Regulations of Xiamen Municipality on Tourism Management (revised in 24)

chapter I general provisions article 1 these regulations are formulated in order to strengthen tourism management, protect and rationally develop and utilize tourism resources, establish a unified, open and competitive tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, in accordance with the basic principles of relevant laws and administrative regulations, and in light of the actual situation of this municipality. Article 2 Legal persons, other organizations and individuals engaged in tourism and tourism management activities within the administrative area of this Municipality must abide by these Regulations. Article 3 "Tourism" as mentioned in these Regulations refers to a comprehensive service industry that takes tourism resources as the carrier and tourist facilities as the conditions to attract and receive tourists. Article 4 The development of tourism should adhere to the unity of social benefits, economic benefits and environmental benefits, highlight local characteristics, give full play to the advantages of tourism resources, and create a civilized, orderly, clean and beautiful tourism environment. Article 5 The Municipal People's Government shall incorporate tourism as a key industry into the national economic and social development plan, increase investment in tourism, strengthen the construction of tourism infrastructure, and coordinate with relevant departments to improve the tourism environment and promote the development of tourism and related industries. Article 6 The municipal tourism administrative department is the competent department of tourism in this Municipality, and shall supervise and manage the tourism industry according to law.

Article 9 Strengthen the publicity of tourism laws and regulations, enhance citizens' awareness of tourism and the consciousness of protecting tourism resources, give play to the supervisory role of news media organizations and public opinion on tourism development and tourism service quality, and promote the development of tourism. Chapter II Protection and Development of Tourism Resources Article 1 The tourism resources mentioned in these Regulations refer to natural resources and human resources that can attract tourists, be exploited and utilized for tourism, and generate economic and social benefits. Eleventh people's governments at all levels should take effective measures to protect and rationally develop and utilize tourism resources. No unit or individual is allowed to destroy or develop tourism resources without authorization. Twelfth the development and utilization of tourism resources must be adapted to local conditions, pay attention to characteristics, increase cultural connotation, and conform to the overall urban planning and tourism development planning of Xiamen. Article 17 Tour operators shall enjoy the following rights:

(1) Refusing to set fees, fines and apportionment illegally;

(2) refusing the inspection of persons without legal inspection certificates;

(3) Resist any department from promoting its designated commodities;

(4) to report and accuse units and individuals that infringe upon their legitimate rights and interests;

(5) establishing trade associations according to law;

(6) other rights stipulated by laws and regulations. Article 18 a tour operator shall perform the following obligations:

(1) accept the supervision and management of the relevant administrative departments on its service quality, tourism safety, service charges and other business conditions;

(2) The services provided for tourists must meet the national standards or industry standards;

(3) Respect the right of tourists to choose their own goods and services, and do not force tourists to buy goods or accept services;

(4) according to the regulations of the state and industry on tourism safety, establish a responsibility system for safety management, equip with necessary safety facilities, and ensure the personal and property safety of tourists;

(5) submitting tourism statistics and other materials in accordance with relevant regulations;

(6) Establish on-the-job training system, strengthen the professional ethics and business skills training for employees, and employees must be trained and qualified before taking up their posts;

(7) Other obligations stipulated by laws and regulations and stipulated in the travel contract. Nineteenth to encourage tourism operators to develop new tourism products, improve the quality of tourism, broaden the channels of publicity and promotion, give play to the role of port radiation, and enhance tourism cooperation and exchanges.
