Legal analysis: At present, China's tourism laws and regulations mainly include the Tourism Law of the People's Republic of China, Travel Agency Regulations, Detailed Rules for the Implementation of Travel Agency Regulations, Measures for the Administration of Travel Agency Liability Insurance, Interim Measures for the Administration of Border Tourism, Regulations for the Administration of Tour Guides, Classification and Evaluation of Stars in Tourist Hotels, and Interim Provisions on Tourist Complaints. Tourists are subject to laws and regulations such as the Exit and Entry Administration Law of People's Republic of China (PRC), the Passport Law of the People's Republic of China, and the Measures for the Administration of Overseas Travel of China Citizens. Laws and regulations on the development, utilization and protection of tourism resources, such as the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Regulations on Scenic Spots and the Regulations on People's Republic of China (PRC) Nature Reserve. People's Republic of China (PRC) Railway Law, People's Republic of China (PRC) Highway Law, People's Republic of China (PRC) Civil Aviation Law, China Civil Aviation Passenger Baggage International Transportation Rules, Railway Passenger Transportation Compensation Provisions and other tourism transportation laws and regulations. People's Republic of China (PRC) Consumer Protection Law and other laws and regulations to protect the rights and interests of tourists.

Legal basis: Regulations on Scenic Spots

Twenty-fourth scenic spots in the landscape and natural environment, should be based on the principle of sustainable development, strict protection, and shall not be destroyed or arbitrarily changed. Scenic area management agencies should establish and improve the management system of scenic resources protection. Residents and tourists in scenic spots should protect the scenery, water bodies, forest and grass vegetation, wild animals and facilities in scenic spots.

Twenty-fifth scenic spots management agencies should investigate and identify the important landscapes in the scenic spots, and formulate corresponding protection measures.

Article 26 The following activities are prohibited in scenic spots: (1) Activities such as mountain cutting, quarrying, mining, land reclamation, grave building, etc. that destroy the landscape, vegetation and topography; (two) the construction of explosive, flammable, radioactive, toxic and corrosive goods storage facilities; (3) scribbling or smearing on scenery or facilities; (4) littering.
