Is it illegal to use industrial land for entertainment?

Industrial land is used for production activities.

In 2007, Article 4 of Decree No.39 of the Ministry of Land and Resources clearly listed industrial land as the category of operating land, stipulating that industrial, commercial, tourism, entertainment, commercial housing and other operating land, as well as more than two pieces of land in the same plot, should be sold by tender, auction or listing. The industrial land specified in this clause includes storage land, but does not include mining land. This clause juxtaposes industry, commerce, tourism, entertainment and commercial housing, commonly known as "five types of business land", and together with the "service land" used in daily life, it is called "six types of business land".

The "business land" should be divided into two types: "changing the land use to business" and "developing and constructing the original business land without changing the land use".

"Changing the land use into business land" refers to the situation that the land use of non-business land originally obtained by allocation or transfer is changed into business land, and the latter refers to the activity of developing and building buildings for transfer or lease on the land with approval without changing the original land use. For land use change activities, according to the State Council (2003) No.70 document and Ministry of Land and Resources (2004) No.71document, land acquired by allocation or transfer must be auctioned again by bidding, auction and hanging.
