Measures for the Administration of National Economic and Technological Development Zone in Lhasa, Tibet
The development zone should be built into a resource-saving and environment-friendly characteristic economic park with perfect facilities, advanced technology, excellent environment, harmonious labor relations and comprehensive service functions, and give full play to its window, demonstration, radiation and driving role. Article 4 The autonomous region shall support the development zones to try first in land, finance, taxation, finance, investment, foreign trade, scientific and technological innovation and management system. Article 5 Enterprises, institutions, other economic organizations and individuals in the Development Zone shall abide by laws, regulations and rules, and their investments, profits and other legitimate rights and interests in the Development Zone shall be protected according to law, and no unit or individual may infringe upon them. Chapter II Management Institutions and Responsibilities Article 6 The leading group of the development zone established by the people's government of the autonomous region leads and coordinates major issues in the development zone. The leading group for development zone work has an office to give specific guidance and coordination to the development zone business. Article 7 The Development Zone Management Committee (hereinafter referred to as the Development Zone Management Committee) is an agency of the Lhasa Municipal People's Government, and implements unified leadership and management of the Development Zone on behalf of the Lhasa Municipal People's Government.
According to the authorization of the People's Government of the Autonomous Region and the People's Government of Lhasa, the Administrative Committee of the Development Zone shall exercise comprehensive economic management and administrative management functions according to law. Article 8 The main duties of the Development Zone Management Committee are:
(a) the implementation of national laws, regulations and industrial policies;
(two) the preparation of the development zone development plan and economic and social development plan, and organize the implementation after the approval of the people's Government of the autonomous region;
(three) to be responsible for the investment promotion of the Development Zone and the examination and approval of investment projects of enterprises in the Development Zone;
(four) unified management and development of land in the development zone;
(five) unified planning, construction and management of infrastructure and public facilities in the development zone;
(6) Coordinating the import and export trade and other foreign-related economic activities in the Development Zone;
(seven) to guide, coordinate and supervise the work of the branches and agencies of the relevant administrative organs in the development zone;
(eight) to coordinate and promote the development of education, culture, health, sports, social security and other social welfare undertakings in the Development Zone;
(nine) to mediate labor disputes and safeguard the legitimate rights and interests of employers and workers according to law;
(ten) to guide enterprises in the development zone to actively absorb employment, give priority to providing public employment services for land-expropriated farmers in the development zone, and actively promote the employment, training and social security of land-expropriated farmers;
(eleven) responsible for the legal work of the development zone, coordinate the relevant departments to carry out law enforcement activities, investigate and deal with illegal acts;
(twelve) to exercise other duties entrusted by the people's Government of the autonomous region and the Lhasa Municipal People's Government. Article 9 The Administrative Committee of the Development Zone shall, in accordance with the principle of streamlining and separating government from enterprise, set up necessary functional institutions to manage the relevant administrative affairs of the Development Zone according to law. Article 10 In accordance with the principle of separating government from enterprise, an investment company shall be established in the development zone to be responsible for the development and business activities of the development zone. Eleventh relevant units and departments to set up branches or agencies in the development zone, should be approved by the administrative committee of the development zone, reported to the relevant superior departments for approval. The established branches or agencies shall perform their functions according to law and consciously accept the guidance and supervision of the Development Zone Management Committee.
Encourage banks, insurance and other financial institutions to set up business windows in the development zone to handle related businesses.
The Administrative Committee of the Development Zone shall provide convenient conditions and efficient and high-quality services for the established branches, agencies or business windows to carry out their work. Twelfth relevant departments of the people's Government of the autonomous region and the relevant departments of the Lhasa Municipal People's Government shall support and cooperate with the work of the Development Zone Management Committee, and strengthen the professional guidance to the functional institutions of the Development Zone Management Committee. Chapter III Investment and Management Article 13 Development zones may be built in the form of "one zone with multiple parks", with open operation and closed management. Fourteenth to encourage the establishment of the following projects in the development zone:
(a) Tibetan medicine, ethnic handicrafts, deep processing of agricultural and livestock products and other special advantages projects;
(2) Production and processing industries of import and export products;
(3) Research, development and utilization of new energy sources such as solar energy and wind energy;
(four) high-tech development projects and environmental protection industry projects;
(5) Infrastructure projects such as transportation, communication and energy;
(six) commerce, logistics, finance, information, tourism, culture and other tertiary industries;
(seven) to undertake the transfer of coastal high-tech industries and R&D centers. Fifteenth prohibit the establishment of the following projects in the development zone:
(a) the use of backward production technology and equipment prohibited and eliminated by the state for production projects;
(2) Projects with high energy consumption, high pollution and high resource consumption;
(three) the pollutant discharge does not meet the relevant national environmental protection standards or the total amount control index of major pollutants in the autonomous region;
(four) other projects prohibited by the state and the autonomous region.
