Provisions of the State on Civil Servants Going Abroad (Territory)

According to the "Notice on Strengthening the Interim Provisions on the Administration of State Staff Going Abroad for Private Purposes":

Article 2 State functionaries who go abroad (abroad) for personal reasons shall go through the examination and approval procedures in accordance with the authority of personnel management.

Article 3 The term "state functionaries" as mentioned in these Provisions refers to state civil servants and state functionaries managed by reference to civil servants.

Personnel engaged in official duties in state-owned companies and enterprises, and personnel assigned by state organs, state-owned companies, enterprises and institutions to non-state-owned enterprises and social organizations are regarded as state employees.

Article 3 The term "state functionaries" as mentioned in these Provisions refers to state civil servants and state functionaries managed by reference to civil servants.

Article 4 The following state functionaries (hereinafter referred to as "registered personnel") who apply for going abroad (territory) for personal reasons shall submit their opinions on the applicant's going abroad (territory) to the exit-entry administration department of the public security organ where their household registration is located.

(a) leading cadres at or above the county (department) level of party and government organs at all levels, people's congresses, CPPCC, people's courts, people's procuratorates, people's organizations and institutions, and retired cadres at or above the department (bureau) level;

(2) Legal representatives of financial institutions and state-owned enterprises, leading members of financial institutions at or above the county level and leading cadres at corresponding ranks, middle-level and above managers of large and medium-sized state-owned enterprises, and representatives of state-owned shares of state-owned holding and shareholding enterprises;

(three) personnel involved in national security, state-owned assets security and business secrets in various departments and industries.

Article 5 The basic information of registered personnel shall be registered with the public security organ by the unit to which they belong. The contents of registration and filing include: name, gender, date of birth, ID number, residence, work unit, current position, competent department, etc. Where the work unit, current position and competent department of the registration and filing personnel change, the relevant units shall change the corresponding registration and filing contents in time.

Article 6 The public security organs shall be responsible for the professional guidance and data management of the registration and filing of state functionaries in their own areas.

Article 7 The exit-entry administration department of the public security organ shall verify the registration of the relevant units and decide whether to issue exit-entry certificates when accepting applications from citizens for going abroad (territory) for personal reasons. The entry-exit administration department of the public security organ shall not accept or handle the case of a registered state functionary who fails to submit the opinions of the work unit on the applicant's going abroad (border) for personal reasons.

Eighth organizations at all levels, personnel departments and public security organs should establish an effective contact mechanism, formulate a responsibility system and a confidentiality system, and designate a person to be responsible for the management of going abroad for personal reasons.

Article 9 Organizations and personnel departments at all levels should strictly implement the relevant provisions on the administration of national staff applying for entry and exit certificates, implement a registration system for reports of going abroad (abroad) for personal reasons, and require personnel going abroad (abroad) to abide by foreign affairs discipline, and may not stay beyond the time limit without approval. The entry and exit certificates that the applicants have applied for shall be kept by the personnel department of the unit where they work.

Article 10 If the personnel departments at all levels fail to go through the formalities of examination and approval or registration, and the public security organs go through the formalities of entry and exit certificates in violation of regulations, thus causing losses to the interests of the state, the directly responsible person and the competent leader shall be investigated for responsibility according to the circumstances, and shall be given administrative sanctions or punished according to law in accordance with relevant regulations.

Eleventh regions and departments can formulate specific implementation measures according to the actual situation, and report to the Central Organization Department, the Central Financial Working Committee, the Central Enterprise Working Committee, the Ministry of Public Security and the Ministry of Personnel for the record.
