Measures for the Management of Outbound Tour Leaders

Article 1 In order to strengthen the management of outbound tourism leaders, standardize their professional behavior, safeguard the legitimate rights and interests of outbound tourists, and promote the healthy development of outbound tourism, in accordance with the "Measures for the Administration of Chinese Citizens' Overseas Travel" and Relevant regulations are formulated in these Measures.

Article 2 The term “outbound tourism tour leader” (hereinafter referred to as “tour leader”) as mentioned in these Measures refers to those who have obtained the outbound tourism tour escort certificate (hereinafter referred to as “tour leader certificate”) in accordance with the provisions of these Measures. Personnel appointed by an international travel agency with the right to operate tourism business (hereinafter referred to as the "tour agency") to engage in outbound tourism leadership business.

The term “tour escort business” as mentioned in these Measures refers to the provision of full-journey companionship and related services for outbound tourist groups; as a representative of the group organizing agency, it cooperates with the overseas receiving travel agency (hereinafter referred to as the "receiving agency") to complete the travel plan arrangements ; and coordinate activities related to the travel process.

Article 3 Personnel applying for a tour leader's certificate shall meet the following conditions:

(1) Citizens of the People's Republic of China with full capacity for civil conduct;

(2) Love the motherland and abide by the laws;

(3) Travel agency personnel who can effectively assume the responsibility of leading the tour;

(4) Understand the destination country or region relevant circumstances.

Article 4 The tour group organization shall be responsible for the qualification review and business training of the personnel applying for the tour leader certificate.

The content of business training includes: ideological and moral education; foreign-related discipline education; tourism policies and regulations; basic conditions of tourist destination countries; and the obligations and responsibilities of tour leaders.

For those who have received the tour leader certificate, the organizing club must continue to strengthen ideological education and business training, establish a strict work system and management system, and conscientiously implement it.

Article 5 The tour guide certificate shall be applied for by the tour organizing agency to the local provincial or authorized tourism administrative department at or above the prefectural or municipal level, and the following materials shall be submitted: registration form for persons applying for the tour guide certificate; issued by the tour organizing agency Proof that you are qualified to work as a tour leader; and proof of professional training for those applying for a tour leader certificate.

The tourism administrative department shall issue tour escort certificates to qualified applicants for tour escort certificates and register them within 15 working days from the date of receipt of application materials.

The tourism administrative department shall reasonably issue tour leader certificates based on the legitimate business needs of the organizing agency.

Article 6 The tour guide certificate shall be uniformly formatted and produced by the National Tourism Administration, and shall be issued by the provincial or authorized tourism administrative department at or above the prefectural or municipal level where the tour group is located.

The tour leader’s pass may not be forged, altered, lent or transferred.

The tour leader’s certificate is valid for three years. Anyone who needs to continue engaging in the tour escort business after the expiration of the tour escort certificate shall apply to the tourism administrative department for registration and replacement of the tour escort certificate six months before the expiration.

If the tour leader loses his tour guide card, he should report it to the tourism administrative department in a timely manner, declare it invalid, and then apply for a replacement; if the tour guide card is damaged, he should apply for a replacement in time.

Persons who have been disqualified as a team leader may not apply for team leader registration again.

Article 7 Tour leaders who engage in tour leading business must be formally appointed by the organizing agency.

The tour leader must wear a tour guide card when engaging in tour escort business.

Persons who have not obtained a tour escort certificate are not allowed to engage in the outbound tourism tour escort business.

Article 8 The tour leader shall perform the following duties:

(1) Comply with the relevant provisions of the "Measures for the Administration of Chinese Citizens' Overseas Travel" and safeguard the legitimate rights and interests of tourists;

(2) Cooperate with the reception agency to implement the travel itinerary plan, and assist in handling emergencies, disputes and other issues during the travel itinerary;

(3) Provide travel itinerary services to tourists;< /p>

(4) Consciously safeguard national interests and national dignity, and remind tourists to boycott any words and deeds that are detrimental to national interests and national dignity.

Article 9 violates Article 4 of these Measures by not conducting qualification review or business training for those who apply for a tour guide certificate, or by lax review, or by neglecting the management of the tour leader and tour leader's business, resulting in the failure of the tour leader or If there is a problem with the tour escort business, the tourism administrative department will, depending on the severity of the case, give the tour organizer a warning, cancel the qualification to apply for a tour escort certificate, cancel the tour organizer's qualification, etc.

Article 10 Anyone who violates the provisions of paragraph 3 of Article 7 of these Measures and engages in tour escort business without obtaining a tour escort certificate shall be ordered to make corrections by the tourism administrative department. If there are any illegal gains, the illegal gains shall be confiscated and may be punished If the illegal income is less than three times, a fine of not more than RMB 30,000 may be imposed; if there is no illegal income, a fine of not more than RMB 10,000 may be imposed.

Article 11 Violates the provisions of Paragraph 2 of Article 6 and Paragraph 2 of Article 7 of these Measures if the tour leader forges, alters, lends or transfers the tour escort certificate, or fails to wear the tour escort certificate when engaging in tour escort business If the tour guide certificate is not issued, the tourism administrative department shall order it to make corrections and impose a fine of not more than RMB 10,000. If the circumstances are serious, the tourism administrative department shall temporarily detain the tour escort certificate for 3 months to 1 year, and shall not reissue the tour escort certificate.

Article 12 Anyone who violates the first paragraph of Article 8 of these Measures shall be punished in accordance with the relevant provisions of the "Measures for the Administration of Chinese Citizens' Overseas Travel".

Article 13 Anyone who violates the second, third and fourth provisions of Article 8 of these Measures shall be ordered to make corrections by the tourism administrative department, and the tour leader's certificate may be temporarily detained for 3 months to 1 year; causing serious consequences If it affects or produces serious consequences, the tourism administrative department will revoke the group leader registration and shall not apply for group leader registration again. At the same time, the group organizer shall be held accountable.

Article 14 If a staff member of the tourism administrative department neglects his or her duties, abuses his power, or engages in malpractice for personal gain, which constitutes a crime, he shall be investigated for criminal responsibility in accordance with the law; if it does not constitute a crime, he shall be given administrative sanctions in accordance with the law.

Article 15 The National Tourism Administration is responsible for the interpretation of these Measures.

Article 16 These Measures shall come into effect on the date of promulgation.
