Chapter 1 General Provisions Article 1 These detailed rules are formulated in accordance with the "Henan Province Tourism Management Regulations" (hereinafter referred to as the "Regulations"). Article 2: All units and individuals that conduct tourism activities, engage in tourism operation and management within the administrative region of this province shall abide by the Regulations and these Detailed Rules. Article 3: Engaging in tourism operations refers to the business activities of operators soliciting and receiving tourists in the name of tourism, and providing paid services to tourists. Article 4: The tourism industry shall implement the principles of unified leadership and hierarchical management in accordance with national regulations. People's governments at or above the county level should, in accordance with the Regulations, clarify the departments in charge of tourism and strengthen administrative law enforcement in the tourism industry.
The tourism quality supervision agencies established by the tourism administrative departments at all levels shall exercise their powers in accordance with the authorization of laws and regulations and the entrustment of the tourism administrative departments. Chapter 2 Tourism Resource Development and Management Article 5 The tourism development plan shall, on the basis of the tourism development plan, make specific arrangements for tourism resource development projects and facility construction projects, and make specific arrangements for tourist attractions (including tourist resorts, tourist areas, etc.) Various forms) planning, tourism route planning and tourism project planning are prepared according to different requirements. Article 6 The preparation of tourism development plans shall adhere to the principle of sustainable development and focus on the social, economic and environmental benefits of tourism development. Tourism development planning should include the following basic contents:

(4) Tourism resource development arrangements and facility construction;

(6) Economic benefits of tourism development and measures to implement planning, etc. Article 7: Tourism development planning shall implement a hierarchical examination and approval system. Provincial tourism administrative departments are responsible for coordinating and approving key and cross-regional tourism development plans in the province; municipal, county (city) tourism administrative departments should be responsible for coordinating and approving tourism development plans in their respective regions according to the division of responsibilities.
The tourism development plan shall be organized and demonstrated by the tourism administrative departments at all levels, and opinions from relevant departments and units shall be solicited. Article 8 Units undertaking the task of formulating tourism development plans shall comply with relevant national regulations on the qualifications of tourism planning and design units and the registration and management of tourism planning units. The provincial tourism administrative department shall, in conjunction with the provincial construction administrative department, certify the qualifications of units and individuals engaged in the preparation of tourism plans in the province, and publish them to the public on a regular basis. Units and individuals that have not obtained certification qualifications are not allowed to engage in tourism planning preparation work. Chapter 3 Approval of Tourism Operators Article 9 Tourist attractions (spots) shall implement a tourism operation license system in accordance with the law. The applicant unit shall submit a written application to the local tourism administrative department, and submit it to the provincial tourism administrative department for approval step by step, and then issue a tourism business license and signboard uniformly produced by the provincial tourism administrative department. Article 10 Tourism business signs must be hung at eye-catching places at the entrances of tourist attractions (spots).
Various tourist attractions (spots) that have not obtained a tourism business license and signboard are not allowed to engage in tourism business. Article 11 The provincial tourism administrative department shall, together with the relevant administrative departments, rate the tourist attractions (spots) based on their resources, service facilities, management level, etc., and make an announcement to the public.
The rating standards and implementation methods for tourist attractions (spots) shall be formulated separately by the provincial tourism administrative department in conjunction with relevant administrative departments. Article 12 Ticket prices for tourist attractions (spots) shall be determined by the price administrative department according to their affiliation, and the opinions of the tourism administrative department shall be sought when setting prices.
The management agencies of tourist attractions (spots) should strictly enforce ticket prices and clearly mark prices, and are not allowed to increase ticket prices without authorization or increase prices in disguised form. The same tourist attraction (spot) is not allowed to charge multiple points. If it has special value and needs to be sold separately, it should be approved according to the price approval authority. Article 13 Star-rated hotels shall be assessed in accordance with the assessment authority prescribed by the state, and the provincial tourism administrative department shall establish a tourism foreign-related star-rated hotel assessment agency to be responsible for assessment. Article 14 Hotels (including resorts (villages), apartments, and cruise ships, the same below) that require star rating must submit an application to the local tourism administrative department, which shall report it to the provincial tourism administrative department step by step. . When a hotel registered with the provincial industrial and commercial administrative department requires star rating, it can apply directly to the provincial tourism administrative department.
When building, renovating or expanding a star-rated hotel, the relevant construction procedures can only be completed after obtaining written approval from the provincial tourism administrative department. Article 15: Unapproved units are not allowed to use star-rated hotel terms and signs and tourism (foreign-related) designated hotel signs.
Star-rated hotel signs are uniformly issued by the provincial tourism administrative department. Hotels that have been rated as star-rated hotels are not allowed to lower service standards at will, and no other grade signs will be displayed. Article 16: The examination and approval management of travel agencies shall be handled in accordance with relevant national and provincial regulations.
Places such as catering, shopping, medical treatment, crafts, tourism (products), entertainment and other places that require to be assessed as tourism (foreign-related) designated units shall be registered as tourism (foreign-related) with the approval of the tourism administrative department. Designated unit signs.
The signs of designated tourism (foreign-related) units are uniformly produced by the provincial tourism administrative department.
