Experts attending the meeting said that the provisions of the Tourism Law on the salary system of tour guides cannot completely eliminate the phenomenon of compulsory shopping.

Wang Huijing, an associate professor at beijing international studies university College of Law and Politics, said at the meeting that Article 38 of the Tourism Law of the People's Republic of China stipulates that travel agencies shall conclude labor contracts with tour guides according to law, pay labor remuneration and pay social insurance premiums; If a travel agency temporarily hires a tour guide to provide services for tourists, it shall pay the tour guide service fee in full.

Wang Huijing said, in fact, except for a few large travel agencies, most tour guides are hired temporarily, and some tour guides even serve as tour guides for several small travel agencies. Tourism is divided into off-season and peak season. Many travel agencies have little business in the off-season, so they can't sign fixed labor contracts with tour guides, pay basic salary and insure tour guides.

In order to make a living, tour guides will definitely find ways to make money, and attracting tourists to shop is bound to be a very important means. Wang Huijing said that Article 35 of the Tourism Law also stipulates that tourists and travel agencies can arrange shopping through consultation or at the request of tourists, without affecting the itinerary of other tourists.

This leaves a loophole for tour guides to try their best to attract tourists to shop. Tour guides will try their best to tackle key problems and let tourists "voluntarily" shop, which is actually a disguised form of coercion. Wang Huijing said that the tour guide salary system is an important part of the Tourism Law, and it needs to be constantly improved in the future revision of the Tourism Law.
