Regulations on Population and Family Planning in Inner Mongolia Autonomous Region (revised in 2022)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional Ethnic Autonomy and the Law of the People's Republic of China on Population and Family Planning and in light of the actual situation of the autonomous region. Article 2 Citizens with household registration or living in the administrative area of this autonomous region, as well as organs, social organizations, enterprises and institutions within the administrative area of this autonomous region, shall abide by these regulations. Article 3 Family planning is the basic national policy of the country.

The autonomous region adopts comprehensive measures to regulate the population, improve the quality of the population, promote the realization of moderate fertility level, optimize the population structure and promote the long-term balanced development of the population. Article 4 Population and family planning work should be combined with increasing women's opportunities for education and employment, improving women's health level and improving women's status. Article 5 People's governments at all levels shall lead the population and family planning work within their respective administrative areas.

The competent health departments of the people's governments at or above the county level shall be responsible for family planning work and population work related to family planning within their respective administrative areas.

The departments of development and reform, finance, human resources and social security, public security, medical security, civil affairs and education of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the work related to population and family planning. Article 6 People's governments at all levels, their health departments and relevant units shall commend and reward organizations and individuals that have made remarkable achievements in population and family planning work. Chapter II Formulation and Implementation of the Population Development Plan Article 7 The people's government of the autonomous region shall formulate the population development plan of the autonomous region according to the national population development plan and incorporate it into the national economic and social development plan.

The administrative offices of various leagues, the municipal people's governments divided into districts and the people's governments at the county level shall, according to the population development plan of the people's government at the next higher level and in combination with the local actual situation, formulate the population development plan of their respective administrative regions and incorporate it into the national economic and social development plan. Eighth people's governments at or above the county level shall, according to the population development plan, formulate the implementation plan of population and family planning and organize its implementation.

Sumu Township People's Government and sub-district offices are responsible for the population and family planning work within their respective jurisdictions, and implement the implementation plan of population and family planning. Article 9 Gacha villagers' committees and residents' committees shall incorporate population and family planning work into the grass-roots management and service system, and do a good job in family planning work according to law. Tenth health, education, science and technology, culture and tourism, civil affairs, radio and television departments should organize publicity and education on population and family planning.

The mass media have the obligation to publicize the population and family planning for public welfare.

Schools should carry out physical health education, adolescent education or sexual health education among students in a planned way according to the characteristics of the educated. Eleventh people's governments at all levels shall implement the target management responsibility system of population and family planning with the main leaders taking overall responsibility.

Family planning work of organs, social organizations and institutions shall be under the overall responsibility of the main leaders.

Enterprises implement the responsibility system for population and family planning work with the legal representative as the overall responsibility. Twelfth Sumu Township People's governments and neighborhood offices shall be equipped with population and family planning staff.

Gacha villagers' committees and residents' committees shall have a deputy director in charge of population and family planning work.

Organs, social organizations, enterprises and institutions shall, according to the needs of their work, set up family planning management institutions or equip them with full-time and part-time population and family planning staff. Thirteenth Gacha villagers' committees, residents' committees, population and family planning staff should receive certain subsidies. The subsidy standards for the deputy directors of Gacha villagers' committees and residents' committees in charge of population and family planning work shall be implemented with reference to the standards of the directors of Gacha villagers' committees and residents' committees.

In Gacha villagers' committees and residents' committees engaged in population and family planning work for more than ten years, the local people's governments shall give living allowances, and the specific measures shall be formulated by the people's governments at the county level.

The staff of family planning service institutions at the county level shall be paid wages and social security benefits. The population and family planning staff of Township People's governments and sub-district offices in Sumu shall implement social security benefits and issue labor protection articles on a regular basis. Fourteenth people's governments at all levels should include population and family planning funds in the fiscal budget.

Sumu Township People's government and sub-district offices' funds for population and family planning work, social security benefits and labor protection articles, and the remuneration of Gacha villagers' committees and residents' committees' population and family planning staff shall be guaranteed by county-level finance.

People's governments at all levels should give key support to population and family planning work in underdeveloped areas.

Encourage social organizations, enterprises, institutions and individuals to contribute to population and family planning work. Fifteenth development and reform, health, public security, human resources and social security, civil affairs, education, statistics, medical security and other departments should provide each other with relevant population data and share information resources. Chapter III Maternity Provisions Article 16 Citizens have the right to have children, and at the same time they shall fulfill their family planning obligations according to law. Both husband and wife have the same responsibility in carrying out family planning.
