According to administrative regulations, the Credit Management Department of the Ministry of Culture and Tourism is responsible for guiding, coordinating, supervising and managing the credit management of the national cultural and tourism markets. The competent departments of culture and tourism of local people's governments at or above the county level are responsible for the credit management of the cultural and tourism markets within their respective administrative areas, and various units and individuals such as industry associations, third-party credit service institutions, financial institutions and news media are encouraged to participate in credit management according to law. The management regulations shall come into force on June 65438+ 10/day, 2022.

In terms of cultural market, the Management Regulations point out that the applicable subjects and employees are related to business activities such as commercial performances, entertainment places, artworks, Internet access services, network culture, and social and artistic level examinations. The above-mentioned market participants and employees have five situations, including obtaining licenses and approval documents by cheating, deliberately concealing, forging or altering materials or forging or altering licenses and approval documents; Providing contents prohibited by laws, administrative regulations and rules, causing serious consequences; Being punished by the administrative department of culture and tourism for revoking the license; Engaging in cultural market business activities such as commercial performances, entertainment places and Internet access services without authorization, especially causing major accidents or adverse social impacts; Other circumstances that should be identified as the subject of serious dishonesty.

At the same time, serious untrustworthy subjects in different sub-sectors of the cultural market will also face their own management measures. Because of engaging in entertainment business activities without authorization, it is recognized as a subject of serious dishonesty, and its investors and responsible persons shall not invest in opening entertainment places or serve as legal representatives or responsible persons of entertainment places for life; If the commercial performance license is revoked due to the prohibited content in the commercial performance and is recognized as the subject of serious dishonesty, it shall not engage in the intermediary, agency or disciplinary activities of commercial performances again.

Not only the cultural market, but also the tourism market, and the management regulations also give specific credit management measures. The "Management Regulations" pointed out that the legitimate rights and interests of tourists were seriously damaged due to intentional or gross negligence, but it did not meet the situation of serious dishonesty; There are security risks in tourism business activities, and if they are not rectified within the prescribed time limit, they are identified as minor untrustworthy subjects. However, if it is recognized as a minor untrustworthy subject for the third time within 12 months, it should be recognized as a serious untrustworthy subject.

As far as the specific management measures are concerned, the main person in charge of a travel agency that has been identified as the subject of serious dishonesty due to the revocation of its business license shall not be the main person in charge of any travel agency for five years. Tour guides, tour leaders and related management personnel who have been identified as serious untrustworthy subjects due to the revocation of the tour guide card or travel agency business license shall not re-apply for the tour guide card or engage in travel agency business within 3 years from the date of being punished. In addition, if a travel agency is fined for violating the legitimate rights and interests of tourists and is recognized as a subject of serious dishonesty, it shall not apply for outbound tourism business within 2 years from the date of punishment.

From the perspective of industry management, we should not only supervise some' obedient' enterprises in the industry, but also supervise' edge-scratching' enterprises. After the introduction of this management regulation, media travel agencies, non-star accommodation companies, and homestay companies that have not participated in the homestay assessment will all be included in the scope of supervision to ensure the fairness of the market.
