Chengdu Interim Provisions on the Management of Urban Outdoor Advertising and Signboards

Chapter 1 General Provisions Article 1 is to regulate the planning and management of outdoor advertising and signboards. According to the "Advertising Law of the People's Republic of China" and the "Urban Planning Law of the People's Republic of China" " and the State Council's "Urban City Appearance and Environmental Sanitation Management Regulations" and other laws and regulations, and combined with the actual situation of Chengdu City, these regulations are formulated. Article 2 These regulations apply to the management of outdoor advertising and signboards and related activities in areas within the city's outer ring road (including 500 meters outside the outer ring road) and on the airport expressway. Article 3 The term "outdoor advertising" as mentioned in these regulations refers to the use of text, images, physical shapes, Expressions such as gas fillings, and the act of setting up, posting, and hanging outdoor advertisements. The term "signboard setting" as mentioned in these regulations refers to the act of setting up signs, signs, light boxes, neon lights, and font symbols to express names on the buildings (structures) or facilities at the business (office) site. Article 4 The installation of outdoor advertisements and signboards shall comply with urban planning, meet the requirements of beautifying the city, and shall not affect the urban landscape. Article 5 The municipal administrative department for city appearance and environment is responsible for the supervision and management of outdoor advertising and signboards in this municipality. Relevant departments such as planning, industry and commerce, construction, transportation, tourism, gardens, municipal public utilities, and urban management and administrative law enforcement shall coordinate the implementation of these regulations in accordance with their respective responsibilities. Chapter 2 Planning for Outdoor Advertising Settings Article 6 The municipal planning administrative department shall prepare a planning for outdoor advertising setting in conjunction with the city’s city appearance, industry and commerce, transportation and other relevant departments, and organize its implementation after approval by the Municipal People’s Government. The outdoor advertising installation plan should be divided into installation areas and prohibited installation areas. No outdoor advertising of any kind is allowed in prohibited areas. Article 7 Outdoor advertisements shall not be installed under any of the following circumstances in the outdoor advertising installation area:

(1) Construction control zones of state agencies, military agencies, cultural relics protection units, and scenic spots;< /p>

(2) Using traffic safety facilities and traffic signs;

(3) Affecting the use of municipal public facilities, traffic safety facilities and traffic signs;

< p> (4) Impeding production or people’s lives;

(5) May endangering the safety of buildings (structures);

(6) Using street trees or damaging green spaces;

(7) Damaging the appearance of the city. Article 8 The installation of outdoor advertisements shall comply with the following provisions:

(1) The design, production and installation of outdoor advertising facilities shall comply with corresponding technical and quality standards;

(2) ) does not affect the ventilation and lighting of adjacent units or residents;

(3) For protruding outdoor billboards, the protruding distance shall not exceed 3 meters and shall not exceed the road red line, and the clearance between the bottom edge and the ground The height shall not be less than 3 meters, and the height shall not exceed the roof of the building;

(4) Set up roof advertisements, the height shall not exceed 6 meters, and the width shall not exceed the walls on both sides of the building;

(5) ) Set up pillar-type advertising towers. The distance on one side of the airport expressway should not be less than 800 meters, and the distance on one side of other roads entering and leaving the city should not be less than 1,000 meters. Except for airport expressways, column advertising towers are not allowed to be installed within the third ring road (excluding the third ring road);

(6) Night scene light sources are configured in accordance with regulations, but their lighting facilities must not be combined with road traffic signs, The signals are similar. Chapter 3 Management of the Setup of Outdoor Advertising Facilities Article 9 To set up outdoor advertising, the right to occupy outdoor advertising space resources shall be obtained. Outdoor advertising space resources are subject to government franchise. In principle, the right to occupy outdoor advertising space resources is obtained through auction. The specific measures will be separately formulated by the municipal administrative department for city appearance and environment, and will be implemented after approval by the Municipal People's Government. Article 10 Those who set up rooftop advertising facilities or construct structures for the purpose of publishing advertisements shall obtain the "Construction Project Planning Permit" for outdoor advertising facilities issued by the municipal planning administrative department. Applicants applying for a "Construction Project Planning License" should submit the following documents to the municipal planning administrative department:

(1) Application form for setting up outdoor advertising facilities;

(2) Outdoor Proof of right to occupy advertising space resources;

(3) Construction drawings of outdoor advertising facilities;

(4) Rendering of street-facing facades of outdoor advertising facilities;

( 5) Other documents required by the planning administrative department. Article 11 The municipal planning administrative department shall review the applicant's application within 10 working days from the date of receipt of the application. For those that meet the conditions for setting up, a "Construction Project Planning Permit" for outdoor advertising facilities will be issued and a copy will be sent to the municipal administrative department for city appearance and environment for filing; for those who do not meet the conditions, the reasons shall be stated in writing. Applicants applying for a "Construction Project Planning Permit" must pay a construction application fee in accordance with regulations. Article 12 Outdoor advertising facilities shall be set up according to the approved location, form, and specifications, and shall not be changed without authorization; if changes are really necessary, the change procedures shall be completed according to the application installation procedures within 30 days after approval. Article 13 After the construction of outdoor advertising facilities is completed, acceptance inspection must be carried out, and the acceptance data must be submitted to the municipal planning administrative department for record within 15 days after passing the inspection.

Article 14 After the outdoor advertising facilities are completed, the installer may use them himself or transfer the use rights in accordance with the law through leasing, paid assignment, etc., except where the transfer is prohibited by laws and regulations; if the transfer is in accordance with the law, the transferee shall It must be filed with the municipal planning administrative department within 30 days. Outdoor advertising facilities that have passed the acceptance inspection shall not be idle for more than 5 days, and the idle period shall be covered with public service advertisements. To set up outdoor advertising on outdoor advertising facilities, you must obtain an "Outdoor Advertising Setup Registration Certificate" in accordance with the requirements of Chapter 4 of these regulations.
