Provisions of Hainan Province on the Administration of Tourist Attractions

Article 1 In order to strengthen the development, construction and management of tourist attractions, improve the quality of tourism services, effectively protect, utilize and scientifically develop tourism resources, and promote the sustained and healthy development of tourism in our province, these Provisions are formulated in accordance with relevant national laws and regulations and combined with the actual situation of this province. Article 2 A scenic spot refers to an independent management area with tourism and related activities as its main function or one of its main functions, with functions of sightseeing, leisure and holiday, entertainment and fitness, and corresponding tourism service facilities and services, with a unified management organization and a clear geographical scope.

The tourist attractions in this province are divided into general tourist attractions and key tourist attractions.

The list of general tourist attractions is compiled and published by the provincial tourism administrative department, and the list of key tourist attractions is compiled and published by the provincial people's government. Article 3 The people's governments of provinces, cities, counties and autonomous counties shall incorporate the construction, development and protection of tourist attractions into the national economic and social development plan. Fourth provincial tourism administrative departments responsible for the supervision and management of the province's tourist attractions.

The tourism administrative departments of cities, counties and autonomous counties shall be responsible for the supervision and management of tourist attractions within their respective administrative areas.

The relevant administrative departments shall, in accordance with their respective duties, be responsible for the supervision and management of scenic spots in tourist attractions. Fifth provincial tourism administrative departments shall, jointly with relevant departments, conduct a general survey, classification and evaluation of tourism resources within the administrative area of this province, and establish tourism resources files.

The development and utilization of tourism resources should adhere to the principles of strict protection, rational development, scientific management and sustainable utilization.

All units and individuals have the obligation to protect tourism resources, and have the right to stop and report acts that destroy tourism resources. Sixth to encourage domestic and foreign investors and various economic organizations and individuals to invest in the development and operation of tourist attractions. Seventh tourist attractions development and construction should adhere to the planning first. The tourism administrative departments of cities, counties and autonomous counties shall, jointly with relevant departments, prepare the planning of tourist attractions according to the outline of Hainan International Tourism Island construction and development planning, urban and rural planning, overall land use planning and tourism development planning.

The planning of general tourist attractions shall be approved and implemented by the people's governments of cities, counties and autonomous counties, and reported to the provincial tourism administrative departments for the record. The scenic spot planning of key tourist attractions, after being reviewed by the Provincial Tourism Planning Commission, shall be submitted to the provincial international tourism island construction leading body for approval and implementation. The approved scenic spot planning of tourist attractions shall not be changed without authorization. If it is really necessary to adjust or change due to special circumstances, it shall be submitted for approval in accordance with the original approval procedures.

The planning of tourist attractions involves the planning of marine functional areas, nature reserves, scenic spots, cultural relics and historical and cultural buildings. , and shall abide by relevant laws and regulations.

If the planning of tourist attractions is not approved according to law, the relevant departments shall not go through the licensing procedures for development and construction. Eighth development and construction of tourist attractions, environmental impact assessment should be carried out according to law.

Environmental protection facilities and tourism safety protection facilities shall be designed, constructed and put into use simultaneously with the main project.

The development and construction of tourist attractions should protect the forest vegetation, water resources, wetlands, wildlife, cultural relics, historical and cultural buildings, ancient and famous trees and other resources in the tourist attractions according to law. Article 9 The new construction, renovation and expansion of key tourist attractions shall be audited by the people's governments of cities, counties and autonomous counties and submitted to the Provincial Tourism Planning Commission for approval and implementation.

Low-grade and low-level repeated construction of scenic spots is prohibited. Article 10 The layout, shape and color of landscape, amusement and supporting service facilities in scenic spots should be in harmony with the landscape and environment. Commercial houses and other permanent buildings and structures that affect the natural landscape shall not be built in the scenic spots in violation of the planning.

Without approval according to law, no trees may be cut down or mines may be opened in tourist attractions; It is forbidden to quarry, dig sand, borrow soil, bury graves, open up wasteland, dig ponds for breeding, and discharge pollutants beyond the standard in tourist attractions. In addition to industrial tourist attractions, it is forbidden to set up industrial and mining enterprises in other tourist attractions. Eleventh provinces and cities, counties and autonomous counties people's governments shall take corresponding measures to give priority to the construction of roads, water supply, power supply, communication and other facilities leading to tourist attractions.

The administrative departments of transportation, housing and construction, urban management, etc. shall arrange bus routes from scenic spots to urban areas and transportation hub areas, reasonably set up parking lots (stations) and other tourism supporting facilities, and improve tourist traffic and passenger transport conditions when preparing road construction plans, passenger transport routes and site plans.

The administrative department of transportation shall open public passenger lines from urban areas (counties and towns) to scenic spots, and set up scenic spots signs in Chinese and English in expressway and other traffic arteries.

Building new buildings and structures in the control zone around tourist attractions shall not damage the environmental features of scenic spots. Twelfth tourist attractions should establish a tourism safety management system, equipped with safety officers, safety supervisors and necessary safety facilities and equipment according to law, formulate emergency plans for safety, fire protection and public emergencies and organize drills.

Tourism operators who engage in or organize high-risk special tourism activities such as rafting, mountaineering, diving, motorboat and umbrella towing shall go through the examination and approval procedures in accordance with the relevant provisions of the state and this province.

Dangerous places or projects should be provided with obvious safety tips or warning signs, and necessary safety protection measures should be taken.
