Article 1 In order to protect the legitimate rights and interests of rural tourists, tour operators and employees, effectively protect the ecological environment, make rational use of tourism resources, and promote the sustained, healthy and high-quality development of rural tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China, the Tourism Regulations of Zhejiang Province and other relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to rural tourism activities, rural tourism industry development, service guarantee and management within the administrative area of this Municipality.

The rural tourism activities mentioned in these Regulations refer to sightseeing, vacation, leisure, entertainment, investigation and experience activities based on rural natural resources and human resources.

Article 3 The municipal, district and county people's governments shall strengthen the organization and leadership of rural tourism, establish a joint meeting system and a comprehensive coordination mechanism, regularly study rural tourism, organize and formulate policies and measures to promote the development of rural tourism, and make overall plans to solve major problems in the development of rural tourism.

Township (town) people's governments and sub-district offices shall, in accordance with the responsibilities determined by the municipal, district and county people's governments, do a good job in resource protection, industrial development, order management and dispute resolution of rural tourism within their respective jurisdictions. Rural tourism institutions established according to law are responsible for the management of related services.

Article 4 The municipal, district and county departments of culture, radio, film and television tourism shall be responsible for the overall coordination and tourism supervision and management of rural tourism development within their respective administrative areas.

City and county development and reform, education, public security, finance, human resources and social security, ecological environment, housing and urban and rural construction, transportation, natural resources and planning, water conservancy, agriculture and rural areas, commerce, health, emergency management, market supervision and management, sports, statistics, comprehensive administrative law enforcement, big data development and management and other relevant departments shall, according to their respective responsibilities, do a good job in rural tourism.

Article 5 Villagers' committees shall guide villagers to protect and rationally utilize tourism resources, and support and organize villagers to develop rural tourism; Construction and management of rural tourism facilities according to law; Strengthen autonomous management and assist relevant departments and township (town) people's governments and sub-district offices to do a good job in supervision, management and dispute settlement.

Village collective economic organizations should make use of the resources owned or used by village collectives to develop rural tourism according to local conditions.

Villagers' meetings can incorporate civilized management and order maintenance into village rules and regulations.

The supervision committee shall support and cooperate with village-level organizations such as villagers' committees to perform their duties and supervise relevant work in rural tourism according to law.

Sixth city and county culture, radio, film and television tourism and other relevant departments should strengthen the support and guidance of rural tourism industry associations, and promote their role.

Rural tourism industry associations should improve their service capabilities and carry out education and publicity, business consultation, information exchange, professional training and other services; Strengthen industry self-discipline and assist relevant departments to do a good job in supervision and management; Strengthen exchanges and cooperation with relevant industry associations; Participate in industry policy formulation, credit system construction, market information release, tourism product promotion and other activities.

Article 7 The Municipal People's Government shall focus on leisure around Taihu Lake, natural ecology in the west and folk-custom rural tourism in eastern water towns, promote the development of rural tourism with high quality, characteristics and agglomeration, and promote global tourism.

City, district and county people's governments shall, in accordance with the principle of promoting rural tourism and protecting the ecological environment, organize the preparation and implementation of special plans for rural tourism according to law, and link them with relevant special plans.

New construction, reconstruction and expansion of rural tourism projects shall meet the requirements of special planning for rural tourism.

Article 8 The municipal market supervision and management department shall, jointly with relevant departments such as culture, radio, film and television tourism, formulate and organize the implementation of local standards for rural tourism according to law, and guide rural tourism operators to provide services according to the standards.

Encourage rural tourism industry associations and operators to formulate group standards and enterprise standards according to law.

Article 9 The Municipal People's Government shall rely on the World Rural Tourism Conference and other platforms to carry out exchanges and discussions, image publicity, product promotion and other activities to enhance the quality and influence of rural tourism in this city.

Encourage and support institutions of higher learning, scientific research institutes and professional institutions to carry out research on rural tourism development.

Tenth city, district and county people's governments should promote the integration of tourism with agriculture, culture, science and technology, sports and other industries, and support the development of new industries and formats of rural tourism.

Encourage the development of characteristic tourism projects and products relying on characteristic towns, characteristic villages, Taihu Lake harbor, Sangji fish pond, patriotic education base and tourism resources such as silk, tea, porcelain, lake pens, wine and bamboo.

Encourage the excavation and utilization of museums, memorial halls, art galleries, intangible cultural heritage, farming culture, farming folk customs and other tourism resources, and develop rural tourism industry.

Eleventh city, district and county people's governments should integrate the tourism resources within their respective administrative areas and their surrounding areas, and guide rural tourism industry associations and operators to design, develop and promote rural tourism routes.

Encourage rural tourism operators to strengthen cross-regional and cross-format cooperation, develop and promote rural tourism routes, and organize related tourism activities.

City, district and county people's governments shall guide industrial and commercial capital, village collective economic organizations and villagers to develop and operate local tourism resources.

Thirteenth city, district and county people's governments may, in accordance with laws, regulations and relevant provisions of the province, formulate measures for the management of homestays (farmhouses) in accordance with the principle of promoting the development of homestays (farmhouses).

City, district and county cultural radio, film and television tourism departments should standardize the rating of homestays (farmhouses), establish an exit mechanism, and support the development of boutique homestays (farmhouses).

Fourteenth to encourage the construction of leisure farms, leisure farms and other rural tourism projects, to carry out fruit and vegetable picking, product display, popular science education, farming experience and other activities.

The people's governments of cities, districts and counties can give priority to ensuring the construction land for leisure agricultural projects that meet the requirements of investment, output value, employment and industrial scale.

Rural tourism operators shall build and use leisure agricultural facilities according to law.

Fifteenth city, district and county people's governments should make use of the achievements of beautiful countryside construction, improve tourism facilities, tap tourism resources, and promote the construction of scenic villages according to the actual situation.

Where a village collective economic organization entrusts a professional institution to operate a scenic village, it shall stipulate the entrusted collective assets, operating period and interest distribution. The municipal market supervision and management department shall, jointly with the relevant departments of culture, radio, film and television tourism, formulate and promote the model text of the entrusted management contract of scenic spots and villages.

Sixteenth city and county finance departments shall supervise the procurement agencies to release government procurement information in a timely and effective manner; According to the law, qualified rural tourism operators such as homestays (farmhouses) and leisure farms will be identified as short-listed suppliers for government procurement.

Encourage state organs, institutions, state-owned enterprises and trade union organizations to entrust qualified rural tourism operators such as homestays (farmhouses) and leisure farms to provide services such as transportation, accommodation, meetings and staff recuperation.

Seventeenth to encourage the mining, production and sales of agricultural and sideline products with local characteristics, handicrafts, cultural and creative products, support the establishment of agricultural and sideline products trading market, specialty stores, rural e-commerce and other platforms to promote tourism and shopping.

Article 18 People's governments at all levels or villagers' committees shall, according to the actual needs of rural tourism development, promote the construction and management of rural roads, tourist greenways, tourist distribution (transfer) centers, traffic tourist sites, parking lots, charging piles, public toilets and other tourist facilities.

Twentieth city, district and county people's governments should reserve land space and arrange certain land use indicators for rural tourism projects every year. Through the comprehensive improvement of land in the whole region, certain land use indicators should be arranged for the construction land linked to conservation for the development of rural tourism.

City, district and county people's governments can provide land for rural tourism projects in accordance with laws and regulations and the development and utilization policies of low hills and gentle slopes and ecological "sloping villages and towns" in this province, by means of point layout, vertical development and differential land supply.

Encourage the use of scattered rural construction land, idle homesteads, idle farmhouses and abandoned mines to develop rural tourism projects according to law.

Encourage and support institutions of higher learning, secondary vocational schools and rural tourism operators to cooperate and cultivate practical rural tourism professionals.

Rural tourism industry associations and operators should strengthen the service skills training of employees and enhance the service ability of rural tourism professionals.

Twenty-third city, district and county people's governments should incorporate rural tourism into the construction of smart cities and use modern information technology to improve the scientific, refined and intelligent management level of rural tourism.

The tourism public information service platform should expand its service functions and provide tourism services such as information consultation, dispute resolution and credit evaluation.

Twenty-fourth municipal market supervision and management departments shall, in conjunction with the relevant departments of culture, radio, film and tourism, formulate local standards for rural tourism signs with local characteristics according to national standards.

Support and guide rural tourism industry clusters, scenic spots and scenic villages to set up signs according to local standards.

Twenty-fifth rural tourism projects in the use of special equipment, inspection, testing and safety supervision and management, in accordance with the "Special Equipment Safety Law of the People's Republic of China" and other relevant laws, regulations and rules.

Conditional rural tourism industry clusters, scenic spots and scenic villages can establish a consumer rights protection first payment mechanism.

People's governments at all levels should support the establishment of a volunteer team for mediation of rural tourism consumption rights protection.

Twenty-seventh township (town) people's governments and sub-district offices where tourism resources are located can take the form of announcements and setting up safety warning signs to remind tourists to pay attention to preventing risks.

Rural tourism operators shall explain or warn tourists in advance in an express manner according to law to ensure tourism safety.

Rural tourists may not organize or implement tourism activities that violate the safety warning provisions. If the accident causes rescue expenses, the organizers of tourism activities and other rescued personnel shall bear the corresponding rescue expenses according to law.

Twenty-eighth rural tourism operators should clearly mark the price according to law, and explain the pricing unit and method to tourists in advance.

Twenty-ninth city, district and county cultural radio, film and television tourism departments shall, jointly with relevant departments, strengthen the construction of rural tourism credit system, collect and integrate rural tourism credit information, and incorporate it into the credit Huzhou information system according to law.

City, district and county cultural radio, film and television tourism departments should implement classified supervision according to the credit status of rural tourism operators, and focus on supervision and inspection of operators with bad information.

City, district and county cultural, radio, film and television tourism departments shall implement the provisions of the state on uncivilized tourism records and advocate civilized tourism.

Thirtieth acts in violation of the provisions of this Ordinance, laws, administrative regulations, local regulations of this province have legal liability provisions, from its provisions.

Article 31 In violation of the provisions of Article 28 of these regulations, rural tourism operators fail to clearly mark the price according to law or explain the pricing unit and method to tourists in advance, the municipal, district and county market supervision and management departments shall order them to make corrections, confiscate their illegal income and may impose a fine of not more than 5,000 yuan.

Article 32 Where people's governments at all levels, relevant departments and their staff abuse their powers, neglect their duties or engage in malpractices for selfish ends in the supervision and management of rural tourism, the competent department shall order them to make corrections according to the management authority, and the directly responsible person in charge and other directly responsible personnel shall be punished according to law.

Article 33 These Regulations shall come into force from June 65438+10 +2020 10.
