Measures for the administration of tourism safety
The term "tour operators" as mentioned in these Measures refers to scenic spots, hotels and other units where the travel agencies and local regulations stipulate that the tourism authorities have the responsibility of industry supervision. Article 3 The tourism authorities at all levels shall, under the leadership of the people's government at the same level and under the guidance of the tourism authorities at higher levels and relevant departments, guide, guard against, supervise, train, statistically analyze and handle emergencies within the scope of their duties according to law. Article 4 Tourism operators shall assume the main responsibility of tourism safety, strengthen safety management, establish and improve the safety management system, pay attention to early warning of safety risks, and properly deal with tourism emergencies.
Tourism professionals should strictly abide by the safety management system of its own unit, receive education and training in production safety, and enhance its ability to prevent and deal with tourism emergencies. Fifth tourism authorities, tourism operators and their employees shall fulfill their obligations to report tourism emergencies according to law. Chapter II Operational Safety Article 6 Tourism operators shall abide by the following provisions:
(1) The service place, service items, facilities and equipment meet the requirements of relevant safety laws, regulations and mandatory standards;
(two) equipped with the necessary security personnel, facilities and equipment;
(3) Establishing a safety management system and a responsibility system;
(four) to ensure the safety of capital investment. Seventh tour operators should regularly check the implementation of safety measures in their own units, and eliminate potential safety hazards in time; The possible tourism emergencies and the safety precautions taken shall be reported to the local people's government or the relevant departments of the people's government in a timely manner in accordance with the regulations. Eighth tour operators should carry out risk monitoring and safety assessment of the products and services they provide, fulfill the obligation of safety risk warning according to law, and take measures such as suspending services and adjusting activities when necessary.
Those who engage in high-risk tourism projects or provide tourism services for the elderly, minors and the disabled shall take corresponding safety protection measures as needed. Article 9 Tourism operators shall conduct education and training on safety production for employees, so as to ensure that employees have the necessary knowledge of safety production, rules and regulations, operating procedures, job skills and emergency measures, and know their own rights and obligations in safety production.
Tourism operators shall establish safety production education and training files and truthfully record the time, content, participants and assessment results of safety production education and training.
Tourism professionals who have not received safety education and training are not allowed to work at their posts; Special operations personnel must receive special safety operation training in accordance with the relevant provisions of the state and obtain corresponding qualifications. Tenth tour operators should take the initiative to ask personal health information related to tourism activities, require tourists to use tourism facilities and receive services in accordance with the express safety regulations, and require tourists to cooperate with the safety precautions taken by tour operators. Eleventh travel agencies to organize and receive tourists, should make reasonable arrangements for travel itinerary, and order products and services from qualified suppliers.
Travel agencies and their employees shall stop or replace the services provided by performance assistants if they find that they do not meet the requirements of laws and regulations or have potential safety hazards. Twelfth travel agencies to organize outbound tourism, should make a safety information card.
The safety information card shall include the tourist's name, exit certificate number and nationality, as well as the contact person and contact information in case of emergency, and shall be filled in Chinese and the official language (or English) of the destination.
The travel agency shall give the safety information card to the tourists to carry with them, and inform them to fill in the information such as blood type, allergic drugs and major diseases themselves. Thirteenth tourism operators should formulate emergency plans for tourism emergencies according to law, and link them with the emergency plans of local people's governments at or above the county level and their relevant departments, and organize regular drills. Fourteenth tourism emergencies, tourism operators and their field personnel should take reasonable and necessary measures to rescue injured tourists, control the development of the situation, and prevent the damage from expanding.
Tourism operators shall, in accordance with the requirements of the people's governments that perform unified leadership duties or organize the handling of emergencies, cooperate with the emergency measures taken by them and participate in the emergency rescue and rehabilitation work organized by the local people's governments.
Travel agencies and their tour leaders should make every effort to deal with unexpected events under the guidance of local Chinese embassies and consulates or government agencies. Fifteenth tourism emergencies, tourism operators on-site personnel should immediately report to the person in charge of the unit. After receiving the report, the person in charge of the unit shall report to the county-level tourism authorities, production safety supervision and management departments and other relevant departments responsible for production safety supervision and management within 1 hour. The person in charge of the travel agency shall also report to the local tourism authorities at or above the county level where the unit is located.
In case of emergency or major, especially major tourism emergencies, the relevant personnel at the scene can directly report to the tourism authorities at or above the county level, the supervision and administration of production safety and other relevant departments responsible for the supervision and administration of production safety where the travel agency is located.
In case of unexpected travel events abroad, the tour team leader should immediately report to the local police, the local embassy or consulate of China or the heads of government agencies and travel agencies. The person in charge of the travel agency shall report to the local tourism authorities at or above the county level where the unit is located 1 hour after receiving the report from the tour leader.
