Tourism Regulations of Gannan Tibetan Autonomous Prefecture in Gansu Province (revised on 20 18)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and tourism professionals, standardize the order of the tourism market and promote the sustained and healthy development of the tourism industry, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China, the Environmental Protection Law of People's Republic of China (PRC), the Tourism Regulations of Gansu Province and other laws and regulations, combined with the actual situation of the autonomous prefecture. Article 2 These Regulations shall apply to the protection and development of tourism activities and tourism resources, planning, industrial promotion, public services, business services and related supervision and management within their respective administrative areas. Article 3 The development of tourism in Autonomous Prefecture shall adhere to the principles of government guidance, market operation, social participation and industry self-discipline, strengthen planning guidance, overall planning of resources, construction of public services and supporting facilities, give play to the decisive role of the market in resource allocation, and form a tourism market environment with honest management and fair competition. Article 4 The people's governments of autonomous prefectures and counties (cities) rely on the advantages of resources to vigorously develop folk customs, plateau ecology, red tourism and religious culture, implement the global tourism development model, and create tourist destinations with regional and ethnic characteristics. Article 5 The people's governments of autonomous prefectures and counties (cities) shall incorporate the development of tourism into the national economic and social development plan, establish a comprehensive coordination mechanism for tourism work, coordinate tourism services, industrial development, market supervision and image enhancement within their respective administrative areas, and promote the coordinated development of tourism and related industries. Article 6 The people's governments of autonomous prefectures and counties (cities) shall, according to the tourism development plan, set up special funds for tourism development, which shall be included in the annual financial budget and increased year by year according to the development needs.

The special funds for tourism development are mainly used for tourism planning, scenic spot construction, tourism promotion, tourism commodity research and development, tourism service facilities construction, rural tourism construction, smart tourism construction and tourism education and training. Article 7 The people's governments of autonomous prefectures and counties (cities) shall establish and improve the emergency rescue system for tourism safety, formulate plans for preventing and handling major tourism safety accidents, and organize their implementation. Eighth autonomous prefectures and counties (cities) people's governments shall establish a comprehensive supervision of the tourism market and a unified acceptance mechanism for tourism complaints. Clarify the responsibilities and working systems of all member departments, and supervise and inspect the tourism market and service quality within their respective administrative areas according to law.

The people's governments of autonomous prefectures and counties (cities) shall improve the advance payment mechanism of tourism consumption infringement, and strengthen the supervision of the advance payment fund according to the actual development of tourism. Chapter II Planning and Promotion Article 11 The tourism administrative departments of the people's governments of autonomous prefectures and counties (cities) shall organize the formulation of tourism development plans and make overall arrangements for the protection of tourism resources, the construction of tourism infrastructure and public service system, the development of tourism market and the development of tourism within their respective administrative areas.

The tourism administrative department of the Autonomous Prefecture People's Government shall be responsible for organizing the preparation of cross-county (city) tourism scenic spot development planning and guiding the county (city) to prepare the overall tourism development planning. The tourism administrative department of the county (city) people's government may, according to the overall planning of tourism development, formulate special plans and new business plans for various tourism industries.

All kinds of tourism planning should carry out environmental impact assessment in accordance with the requirements of People's Republic of China (PRC) Environmental Protection Law. After the completion of the preparation, the people's government at the same level shall apply to the tourism administrative department at the next higher level for organizing the review, and after passing the review, it shall be approved and implemented by the people's government at the same level and reported to the tourism administrative department at the next higher level for the record. The approved tourism development plan shall not be changed without authorization, and if it is really necessary to change it, it shall be reported to the original approval authority for approval. Twelfth tourism development planning should conform to the national economic and social development planning, with the principle of sustainable development.

Tourism development planning should highlight regional and cultural characteristics, and connect with the overall land use planning, urban and rural planning, environmental protection planning and planning of scenic spots, nature reserves, water conservancy scenic spots, cultural relics protection units, forest parks, geological parks and so on. Thirteenth Autonomous Prefecture, county (city) people's government and its relevant departments in the preparation of the overall land use planning and urban and rural planning, should co-ordinate the construction land and spatial layout requirements of related tourism projects and facilities within their respective administrative areas.

In the planning and construction of transportation, communications, water supply, power supply, environmental protection and other infrastructure and public service facilities, we should take into account the needs of tourism development. Article 14 Tourism planning shall follow the following principles:

(a) in line with national laws and regulations on the development and protection of tourism resources, and handle the relationship between protection and utilization, long-term and short-term, whole and part;

(two) to maintain the original features of natural landscape and human landscape, highlight the local ethnic and regional characteristics, and maintain the natural ecological balance;

(three) the development scale, development degree, construction standards and quota indicators of tourist attractions (spots) should be appropriately higher than the local economic development level, and leave room for long-term development;

(four) the construction projects of tourist attractions (spots) should be fully demonstrated, scientifically evaluated the characteristics of scenic spots and the value of resources, highlight the characteristics of scenic spots, and avoid blind and repeated construction.
