The penalty for overcrowding in Beijing is as follows:

1. Those who drive school buses, road buses and tourist buses to carry more than 2% of the approved passengers, or drive other passenger cars to carry more than 1% of the approved passengers, will be deducted 12 points;

2. If driving a passenger car with more than seven seats carries more than 5% people but not 1%, nine points will be deducted;

3. If driving a school bus, a road bus or a tourist bus carries more people than 2%, or driving more than seven passenger cars carries more people than 2% but not 5%, or driving other passenger cars carries more than 5% but not 1%, six points will be deducted;

4. If driving a bus, a road bus, a tourist bus or a passenger car with more than seven seats carries more than 2% but less than 5% passengers, three points will be deducted.

Legal basis: Article 92 of the Law of the People's Republic of China on Road Safety Management

If a passenger vehicle on a highway carries more passengers than the rated occupant, it shall be fined between 2 yuan and 5 yuan; Those who exceed 2% of the rated passengers or carry goods in violation of regulations shall be fined between 5 yuan and 2, yuan.

if the freight motor vehicle exceeds the approved load quality, it shall be fined between 2 yuan and 5 yuan; Those who carry passengers in excess of 3% of the approved weight or in violation of regulations shall be fined between 5 yuan and 2, yuan.

in case of any of the acts mentioned in the preceding two paragraphs, the traffic administrative department of the public security organ shall detain the motor vehicle until the illegal state is eliminated.

if the vehicle of a transport unit is in any of the situations specified in the first and second paragraphs of this article, and it is not changed after punishment, the directly responsible person in charge shall be fined from 2, yuan to 5, yuan.
