It is understood that the Minsheng Bank credit card used by Mr. Guo was lost during his trip to Thailand, so he immediately reported it to Minsheng Bank The domestic handling department of the bank called to report the loss. Minsheng Bank responded that no fraud had occurred and went through the loss reporting and payment stop procedures. But after returning to China, Mr. Guo discovered that after reporting the loss, there were five purchases totaling US$6,579.08.

Later, when Mr. Guo applied for a credit card from another bank, he was told that there were bad records on the credit system because of five disputed fraudulent purchases that were overdue and unrepaid. Mr. Guo took this to the court and requested an order to order China Minsheng Bank to revoke his bad records and apologize.

However, Minsheng Bank stated that Mr. Guo’s credit card was stolen because he failed to fulfill his custody obligations, so the loss should be borne by the individual.

In addition, according to the electronic credit card statement, five fraudulent purchases occurred on February 17 last year, and Mr. Guo called on February 18 to request to report the loss. At that time, he received a reply that no fraudulent purchases had occurred. . In this regard, Minsheng Bank explained that since the card issuer’s actual deduction time was February 19, “the actual consumption time is different from the bank’s accounting time, so Mr. Guo did not show it when he called on February 18.”

Coincidentally, in July, Mr. Sun’s Minsheng credit card in Beijing was inexplicably used by someone thousands of miles away on July 10. A sweater factory in Tongxiang City wiped out 40,000 yuan. Subsequently, Mr. Sun contacted the customer service staff of Minsheng Bank. The customer service said that Mr. Sun needed to print the credit card slip and report it to the public security agency. After reporting the crime, he took the report receipt to the Anzhen Marketing Department of Minsheng Credit Card to fill in the "non-personal transaction statement".

A few days later, Mr. Sun received a customer service call from Minsheng Bank. The customer said: "A case filing certificate must be issued by the public security agency before the fraud can be processed. Otherwise, you will be responsible for it personally!"

Mr. Sun went to the Economic Crime Detachment of Xicheng District Public Security Bureau in Beijing (the receiving party). Police officer Liu kept saying: China’s judicial system does not have such materials as proof of case filing, and the public security organs have no obligation to provide proof of case filing. In fraud cases, the victim can resolve the fraud case with the bank by presenting the "report receipt".

Mr. Sun approached Minsheng Bank again. The bank insisted that without proof of filing, Mr. Sun must repay the 40,000 stolen money by himself, otherwise he will bear the consequences. Subsequently, Mr. Sun received a text message notification of default from Minsheng Bank, and Minsheng Bank reported Mr. Sun’s situation to the central bank in the form of default account information.
