Regulations of Hainan Province on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen the management of tourism, protect and rationally develop and utilize tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with the relevant provisions of the state and the actual situation of this province. Article 2 The term "tourism" as mentioned in these Regulations refers to the act of attracting and receiving tourists by using tourism resources and facilities, and providing them with comprehensive services such as transportation, sightseeing, catering, accommodation, shopping, culture and entertainment. Article 3 The development of tourism should adhere to the principle of integrating social benefits, economic benefits and environmental benefits, give full play to the advantages of tourism resources, highlight local characteristics, and ensure quality service and safety and hygiene. Article 4 The people's governments of provinces, cities, counties and autonomous counties shall develop tourism according to local conditions and support ethnic autonomous areas and economically underdeveloped areas to develop tourism.

Encourage foreign businessmen to develop tourism resources and build tourism facilities by means of joint venture, cooperation and sole proprietorship. Article 5 The people's governments of provinces, cities, counties and autonomous counties shall, in light of local conditions, formulate long-term and annual plans for tourism, and incorporate them into the national economic and social development plans of provinces, cities, counties and autonomous counties. Article 6 The people's governments of provinces, cities, counties and autonomous counties shall establish a coordination system between tourism departments and relevant departments to ensure the coordinated development of tourism and related industries. Article 7 The people's governments of provinces, cities, counties and autonomous counties shall attach importance to and support tourism education and cultivate tourism professionals. Eighth provincial tourism authorities in accordance with the provisions of the provincial people's government functions and powers of the province's tourism management.

The establishment and responsibilities of tourism management institutions in cities, counties and autonomous counties shall be determined by the people's governments of cities, counties and autonomous counties according to local actual conditions. Ninth tour operators should follow the principles of honesty and credit and fair competition, and operate according to law.

The term "tourism operators" as mentioned in these Regulations refers to legal persons, other organizations and individuals engaged in tourism business activities in accordance with the provisions of these Regulations. Article 10 Tourism operators may establish or join tourism industry associations according to law.

Tourism industry associations shall abide by laws and regulations, coordinate and guide their members' tourism business activities in accordance with their articles of association, provide consultation, reflect their suggestions on tourism development to the tourism authorities, and safeguard the legitimate rights and interests of tourists and tour operators. Chapter II Development and Protection of Tourism Resources Article 11 People's governments at all levels shall take effective measures to protect and rationally develop and utilize tourism resources. No unit or individual may destroy tourism resources.

The tourism resources mentioned in these Regulations refer to various natural and cultural landscapes that are attractive to tourists, can be developed and utilized for the development of tourism, and can produce economic and other benefits. Twelfth tourism resources development should highlight the natural landscape, cultural landscape and national cultural customs of tropical islands in this province. Thirteenth tourism resources and tourist attractions are relatively concentrated, and the economic benefits of tourism are remarkable. According to the relevant regulations, national and provincial tourism development zones can be designated and enjoy the preferential policies stipulated by the state and the province.

Fifteenth it is forbidden to quarry, mine, dig sand, bury graves, cut down trees, discharge pollutants and dump wastes in tourist development zones and tourist areas without authorization. Sixteenth provinces, cities, counties and autonomous counties shall be responsible for the investigation and evaluation of tourism resources in their respective jurisdictions, formulate the overall plan for the protection and rational development and utilization of tourism resources, and submit them for approval in accordance with the relevant provisions of the state.

Where included in the provincial key construction of tourist attractions planning, tourism development zone planning, organized and implemented by the provincial tourism authorities in conjunction with the relevant departments for examination and approval. Seventeenth construction of key tourism facilities projects, should obtain the written opinions of the tourism authorities, in accordance with the relevant provisions of the state and province for approval. Chapter III Tourism Management Article 18 Tourism operators shall register in accordance with the relevant provisions of the state and this province.

Travel agencies engaged in international tourism business (including travel companies and other similar organizations, the same below) must apply to the provincial tourism authorities for a travel agency business license with a business license, and operate with a business license and a travel agency business license; Travel agencies engaged in domestic tourism business shall go through the filing formalities with the local tourism authorities with their business licenses. If there is no tourism management agency, you can go through the formalities with the provincial tourism authorities with your business license.

Travel agencies that are not registered in this province shall not operate travel agency business in this province. Nineteenth tour operators' operational autonomy is protected by law, and no unit or individual may infringe upon it.

Tourism operators have the right to refuse the relevant departments to forcibly promote their designated commodities or forcibly resettle personnel; Have the right to refuse to charge and apportion in violation of the relevant provisions of the state and the province.
