Article 41 Compensation Rules of Tourism Law

In 2006, "Several Opinions of National Tourism Administration on Further Strengthening the Construction of Tour Guides in China" proposed that tour guides should "vigorously carry out patriotism education and socialist concept of honor and disgrace education, guide to establish a correct world outlook, values and outlook on life, oppose money worship, adhere to people-oriented, tourists first, serve tourists wholeheartedly, and vigorously cultivate good habits of loving their jobs, being thoughtful and willing to contribute". This is actually a requirement for the professional ethics of tour guides. Therefore, tour guides and tour leaders should follow professional norms, abide by professional ethics, respect the rights of tourists and safeguard the interests of tourists in their practice activities; Strive to improve their professional quality, satisfy tourists with high-quality services, enlighten tourists with rich knowledge, and guide tourists with healthy interests; There is no "bullying", no "cheating", no "yellow jokes" and other grandstanding.
Customs and habits refer to the traditional customs, etiquette and habits of individuals or collectives, and are the traditional behavior patterns or norms that people abide by in a specific social and cultural area, including national customs, holiday customs and traditional etiquette. The fourth paragraph of Article 4 of our Constitution stipulates: "All ethnic groups have the freedom to maintain or reform their own customs and habits." Article 10 of the Law on Regional National Autonomy stipulates: "The organs of self-government of ethnic autonomous areas guarantee that all local ethnic groups have free religious beliefs to maintain or reform their own national customs and habits, which refers to people's worship and recognition of their own beliefs, religious doctrines, unshakable beliefs and wholehearted conversion. Article 36 of the Constitution of China stipulates: "The people and citizens of China have freedom of religious belief. "Tourists come from all directions, and everyone has different customs and religious beliefs. Tour guides and tour leaders respect tourists' legal customs and religious beliefs, which is related to national unity, national unity and social stability. Therefore, on the basis of other laws and regulations, this law has made this connection provision.
Three, inform and explain the code of conduct for civilized tourism, guide tourists to healthy and civilized tourism, and discourage tourists from violating social morality.
Tourists themselves have the obligation to abide by social morality and tourism civilization norms. It is the professional requirement and social responsibility of tour guides and tour leaders to inform and explain the civilized behavior norms of tourism and guide tourists to travel healthily and civilized. Therefore, tour guides and tour leaders should take the lead in observing civilized tourism behavior in accordance with the provisions of this article, and inform tourists of the norms of civilized tourism behavior specified in the Convention on Civilized Domestic Tourism Behavior of China Citizens and the Guide to Civilized Outbound Tourism Behavior of China Citizens, and inform them not to participate in unhealthy tourism activities such as pornography, gambling and drugs. Popularize the knowledge of civilized etiquette and carry out civilized tourism education; Guide tourists to respect the cultural customs of tourist destinations and explain their customs, etiquette norms, national taboos and behavior patterns; When tourists don't understand, they should explain and explain.
Legal basis: Article 41 of the Tourism Law of the People's Republic of China. Tour guides and tour leaders engaged in business activities should wear tour guide cards and tour guide cards, abide by professional ethics, respect the customs and religious beliefs of tourists, inform and explain the code of conduct for civilized tourism, guide tourists to travel healthily and civilized, and discourage tourists from violating social morality. Tour guides and tour leaders shall strictly implement the travel itinerary, and shall not change the travel itinerary or suspend service activities without authorization, ask tourists for tips, and shall not induce, deceive, force or force tourists to shop or participate in paid tourism projects in disguise.
