances, sports events, scientific and technological exchanges and other activities to promote tourism.

Tourism operators should take various forms to carry out promotional activities to improve the visibility of products and services.
