Interim Measures for the Administration of Homestay in Guangdong Province

Chapter I General Provisions Article 1 In order to standardize the operation and management of homestays, protect the legitimate rights and interests of tourists and operators, promote the sustained and healthy development of homestay industry, revitalize idle resources in urban and rural areas, and promote rural revitalization, these measures are formulated in accordance with the provisions of the Tourism Law of the People's Republic of China, the Tourism Regulations of Guangdong Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the business activities, supervision and management of homestays within the administrative area of this province.

The term "B&B" as mentioned in these Measures refers to the small accommodation facilities operated by urban and rural residents using their own houses with ownership or use rights or other conditions, where the organizers participate in the reception and provide tourists with experience of local natural landscape, distinctive culture and production and lifestyle. Article 3 The management of homestays shall follow the principles of policy guidance, facilitating access, strengthening supervision and industry self-discipline. Article 4 The people's governments at or above the county level shall establish an overall coordination mechanism for the development of homestays, and be responsible for the decision-making and coordination of major issues concerning the development of homestays.

Tourism authorities are responsible for coordinating the daily work of hotel development, promoting the formulation of hotel-related service standards, promoting the promotion of hotels and guiding the training of hotel management business.

The public security department is responsible for the daily public security management of the hotel, guiding the hotel operators to install and maintain the public security management information system, and configuring the necessary safety technical prevention facilities.

The fire department shall supervise and inspect the hotel operators' compliance with the provisions on fire safety management according to law, and guide the rectification and fire safety training of hotel fire safety hazards. Local and listed fire departments can formulate fire safety technical requirements for local hotels on the basis of national fire technical requirements.

The market supervision and management department is responsible for the commercial registration of hotel operators, guiding hotel operators to be honest and trustworthy, fair competition, and maintaining market order.

Urban and rural construction, planning, health administration, ecological environment and other competent departments. Should be responsible for guiding and supervising the operation of the hotel according to their respective responsibilities. Fifth Township People's governments and sub-district offices shall assist relevant departments to carry out supervision and management of homestays. Article 6 The establishment of homestay industry associations is encouraged, and the homestay industry associations are supported to perform the functions of industry self-discipline and professional services. B&B trade associations shall accept the business guidance of industry management departments, formulate service standards, participate in the evaluation and review of B&B grades, and provide information consultation, product promotion, training and exchange, dispute coordination and other services for members. Seventh support the development of homestays in rural areas with tourism resources. Encourage farmers, village collective economic organizations and economic organizations with professional management ability to participate in the management of rural residents' guest houses by means of independent operation, leasing and joint venture.

The people's governments at or above the county level can give corresponding policy support to the homestay gathering places with good ecological environment and distinctive humanistic characteristics around Nanyue scenic spots, characteristic tourist villages and towns, historical and cultural blocks and ancient post roads, so as to guide the standardized and orderly development of homestays. Eighth people's governments at or above the county level shall, according to the tourism development planning and special planning, strengthen the guidance on the operation and management of homestays; Conditional counties (cities, districts) and towns (streets) can organize the development planning of homestays. Chapter II Requirements and Procedures for Start-up Article 9 The size of hotel rooms shall be implemented with reference to the Basic Requirements and Evaluation of Tourist Homes (LB/T 065-20 17), and the number of rooms in single building shall not exceed 14 (sets). Places where the number of rooms in a single building exceeds the aforementioned scale shall be managed in accordance with the relevant laws, regulations or rules of the hotel industry.

The people's governments at or above the prefecture level may, in combination with local conditions, appropriately relax the requirements for the scale of homestays specified in the preceding paragraph on the premise of correspondingly improving the technical requirements for fire safety. Article 10 The site selection of homestays shall comply with the relevant provisions of spatial planning, and shall avoid high-risk areas prone to natural disasters such as mountain torrents and mudslides. Article 11 B&B buildings shall meet the national standards and requirements for housing quality and safety.

Rebuilding a B&B building shall not damage the main building and load-bearing structure. When necessary, reinforcement measures should be taken and safety appraisal should be carried out to ensure the safety of buildings.

The architectural style of the hotel should be in harmony with the local landscape environment. Article 12 The fire safety requirements of homestays in towns (excluding counties, towns), townships and villages rebuilt by villagers' self-built houses shall be implemented in accordance with the Notice of the National Tourism Administration of the Ministry of Housing and Urban-Rural Development on Printing and Distributing the Fire Prevention Specifications for Farmhouses (homestays) (Jiancun [2017] No.50).

The scale of business premises and fire safety requirements of other B&Bs for house renovation can be implemented with reference to the documents in the preceding paragraph.

The fire safety of homestays reconstructed from other civil buildings other than houses shall meet the requirements of Code for Fire Protection Design of Buildings (GB 500 16). Thirteenth hotel management should meet the following basic requirements of public security management:

(1) Installing a hotel guest information collection system recognized by the public security department, registering the real names of guests and the identity information of employees in accordance with regulations, and reporting to the public security department in accordance with regulations;

(two) equipped with necessary security facilities such as anti-theft and video surveillance.
