Measures for the administration of border tourism

Article 1 These Measures are formulated for the purpose of further opening up China's tourism industry, promoting economic prosperity and social stability in border areas, enhancing exchanges and friendship with people in neighboring countries, and improving the management level of border tourism.

Article 2 The term "border tourism" as mentioned in these Provisions refers to the tourism activities organized by approved travel agencies to receive citizens from China and neighboring countries to collectively enter and leave designated border ports within the area and time agreed by the two governments.

Article 3 The National Tourism Administration is the competent department of border tourism, responsible for formulating relevant policies and management measures for border tourism, macro-managing border tourism, and approving travel agencies operating border tourism.

Article 4 Tourism bureaus of border provinces and autonomous regions shall be responsible for the management, supervision, guidance and coordination of border tourism business within their respective administrative areas, formulate detailed rules for the implementation of border tourism management in accordance with relevant laws and regulations, and regularly report the development of border tourism to the National Tourism Administration.

Article 5 The tourism bureaus of border cities and counties shall be responsible for coordinating and managing the border tourism activities in their own areas under the guidance of the tourism authorities at higher levels.

Article 6 The necessary conditions for applying for border tourism business are:

(1) Border cities and counties open to foreigners with the approval of the State Council;

(2) There are national first-class and second-class ports officially approved by the state to open to the outside world, and the port joint inspection facilities are basically complete;

(3) Travel agencies approved by the tourism administration department to receive foreign tourists;

(4) Having the conditions for handling the entry and exit documents of tourists nearby;

(5) Having traffic conditions and reception facilities;

(six) signed an intentional agreement with the tourism department of the border area of the other country.

Article 7 The main contents of signing an intention agreement with the tourism department in the border area of the other country:

(a) the specific forms of border tourism organized by the two sides, the service items provided to the other tour group, the scope of activities and the settlement method;

(two) the entry and exit documents used by the participants of both parties;

(3) The travel agencies of the two sides are responsible for educating domestic tourists to abide by the laws and regulations of the other country, and not to carry or take out articles prohibited from import and export by the two countries;

(4) The organizations of both parties shall protect the legitimate rights and interests of tourists and handle personal accident insurance for tourists;

(5) The tourism departments of both sides maintain the order of entry and exit in the border areas, ensure that the tour groups return to China on schedule, and undertake the obligation to repatriate the stranded personnel of the other side.

Article 8 Procedures for applying for border tourism business:

To start border tourism business in border areas, it is necessary to meet the conditions listed in Article 6 of these Provisions, do a good job in feasibility study and formulate an implementation plan. The tourism bureaus of provinces and autonomous regions solicit opinions from foreign affairs, public security, customs and other relevant departments, and after being submitted to the people's governments of provinces and autonomous regions for examination and approval, the people's governments of provinces and autonomous regions shall transfer them to the National Tourism Administration for examination and approval.

Bidding for border tourism business, such as involving countries or regions that carry out border tourism with China, shall be examined and approved by the National Tourism Administration in consultation with the Ministry of Foreign Affairs, the Ministry of Public Security, the General Administration of Customs and other departments; Involving countries or regions that have not yet carried out border tourism with me, the National Tourism Administration shall consult with the Ministry of Foreign Affairs, the Ministry of Public Security and the General Administration of Customs and report to the State Council for approval. After approval, the relevant places may sign formal agreements or contracts with foreign countries.
