How to compensate for the injury in the scenic spot?

Legal analysis: tourist attractions have the responsibility to ensure the personal safety of tourists. If the scenic spot fails to fulfill its corresponding obligations and causes injuries to tourists, the scenic spot should bear corresponding responsibilities.

According to the Supreme People's Court's Interpretation on Several Issues Concerning the Application of Laws in the Trial of Personal Injury Compensation Cases, if a natural person, legal person or other organization engaged in business activities such as accommodation, catering, entertainment or other social activities fails to fulfill its security obligations within a reasonable range and causes personal injury to others, the people's court shall support it.

Managers of hotels, shopping malls, banks, stations, entertainment places and other public places or organizers of mass activities fail to fulfill their security obligations, causing damage to others, and shall bear tort liability.

If the behavior of a third party causes damage to others, the third party shall bear the tort liability; If the manager or organizer fails to fulfill the obligation of safety guarantee, it shall bear corresponding supplementary responsibilities.

According to the laws of our country, tourist attractions should bear civil liability for compensation, and the specific compensation items include: medical expenses, lost time, nursing expenses, hospital food subsidies, nutrition expenses, follow-up treatment expenses, medical expenses, disability compensation and mental loss compensation. As for the specific amount of compensation, it should be calculated according to the specific case and disability level.

Legal basis: Article 1 175 of the Civil Code of People's Republic of China (PRC) shall bear tort liability if a third party causes damage.
